WELCOME TO NEW COMMISSION MEMBER SUE JACKSON Mr. Kuechle welcomed and introduced Sue Jackson as the new Appeals Commission member. Mr. Bolin stated that Ms. Jackson has experience of serving on the Human Resource Committee and the Charter Commission and is very familiar with the City of Fridley. She was also active in some of the neighborhood meetings a few years ago. 1. PUBLIC HEARING: VARIANCE REQUEST. VAR #00-14. BY BOXWELL BUILDERS. INC: Per Section 205.07.03.D.2.(c).(3) of the Fridley Zoning Code, to reduce the side yard for an attached accessory structure on a corner lot from 25 feet to 22 feet to correct an existing nonconformity on Lot 15, Block 5, Brookview Terrace 3`d Addition, generally located at 701 Overton Drive. UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON KUECHLE DECLARED THE MOTION CARRIED AND THE PUBLIC HEARING WAS OPENED AT 7:32..P. -M. Mr. Bolin stated that the petitioner is requesting a variance to reduce the required side yard setback on a comer lot where the doors of an attached accessory building open to the side street from 25 to 22 feet. This would correct an existing non -conformity to obtain building permits necessary to obtain construction for a family room above the attached garage that is currently too close to the side yard line. This is one of the many cases when an owner comes in for a building permit for a simple addition, he or she finds out a variance is needed to correct the existing nonconformity before a building permit can bg issued. The petitioner's .property is located on the corner, of Overton Drive and Monroe Street. Mr. Bolin stated that the garage faces Monroe and is zoned R-1 single family as are all the surrounding properties. The petitioner's hardship statement states: 'The new family room would not exceed the boundaries of the existing garage. The reason for the variance is that the garage faces the side street known as Monroe, instead of the address street Overton." Mr. Bolin stated the petitioner desires to construct a new family room over that existing flat roof garage. The family room itself is within the allowable setbacks. There is the caveat in the code that states that the garage is nonconforming because the garage doors face the side street. If the garage doors faced the other street, the garage could be within 17Y2 feet of that comer. The addition will be architecturally tied in with the home. The rooflines work and make sense and will replace the fencing currently on the garage roof. Staff has no recommendation because it is within previously granted dimensions. A variance was granted at 600 Hugo that reduced the side yard setback for a garage whose doors also faced the side street from 25 feet to 17 feet. The petitioner is seeking a reduction to 22 feet. Mr. Jones asked Mr. Bolin if any neighbors had any comments. Mr. Bolin stated that three neighbors have called in support of this project. Mr. Kuechle asked if there were sidewalks along the street. Mr. Bolin stated that there were not. The petitioner, William Boxwell, owner and President of Boxwell Builders, stated that the City staff has done a very thorough job with the presentation and he has nothing to add. MOTION by,Mr. Tynjala, seconded by Mr. Jones, to close the public hearing. Mr. Jones stated that if the house numbers were on the other side of the street there would not be an issue. Due to the fact that it is within previously granted variances and the neighbors responded in favor of this request, he would vote in favor of the variance. Mr. Tynjala stated he agreed that there is nothing controversial about this. This will be a nice addition. Ms. Jackson also agreed and stated that this would make it a more attractive home. Mr. Kuechle agreed as well. His question about the sidewalk was a concern that when the driveways get short, there may be not enough room to cover the sidewalk. Twenty- two feet should be adequate in this case. MOTION by Mr. Jones, seconded by Ms. Jackson, to approve Variance Request #00-14 by Boxwell Builders, Inc., with the following stipulation: 1. " PROPERTY OVERVIEW The property is located on the comer of Overton Drive and Monroe Street. The home fronts on Overton Drive, but the attached garage fronts on Monroe Street, requiring a 25' setback. The existing home was built in 1959 and the garage was constructed three years later. The petitioners proposed expansion plans appear to be the only logical option for expansion of this home. The family room addition itself does not need any variances. The variance request is for the existing non -conformity which must be addressed prior to the issuance of any building permits to improve this property. Variance: An exception granted by the City Council from the literal provisions of the zoning ordinance, where there are unique conditions that do not apply to the area in general. Putting it simply, a variance is a deviation from zoning requirements. The Appeals Commission is given the power to review variance requests. The Laws of Minnesota have given the Appeals Commission the following responsibilities: 1. To hear and decide appeals where it is claimed that there is a mistake in any order, requirement, decision, or determination made by a City Official in enforcing the zoning ordinance. 2. To hear variance requests where strict enforcement of the code would cause undue hardship because of conditions unique to the property, and to grant these requests when it is shown that the granting of the variance will be in keeping with the intent of the ordinance. What is undue hardship? Undue hardship is defined by the law as: 1. The property cannot be put to reasonable use if used under the requirements of the code. 2. The need for the variance is due to the conditions unique to the property and not created by actions of the landowner. 3. The variance, if granted, will not alter the character of the neighborhood. Money alone shall not constitute a hardship if reasonable use of the -property exits under the requirements of the code. The applicant should review all possible alternatives which would meet the code requirements prior to applying for a variance.
