A hearing had been held on the project on Davember 8, 1963. The purpose of this hearing is to provide property omera with an opportunity to present objections to the assessment. Objections rust be presented in writing and state grounds that benefits derived from the project are not equal to the asseQQ"nts against the property. CONSIDERATION Of RE -SU REZONING REQUEST FOR POSSIBU PUBLIC HEARINGS ZOA 64®11, GORDON GRANAMs. Lots 13 t9r—u 16, Biock 13, Hamilton s Addition to Mechanicsville. Rezone from R-3, general multiple family dwelling, to C,R1, local business area. Mr. and Mrs. Graham were present. A review was made of the stand that.the. Planning Commission had taken at the last meeting.. The conclusion reached was to consider a specific plan for rezoning in this area, that part of the stipulation, would be the presentation by Mr. Graham of how they plan to use this piece of property, the purpose being that this information, along with other studies conducted at this time would be used in arriving at a recommendation to the Council. Mr. Graham explained the property was purchased in 1948 and although It is in a zoning category.which permits apartments, be did not feel that an apartment building would be the proper structure on this property because of the traffic hazard. Mr. Graham stated there were several types of businesses he would like to get in, but until the property was zoned for such, he felt his hands were tied. The Commission asked Mr - Graham if he'had considered applying for a Special Use Permit in order to get the type of business that he had in mind. Mr. Graham replied that he realized he could got a Special Use Permit but if, after the initial permit were issued, the business was not successful -then in order to try something else, therm could be several months delay getting a new Special Use Permit. Mr. Graham felt Haat the land should be used in order to ease the tax burden. It was decided that the work which is going to be done on University Avenue would probably reflect in tate Increased value of the property. The C, mission felt that Mr. Graham's proposed plan could be accomplished by use of a Special Use Permit and asked him to reconsider his request. The Mayor stated that the Council was aware of the close bid of the Lakeland kick and Stone Company. and that the Lakeland Brick and Stone Company was a Fridley firm. Councilman Wright stated that the Council could not charge the tax payer an extra amount for using a local firm. The Mayor stated further that the low bidder would have cause to bring suit against the City of Fridley for awarding the bid to a local firm when the other bidder had the low bid. Motion by Kirkham to concur with the recommendation of the Consulting Engineer and award the bid to the Karl Dedolph Construction Co. for the amount of $16,150.00. Seconded by Thompson. The City Manager stated that the Phillips 66 Station driveways had not beeaapproved by the Safety Committee in its new location. Mr. Schlesinger shorted the Council drawings of the proposed Phillips 66 Station in its new location. Motion by Wright to approve construction of a Phillips 66 Station at the location of 5755 University Avenue Northeast, contingent upon compliance with the change in driveways as directed by the Safety Commission. SPEa.� BgggG BOARD =TING 14XNUTES • MARCH 30, 1965: The City Manager explained that.& Special Meeting of the Building Board had - been held to consider a Building Permit for the Gulf Oil Corporation -to -construct a service station at 5300 Central Avenue Northeast, the service station to be constructed of cement and steel at an estimated cost of $30,000.00. Councilman ]right asked whether the Safety Committee had taken action on the application for a Building Permit at this tine. The City Manager answered, "Wo." motion by Sheridan to approve the application by the Gulf Oil Corporation for a service station to be located at 5300 Central Avenue Northeast, contingent upon approval of the Safety Committee. Seconded by Wright. Upon as voice vote, there being. no nays, the motion carried unanimously. BOARD OF APPEALS MT1NGS v MMCR 24, 1965: Neither Me. nor Mrs. Gunderson were present at the Council Meeting. The City r explained the action of the Board of Appeals granting the Special Use Permit for -the construction of Double Bungalows with a stipulation that there be a single car garage for each unit, plus paved off *street parking for one car _ 6J— + Page 7. per unit, and requiring stucco instead of shakes siding. The Mayor asked the City Manager if he could explain the requirement for stucco instead of shakes siding. The City Manager answered that'he didn't know the reason for the requirement but the Council could change this stipulation if it saw fit to do so. The City Manager explained further that under the Ordinance to grant Special Use Permits the Council could make any stipulations contingent upon granting the Special Use Permit. Motion by Wright to set a public hearing on the Special Use Permit. Seconded by Sheridan. Upon a voice vote, there being no nays, the motion carried unanimously. Ron Johnson, representing Clemron, Inc., was present at the Council Meeting. The City Manager explained that the right-of-way on Jackson Street had been increased from 60 feet to 66 feet and this was a contributing factor to the request for the reduced setback of the houses on.Jackson Street. Councilman Wright asked Mr. Johnson if approval were granted for a variance from the setback requirement to 30 feet, did Clemron, Inc. plan to build all houses along Jackson Street at the saw setback. Mr. Johnson answered, no, that buyers had requested that the various setbacks of 30 feet to 35 feet be used on the street. The City Attorney asked Mr. Johnson what cove -ants Clemron, Inc. had with the buyers concerning the setback. Mr. Johnson stated that covenants require a 30 foot minimsm setback. Notion by Wright to approve and grant the request for variance on Lots 1 through 15, Block 1, Melody Mannor, Third Addition to a 30 foot minimum setback. Seconded' by Sheridan. Upon a voice vote, there being no nays, the motion carried unanimously. Mr. Norberg was present at the Council Meeting. He explained that in order to locate a garage on the yard and provide space for a car to park in the driveway of the garage without taking all of the yard it was necessary to move the garage within 10 feet of the street, There is a hams located on the lot immediately behind this lot which would probably be condemned and removed and the next home would be built, as Nr. Norberg described it, back to back with this proposed residence and would not be facing the side street as the present home now does. SPECIAL USE PEST: DOUBLE BUNGALOW - G. A. GUNDERSON: Lots 1 and 2. Block 3, Gunderson Terrace. Mr. Gunderson was present. It was noted there were objectors to the Special Use Permit for double bungalows at the February 24th meeting, but the objectors were not present at the March 24th meeting. The lots, concerned in this request, are back to back, one facing Onondaga and the other Fireside Drive. At the March 24th meeting Mr. Gunderson returned with a certificate of survey showing the location of the double bungalows and was informed that, something besides stucco should be used as a siding. In answer to a question from the Commission, Mr. Gunderson stated houses were built on either sides of these lots. MOTION by Johanson, seconded by Bandel, that the Planning Commission concur with the Board of Appeals and recommend approval of the Special Use Permit for a double bungalow on Lot 1, Block 3, and Lot 2, Block 3, Gunderson Terrace, be granted. Vote not taken. MOON by Johanson, that his first motion be withdrawn and that the Special Use Permit for G. A. Gunderson be tabled until April 22nd to give the members of the Planning Commission an opportunity to inspect the site. Mr. Bergman seconded the motion. Upon a voice vote, all voting aye, the motion carried. 9. DISCUSSION OF LAND USE IN HOSPITAL AREA: Mr. Johanson stated that no one has come up yet with any definite plan for this area. Mr. Wagner reported that Mayor Nee asked him to arrange a meeting a,: the hospital with people interested in the land use for the hospital area. It is understood that there are some doctors who would like to see a building in what has always been considered a good place for a clinic. It was suggested that the meeting would include the Administrator of the hospital, Plw,niag Commission Chairman, Consultant, and the Doctors who are interested in the area. 10. PARR PL NG: PARKS & PLAYGROUNDS MINIMS OF MARCH 15, 1962 - Page 2s Mr. Hughes, on behalf of the Parks and Playgrounds Committee, stated the committee would like to obtain the services of Mr. Hodne to start them on a program for planning at Locke Park and one of the othenr small parks. I L/ BOARD OF APPEALS MEETING-1FEBRUARY 24, 1965 The meting was called to order by Chairman Nawrocki, at 7:35 P.M. Members Present: Nawrocki, Fitzpatrick, Gabrick, Saunders Member Absents Goodrich There was no one present in favor of the request for a special use permit. Mrs. David Carlson, 1395 Onondaga Street Northeast, and Mrs. Lorraine Malich, 1425 Onondaga Street, were present, and stated that they objected to putting double bungalows in that area. Motion by Fitzpatrick, seconded by Saunders, to continue this hearing to Wednesday. March 24, 1965 at 7130 P.M.. and that Mr. Gunderson be notified that he must present a plot plan of the two lots showing the locations of the proposed double bungalows, and also that he must be present at the meeting. Upon a voice vote, there being no nays, Chairman Nawrocki delcared the motion carried. ADJO T: There being no further business, Chairman Nawrocki delcared the meeting adjourned at 8:10 P.M.
