INTEAD OF AS STORAGE AREA FROM COUNCILMAN HAMERNIK
I understand Councilman Hamernik talked to you about this
gentleman using his second accessory building as a garage
instead of a storage building as originally.allowed on the
1972 building permit application..
Please check into this and make a report so we can pass it on
to Councilman Hamernik Friday.

12/2/76 - On May 26, 1972, Mr. Stene was granted a building
permit to build a garage with a stipulation that he would remove
the driveway to the existing garage and sod the area and
only use the existing garage for storage.
We received a complaint in August regarding the above stipu-
, lation which had not been complied with. Correspondence was
sent to Mr. Stene requesting that the driveway be removed
as required by the builidng permit. He was allowed until
October 28, 1976 to comply with the stipulation.
Inspection in the first part of November indicated the drive-
way wasn't removed but the garage was not being used for
vehicles, but for storing of equipment. The attached cor-
respondence has been sent indicating compliance is required.
If no response is made by December 10th, he will be cited
for violation of the zoning code.
We will continue to follow up on the complaint to ensure
compliance with the stipulation of the building permit. Mr.
Stene has been informed that an alternate to removal of the
driveway is to process a special use permit request for a
second accessory building.

I have made several attempts in the past year to settle the problem
of an existing unapproved 2nd accessory building (attached garage) at
870 Pandora Drive. The owner, Mr. Roger Stene, has been difficult to
contact at times, but always has returned my calls and correspondence.
Recently, Mr. Stene was given a list of neighbors who would be
contacted if he were to pursue the Special Use Permit alternative.
Ile hoped to "test the sentiment" of the neighbors affected before
applying. Over two months have elapsed since he was given the list
and he hasn't made application to date.
I called and left word with him to contact me. I drove by and took
a picture as a record for the file that the driveway has not been
removed to date. (Removal of the driveway was the other alternative
given to Mr. Stene.)

Dear Mr. Stene:
This letter is to confirm the information which I provided you
during our recent meeting at your residence. At that time, you
indicated that one of your neighbors had expressed concern over a
number of issues regarding your property.
One .of the items we discussed involves your newly constructed fence
along the west side of your property. As I stated to you in our
meeting, there is currently no requirement in the Fridley City Code
mandating that the "good side" of a fence be facing adjacent
properties. In addition, from examining the fence, there does not
appear to be anything in its construction that would create a
dangerous situation or safety hazard as defined in the City Code.
It is my understanding that your neighbor has informed you that
some security lighting along the west side of your property is
creating a problem for him. Excessive bright lighting can be
construed to constitute a nuisance as defined in the City Code.
You stated that you have taken action to correct this situation and
that you would be willing to take additional action if the
conditions warrant. If the City receives a complaint from your
neighbor regarding this lighting, I may need to take a further look
at this situation with you.
Also, you have a trailer in the driveway on the east side of your
property. This portion of your lot is defined as the side yard and
trailers are permitted to be located in this area.
Finally, it is my understanding that there is a dispute between
yourself and your neighbor to the west regarding the location of
the property line. This disagreement is central to several of the
issues which you brought to my attention including the location of
your new fence, the existing chain link fence, and the
responsibility for cutting weeds and maintaining the area between

the two fences. While on your property, I made no attempt to
establish the property line. I would like to state that all
fencing must be located entirely on the private property of the
person constructing such fencing and that all property owners are
responsible for lawn maintenance across any portion of property
which they own. Essentially, the improper location of fences
causing encroachment to adjacent properties is a civil matter
between the parties involved and should be resolved through that
legal process.

SUBJECT: Sealcoat Complaint
Mr. Roger Stene of 870 Pandora was upset with the application of some sealcoat material
on his concrete driveway as the result of the sealcoating work on Wednesday, August 7.
The asphalt distributor truck runs along the edge of the road shooting a spray of asphalt
along the bottom of the curb line. Wherever a curb is not present, it -has a tendency of
spreading a little wider which was the case on Mr. Stene's concrete drive.
He made a complaint to the contractor who had his people attempt to remove the asphalt
which fell on the concrete driveway extension into the street. In the process, they were
able to remove some of the asphalt and stones but it resulted in smudges of asphalt on his
drive as well as stains from the workers shoes on the concrete drive.
Jon Thompson met with him on Thursday morning and explained the process and what
occurred but he was dissatisfied with the way the workers worked and the appearance of
his driveway. Mr. Stene also called Bill Hunt, raising the same issue as well as a bunch
of other issues related to past complaints and the sealcoating operation.
I spoke with Mr. Stene on Wednesday afternoon and he identified that he was dissatisfied
with the cleanup work and felt that some additional elbow grease should be expended on
his driveway in order to make it appear cleaner. I indicated that we would have the
contractor attempt to remove as much of the asphalt as he possibly could.
The contractor was dispatched to the site in an attempt to remove the residual asphalt that
was left on his driveway.

SUBJECT: Response to Mr. Stene's Concerns
It is my understanding that Mr. Roger Stene has some concerns regarding the water quality provided by
the City of Fridley.
Every year before July 1st we must publish, for our consumers, a Water Quality Report. The Safe
Drinking Water Act of 1996 mandates this and its purpose is to inform the consumers of the water if there
have been any violations of the Federal Standards for drinking water. This report is generally included
with the City's spring newsletter.
Over the past three years, since this report has been required, we have not had more than a dozen
responses to this report because we have met all the State Health Department and Federal requirements
under the Safe Drinking Water Act. -
Water quality means different things to different people. Since we don't have a water softening plant,
many people decide to purchase and use one for their residence. These devices, in essence, are filters that
remove calcium carbonate and magnesium through an ion exchange and these filters are "regenerated" by
backwashing with a brine solution.
Other people opt to put "in-line" filters at some point in their plumbing to remove any sediment or other
component in the water, and this depends on the type of filter be it a pleated paper or activated carbon
filter. These filters, by their very nature, will become either discolored or "used up" and must be replaced
on a periodic basis because they concentrate everything in one spot and through an accident could
possibly be a source of a problem.
Mr. Stene has not, to my knowledge, contacted the Water Department directly for quite some time, but I
believe that he and the former City Engineer have had some discussions over the past several years.
We would be happy to take a bacteria test at his residence when we gather our other samples on
Wednesdays, if he so desires.
We test for bacteria in our water system every week, we test for chlorine and fluoride everyday and we
check for iron and manganese at least once every two weeks.
