In response to the letter from Laverne C. Edson, dated August 15, 1977,
regarding the above subject matter, a review in the field indicated
there would be no major ob$truction to any existing or proposed drainage
patterns; therefore, it is recommended that this encroachment be allowed
with the stipulation that letters of release from Cable TV, Northern
States Power, Minnegasco, and Northwestern Bell Telephone be obtained
indicating no objections to this encroachment.

Mr. Tom Colbert, Assistant City Engineer, stated the Planning Commission reviewed this
request for a lot split and has recommended approval. ,
MOTION by Councilman Schneider to approve Lot Split L.S. #77-09 for DeGardner
Realty. Seconded by Councilman Hamernik.
Mr. Qureshi, City Manager, questioned the potential of any additional assessments on
the property and felt this should be checked.
UPON A VOICE VOTE TAKEN ON THE MOTION, all voted aye, and Mayor Nee declared the
motion carried unanimously.
MOTION by Councilman Hamernik to receive the minutes of the Planning Commission
Meeting of August 17, 1977. Seconded by Councilwoman Kukowski. Councilman
Schneider questioned the procedure followed regarding the Hyde Park Area at the Appeals
Commission Meeting on August 9, 1977.
Mr. Qpreshi, City Manager, explained because it was an R-1 use of the R-3 property,
it was determined this did not have to be passed on to Council.
Councilman Schneider indicated he did not have any problem with the action taken,
but just wanted to make sure it was consistent.
UPON A VOICE VOTE TAKEN ON THE MOTION, all voted aye, and Mayor -Nee declared the
motion carried unanimously.
RECEIVING THE MINUTES OF THE POLICE COMMISSION MEETING OF AUGUST 16, 1977:
MOTION by Councilwoman Kukowski to receive the minutes of the Police Commission
Meeting of August 16, 1977. Seconded by Councilman Schneider. Upon a voice vote,
all voting aye, May Nee declared the motion carried unanimously.
RECEIVING THE MINUTES OF THE POLICE COMMISSION MEETINGS OF AUGUST 30, 1977 AND
SEPTEMBER 9, 1977:
MOTION by Councilman Hamernik to receive the minutes of the Police Commission Meetings
of August 30 and September 9, 1977. Seconded by Councilwoman Kukowski. Upon a
voice vote, all voting aye, Mayor Nee declared the motion carried unanimously.
CONSIDERATION OF A REQUEST FOR APPROVAL OF A ONE FOOT EASEMENT ENCROACHMENT AT 1580
UNUNDAGA STREET, BY LAVERN C. EDSON, LOT 2, BLOCK 1, DELEIER ADDITION:
Mr. Tom Colbert, Assistant City Engineer, stated a letter was received from Mr. Edson
requesting a one foot encroachment into the easement. He indicated there would be no
major obstruction to any existing or proposed drainage pattern, and that letters were
received from Cable TV, Northern States Power, Minnegasco and Northwestern Beil
Telephone indicating no objections to this encroachment.
MOTION by Councilman Schneider to.grant the request for a one foot encroachment on
the easement for Lot 2, Block 1, Deleier Addition. Seconded by Councilman Fitzpatrick.
Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously.

RBING FOR CONCRETE CURBING IN PARKING LOT CONSTRUCTION:
Mr. David Brink of Designware Industries Inc. appeared before the Council regarding a
request to substitute asphalt curbing for concrete curbing in their parking lot
construction.
Mr. Colbert, Assistant City Engineer, stated, at the time the building permit was
issued in November, 1973, it was agreed that the parking lot would be brought up
to City standards within one year of completion of the Mississippi Street underpass.
Mr. Brink stated in order to provide concrete curbing, it would cost an additional
$5,000. He stated they have an existing asphalt curb which is 16 years old and felt
this was a testimonial to the durability of asphalt. He requested favorable action
from the Council to permit an asphalt curb instead of a concrete curb.

Mr. Qureshi, City Manager, stated when the standards were reviewed and taking into
consideration the cost benefit for a long period of time, it was decided concrete
curbing was a better investment, and in 1969, standards were adopted that all new
construction would have concrete curbing.
Mayor Nee felt the Council would have a problem of finding the rationale for changing
the ordinance.
Councilman Hamernik stated this requirement for concrete curb is part of the code and
others have complied and felt he could not put himself in the position to say that
what the City has in their code is not acceptable.
Mr. Qureshi, City Manager, questioned Mr. Brink if he had investigated the other
method of construction of the concrete curbing.
Mr. Brink stated they were not able to get any favorable quotes that would save
them any appreciable amount of money. Mr. Brink also indicated they would be providing
more parking than is needed.
Mr. Qureshi felt if there is no potential for them to need the additional parking,
possibly something could be worked out to have a smaller area blacktopped, thus
reducing some of the cost and applying this to the concrete curb. He felt, as long
as the land was available, if additional parking was required in the future, it could
be put in at that time.
Mr. Brink still felt it was difficult to justify the expense for concrete curbing.
Councilman Hamernik felt consideration of Mr. Qureshi's suggestion to blacktop a
smaller area of the parking lot and save in this regard may be a favorable solution.
Another gentleman from Designware, Inc. commented this suggestion may not work from
the standpoint of providing a good traffic flow pattern.

RECONVENED:
Reconvened at 11:00 P.M. All Council members were present.
Mr. Qureshi suggested the staff work with Mr. Brink of Designware Industries, Inc.
to check further into estimates for the concrete curbing.
MOTION by Councilman Schneider to receive this request by Designware Industries, Inc.
Seconded by Councilman Hamernik. Upon a voice vote, all voting aye, Mayor Nee
declared the motion carried.unanimously.
CONSIDERATION OF APPROVAL OF FINAL APPLICATION FOR OUTDOOR ATHLETIC COURT GRANT:
MOTION by Councilman Schneider to approve the final application for the outdoor
athletic court grant. Seconded by Councilwoman Kukowski. Upon a voice vote, all
voting aye, Mayor Nee declared the motion carried unanimously.
REQUEST -FOR INCREASE OF PENSION BENEFITS BY FRIDLEY FIREFIGHTERS:
Deputy Chief Aldrich of the Fire Department appeared before the Council to answer
any questions regarding the increase in pension benefits for the Fridley firefighters.
Councilwoman Kukowski questioned the last increase in benefits and Mr. Aldrich
stated in December, 1975. Deputy Chief Aldrich called the Council's attention to
the letter of May 3, 1977 from Stennes and•Associates, Inc., Actuaries and Consultants,
indicating the increase is within the limits of the excess of funds.
Deputy Chief Aldrich also pointed out this study by Stennes and Associates was done
in May and it is not proposed to have these increased benefits go into effect until
January, 1978.

I received your letter dated March 9, 1992 in which you requested
the following information:
1. City sewer and water rates.
2. Zoning classifications for the property located at 85th and
University Avenues.
3. Status of noise reduction for Onan's generators, located at
1400 - 73rd Avenue.
In response, I have compiled the following information:
1. Resolutions 34-1990 and 101-1991 regarding the water and sewer
rate changes. These are the current rates under which the
City is billing. Additional information regarding water and
sewer billing procedures may be directed to Judy Melham at
572-3529.
2. For your information, I have provided you the C-2, General
Business and M-2, Heavy Industrial zoning district
regulations. I have also included a zoning map of the
property at 85th and University Avenues. The property is
currently zoned both C-2 and M-2. I only included the zoning
district regulations for the zoning classifications for which
the property is zoned. These zoning code sections include
uses permitted, special uses, lot requirements, and
landscaping. If you have any specific questions regarding the

Dear Mr. Thompson:
I am in receipt of your letter dated July 15, 1992, in which you requested
the following information:
1. Notification of future hearings and meetings where decisions
regarding the Wal-Mart proposal may occur.
2. Identification of those responsible for reviewing the ground water
study.
3. Copies of the ground water study.
You have been placed on the mailing list for the Wal-Mart land use items; the
plat and rezoning requests. Currently, we anticipate that the City Council
will hold a public hearing at their August 3, 1992, meeting, and it is
possible that a decision regarding the requests could be made by the Council
at their August 17, 1992, meeting. Enclosed please find copies of the
hearing notices for your review.
At the writing of this letter, the City has not received the technical study
from the developer. The study will be reviewed by the City Naturalist, the
Public Works Director, the Community Development Director, and the Planning
Assistant. The City Naturalist and Public Works Director have the most
technical expertise regarding ground water issues. As soon as the City
receives the study, a copy will be forwarded to you for your information.
The Springbrook Nature Center Foundation has tentatively scheduled August 10,
1992, to discuss the study and staff's recommendations. The Nature Center
Foundation will make a formal recommendation to the City Council regarding
the proposed development at that time. If you wish to attend the meeting,
the Foundation meets at the Nature Center at 7:30 p.m..

RE: Sound Testing / Onan
Dear Mr. Thompson:
Last month I contacted you to discuss your concerns regarding noise
emitted by the Onan facility. At that time, I indicated that I
would perform sound testing in cooperation with the Fridley Police
Department and report my findings to you. Since I have been
unsuccessful in trying to reach you by telephone during the past
few days, I thought that I would pass along this information in
writing.
The sound testing which I performed revealed no violations of the
daytime noise limits of 60 decibels (dBA). Nighttime readings
obtained from your area by the Fridley Police Department show
levels of 49-55 dBA during that time in which the acceptable limit
in residential districts is 50 dBA. Based on these readings and
the presence of other noise sources (vehicles, animals, miscella-
neous noises), the officer conducting the test concluded that no
measurable noise violation could be attributed to the Onan facility
at that time.
I am sending a letter to Mr. Lawrence Day of Onan to once again
express your concern regarding this issue and to request that the
company continue to work on its improvements which will reduce the
sound level. I would like to stay in touch with you regarding this
issue as Onan progresses toward completion of this project.

RE: Sound Test Results at Onan/1400 - 73rd Avenue N.E.
Dear Mr. Thompson:
Approximately two months ago, we discussed the status of the noise
issue regarding the Onan facility. At that time, I stated it was
my understanding that Onan had completed the majority of its noise
reduction project. I indicated to you that I would conduct further
sound tests to determine whether or not an actual noise reduction
had occurred.
During the past two months, I have conducted sound testing adjacent
to the Onan facility. The following chart shows these readings and
their comparison with noise measurements taken prior to the noise
reduction project.

From these measurements, it appears that Onan's noise reduction
project has produced a slight decrease in sound levels emitted.
From analyzing these results, it would appear that there is no
violation of the noise ordinance near your residence and only the
possibility of a slight violation along 73rd Avenue. (While the
measurements observed exceed 50 dBA, the sound measurement device
used does not filter out sound from other sources.) I have
enclosed a copy of the Fridley Noise Ordinance for your review.
