Per Section 205.07.03.D.(3).(a) of the Fridley City Code, to

2, Jim Lund Estates, the same being 1510 Onondaga Street N.E.

DECLARED THE MOTION CARRIED AND THE PUBLIC HEARING OPEN AT 7:43
P.M.
Ms. McPherson stated the property is located at the intersection
of Pine Tree Lane and Onondaga Street and is a corner lot. The
property is zoned R-1, Single Family Dwelling, as are most of the
surrounding properties. There is some R-3, General Multiple
Dwelling, zoning adjacent to 73rd Avenue.
Ms.. McPherson stated the petitioner is proposing to construct a
three -season porch off the rear of the existing dwelling. The

Code defines the front yard as the shortest of the two street CA
frontages; therefore, the front yard is to the side of the dwelling
and the dwelling faces what is the side corner of the lot. Because
of the Code definition for the front yard, on corner lots this
creates a rear yard situation for what functions as the side yard.
The rear yard setback cannot be less than 25% of the lot depth with
not less than 25 feet allowed or more than 40 feet required for the
main building.. In' this case, the minimum setback for the rear
yard, which functions as the side yard, is 25 feet.
Ms. McPherson stated the existing dwelling is 22.7 feet from the.
lot line at the closest point; therefore a variance is needed for
the existing encroachment. The three season porch as proposed
meets the 10 foot side yard setback and does not require a
variance.
Mr. Pfeiffer stated he had nothing to add to the staff's report.
MOTION by Ms. Smith, seconded by Dr. Vos, to close the public
hearing.
UPON A VOICE VOTE, ALL VOTING AYE, VICE -CHAIRPERSON KUECHLE
DECLARED THE MOTION CARRIED AND THE PUBLIC HEARING CLOSED AT 7:48

Request
The petitioner requests that a variance be granted to reduce
the rear yard setback from 25 feet to 22.7 feet to correct an
existing condition. The request is for Lot 1, Block 2, Jim
Lund Estates, generally located at 1510 Onondaga Street N.E.
Site
The subject parcel is a corner lot located at the intersection
of Pine Tree Lane and Onondaga Street. The property is zoned
R-1, Single Family Dwelling, as are the surrounding parcels.
Located on the property is a single family dwelling unit with
an attached garage.
Analysis
Section 205.07.03.D. (3). (a) of the Fridley City Code requires
a rear yard setback of not less than 25% of the lot depth with
not less than 25 feet permitted or more than 40 feet required
for the main building.
Public purpose served by this requirement is to provide rear
yard space to be used for green areas which enhance the
neighborhood.
The subject parcel is a corner lot. As defined by Code, the
shorter of the two street frontages is defined as the front
yard. The house faces the side corner; therefore, the "side
yard" is defined by Code as the rear yard. The setback for
this "side yard" as required by Code is 25 feet. The existing
dwelling unit is 22.7 feet from the side lot line. If this
was an interior lot, it would be in conformance with the Code
requirement, and the proposed three -season porch would violate
the rear yard setback requirements. However, as presented,
the three -season porch is in conformance with the 10 foot side
yard setback requirement.
