Notice is hereby given that the Appeals Commission of the City of Fridley
will conduct a Public Hearing in the City Council Chambers at 6431 University
Avenue Northeast at 7:30 p.m. on Tuesday, June 14, 1988, for the purpose of:
Consideration of a variance request, VAR #88-12, by Richard
Traczik, pursuant to Chapter 205.07.03.D,(1), of the Fridley
City Code to reduce the front yard setback from 35 feet to 15
feet to allow the construction of a new single family
dwelling with attached garage on Lot 13, Block 1, Marion
Hills Addition, the same being 5201 Pierce Street N.E.
Any and all persons desiring to be heard shall be given the opportunity at
the above stated time and place.
Note: The Appeals Commission will have the final action on this request,
unless there are objections from surrounding neighbors, the City Staff, or
the petitioner does not agree with the Commission's decision. If any of
these events occur, the request will continue to the City Council through the
Planning Commission with only a reccunra dation from the Appeals Cammissicn.

VAR #88-12
Section 205.07.03.D, (1) , requires a front yard depth be not less than
thirty- five (35) feet in a residential zone.
Public purpose served by this requirement is to allow for off-street
parking without encroaching on the public right-of-way and also for
aesthetic consideration to reduce the building "line of sight"
encroachment into the neighbor's front yard.
B. STATED HARDSHIP:
"Unique lot - unique design - unusual lot design"
C. AMEMISTRATIVE STAFF REVIKW:
This lot was cne of four lots, of which variances were granted in April
1979. This lot, as well as the lot to the north, were granted 25 foot
front yard setbacks. The next one was granted a 30 foot setback, while
the most northerly of the four was allowed a 15 foot setback. This
variance was reapproved in August of 1986.
If the Appeals Commission approves this request, staff has no
stipulations to recommend.

Though I will not be able to see the petioner's site from aly point in
my yard and I an unlikely to view it before the next blue moon, I strongly
urge you to grant the petitionerts request for this variance.9 because the
terrain upon which he is building falls away sharply from the cal -de -sac
as does mine here at 5211 Fillmore St. NE. I am still kicking nVself for
not asking for a similar variance when I built thirty years;agg. If I
had a variance to build closer to the street, my yard wmuld be more
attractive from the street, mgr driveway would be easier to use, and I
would not have lost, for practical purposes, a third of my yardi
