Consideration of a variance to reduce the side yard setback for living area from 10 feet to 7.4 feet to recognize an existing non -conformity, to rebuild existing decks, generally located at 1578 Osborne Road NE. MOTION by Dr. Vos, seconded by Mr. Jones, to open the public hearing. UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON KUECHLE DECLARED THE MOTION CARRIED UNANIMOUSLY AND THE PUBLIC HEARING OPENED AT 7:32 PM. Scott Hickok stated the petitioner is seeking a variance to reduce the required side yard setback for living space from 10 feet to 7.4 feet in order to recognize an existing non -conformity at his residence at 1578 Osbome Road. The recognition of this non -conformity is required prior to issuance of any building permits for this property. Mr. Hickok reviewed the summary of hardship submitted by the petitioner as follows: "I am requesting a side yard variance on the existing house to allow me to rebuild two existing decks that are in disrepair and need to be brought up to code. North of the subject property is Spring Lake Park. The property is located on Osborne, East of Central Avenue. The existing home was built in 1959. City Code requires a minimum side yard setback of 10 feet between living area and the side yard property lines. The petitioner is seeking a variance to reduce the side yard setback from 10 feet to 7.4 feet to simply recognize an existing non -conformity. City Code also requires that all single family lots with a minimum lot area of 9,000 square feet have at minimum a double stall garage. Currently, there isn't a garage on the property. As part of this variance approval, staff is stipulating that a garage he built on the property within one year of the variance approval. Mr. Hickok stated the petitioner plans to reconstruct both of the existing decks on the house as they are currently in a state of disrepair. The location of decks meets all setback and lot coverage requirements. As was stated earlier, in order to reconstruct the decks to the home, recognition of the side yard setback non -conformity is required. City staff has no recommendation, Mr. Hickok explained, as this request is within previously granted dimensions. Similar variances granted include: • VAR #02-20 257 69th Avenue — Variance granted to reduce the side yard setback for living area from 10 feet to 7.1 feet to recognize an existing non -conformity. • VAR #00-19 1352 Hillcrest Drive — Variance granted to reduce the side yard setback for living area from 10 feet to 5 feet in order to recognize an existing non -conformity. Mr. Hickok stated staff recommends if the variance is granted, the following stipulations be attached: 1. Petitioner shall obtain all necessary building permits for the reconstruction of the decks. 2. A double stall garage shall be constructed on the property within one year of approval of this variance request. Chairperson Kuechle questioned the requirement for the double car garage and how that impacts existing homes with single car garages. Mr. Hickok explained in the R-1 section of the code two parking stalls are required for a lot in excess of 9,000 square feet. He explained that the code recognize those situations and makes provisions for the expansion of a single car garage into a two car garage including the allowance of a reduced side yard setback without a variance. Dr. Vos questioned how many homes in Fridley have no garages. Mr. Hickok stated there are very few. Robert Thompson, petitioner, stated the current deck extends 6 feet to the front and he'd like to reconstruct it to 8 feet. He explained that he has already put a lot of money into the home and may sell it without constructing a garage. If so, the requirement for the garage would be included in the disclosure statement.
