Public purpose served by this requirement is to eliminate the condition of overcrowding in residential areas. Section 205.07.01.B, (4) , (a) requires the square footage of an accessory building to -rot exceed 100% of the first floor area of the dwelling unit or a maximum. of 1,000 square feet. Public purpose served by this requirement is to maintain the residential quality of the neighborhood by limiting the size of accessory structures. B. He presently has a two car attached garage and a 12 ft. by 16 ft. storage shed with a total of 672 sq. ft. He would now like to -build a large 26 ft. by 46 ft. garage to house his personal property and also space for a shop that he ria has in his basement. In addition to these variance requests, he has also applied for a special use permit for more than one accessory building which will be heard by the Planning Commission on August 10, 1988. If he is allowed to construct this new garage, his total lot coverage will be about 13%. If the Appeals Commission approves this request, it should be stipulated that it is contingent upon City Council approval of the special use permit. Mr. Clark stated that Lot 28 has been split so the 73 1/2 Avenue cul-de-sac does not extend as far as the petitioner's lot (lot 29), and there was no way of knowing if it ever would. Be stated there were apartment buildings on Lots 23 and 25 (fronting on 73rd Avenue) which .pretty well restricted double frontage lots for Lots 22, 24, and 26. Mr. Clark stated the petitioner presently has a two car garage (24 ft. x 20 ft.), a 16 ft. x 12 ft. existing shed, and he would like to build a 26 ft. x 46 ft. building. The petitioner was in code ccupliance without the proposed building, because he was allowed to have two accessory buildings, provided the second one does not exceed 240 sq. ft. Because of the third building, he must also apply for a special use permit. Because all these buildings added together exceed 1,400 sq. ft. and the largest building exceeds 1,000 sq. ft., the petitioner needs variances to do what he wants to do. APPEALS COmmISSION b=ING, AUGUST 2, 1988 PAGE 6 Mr. Clark stated that prior to the variance application, he had discussed with Mr. Kallroos the need for such a large building. He stated it was a big lot, about twice the depth of a normal lot, so lot coverage was not a consideration at all. It was his understanding the building would be one-story and would meet the height requirements. The exterior would match the exterior of the house. Mr. Barna stated the proposed building was shown set back 30 ft. from the rear lot Vie. If the lot was ever split, would the 30 ft. setback meet a front yard setback for the new lot7 Mr. Clark stated 25 ft. would be used for street, which would mean that the building would only be 5 ft. off the 50 ft. right-of-way, so it would not meet any requirements for front yard setbacks. In order to locate the building on the lot if the lot were ever split and the proper setback was used, it would have to be set back 60 ft. fraFn the rear property line. Mrs. Kaliroos stated she did not know how the street could ever go through because of the apartment buildings back there. Mr. Sherek stated he believed the discussion has always been of extending the street to the apartment buildings and then exiting past the apartment buildings onto 73rd Avenue. He did not think there were any plans that included Mr. Kallroos' property. Ms. Savage asked about the hardship. Mrs. Kallroos stated that within the last few years, she has developed allergies and asthma. She must take -shots and use.a.breathalizer. She is very allergic to wood dust, and woodworking is her husband's hobby. Their son also has allergies, so the woodworking must be moved out of the louse. Ms. Savage asked why the petitioner needed such a large building. Mr. Kallroos stated he would like to get as big a building as he can. Mrs. Kallroos stated they have a boat and snowmobile, an extra car, and other equignent, plus the woodworking shop. They would like to store these things inside rather than having to leave them outside. Mr. Kallroos stated that regarding the exterior of the building, his house was rough cedar and the new building would be rough fir. He stated he would also be putting up a privacy fence. Mr. Kallroos stated he had a Letter from his neighbor at 1434 Onondaga who had no objections to the new building. MOTION by Ms. Savage, seconded by Mr. Sherek, to receive the letter from Harriet Hjort, 1434 Onondaga Street, stating she had no objection to the additional accessory building proposed by Mr. Kallroos. Ms. Savage stated she was just concerned about the size of the new building. It was practically as big as the house. MOTION by Mr. Sherek, seconded by Ms. Savage, to close the public hearing. UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON BARNA DECZAM THE PUBLIC HEARING CILDS® AT 8:05 P.M. Mr. Sherek stated he was in favor of granting the variance. The public purposes served by the code requirements were to e ;m nate the condition of overcrowding in residential areas and to maintain the residential quality of the neighborhood by limiting the size of accessory structures. He stated he felt this was a special situation with this lot. The hardship by itself did not necessarily deem that a building of this size was necessary, but he did not think it would cause any problems. The lot was very large, and the new building would be next to the apartment building garages. The building would not look like such a large building in comparison to the garages. Mr. Barna stated this was not the first time a huge garage was built in the City of Fridley. He stated some large garages look out of place and some do not—it depended upon the placement and the design. In this particular instance, it would not look cut of place. He found the hardhip, asthma and allergies to wood dust, to be a viable hardship. There would be no driveway to the building, and the back yard would be landscaped. He felt granting the variance would still be in keeping with the intent of the code. Ms. Savage stated she still had some reluctance with this request because she felt extra large accessory buildings can tend to aesthetically spoil the residential character of a neighborhood. however, she could understand the petitioner's reason for wanting such a large building. She stated she had been persuaded by her fellow commissioners that the spirit of the code would still be met. The large lot was an important factor in this case. She could clearly understand the hardship that has been described, and she would vote in favor of the variance.
