Investigation indicates that the building permit in question was issued 6-11-79 by Mr. Darrel Clark of your department. We checked with Mr. Clark's secretary and have copies of the building requirerents and we cannot see where Mr. Clark did anything wrong in issuing the permit. According to his inspection all the requirements were net prior to his issuance of the permit. However, regardless of how this matter progresses in so far as whether or not there was negligence on the part of the City of Fridley we wish to advise that there is no insurance coverage under your policy with us for this tyre of a claim. And accordingly nor would we be able to provide a defense o'f a law suit against the City for something that is not covered in the insurance policy. I am enclosing a photocopy of a page from the policy containing the exclusion in question. There was not a physical injury or destruction of tangible property involved in this particular situation. The only damage alleged is a loss of view. This certainly is not physical injury or destruction of property. Nor is this a oc- currence which is defined a accident.
