Mayor, he was in favor of parks, but we had suffered trying to work out a
fair and equitable sewage bill with the Metropolitan Sewer Board and we did
not need any more taxing agencies working on that premise. He would rather
see us do it than someone else in a building downtown.
ORDINANCE #478 - AN ORDINANCE TO AMEND THE CITY CODE OF THE CITY OF FRIDLEY,
MINNESOZA BY MAKING A CHANGE IN ZONING DISTRICTS: COLONIAL SERVICE, ZOA
#71 -02: -
Councilman Liebl asked if the deed has been received by the City. The City
Engineer said that the deed had been received and filed.
MOTION by Councilman Breider to adopt Ordinance #478 on second reading,
waive the reading and publish. Seconded by Councilman Liebl. Upon a roll
call vote, Kirkham, Harris, Breider, Kelshaw, and Liebl voting aye, the
motion carried unanimously.
ORDINANCE #479 - AN ORDINANCE AMENDING AND RECODIFYING CHAPTER 46 OF THE
FRIDLEY CITY CODE, KNOWN AS THE BUILDING ORDINANCE:
Councilman Liebl. asked Dick Harris if he was aware of the minor changes made
in the ordinance by the City Council. Mr. Dick Harris said that while he was
on the Planning Commission he had missed one of the meetings at which this
had been discussed, but from what he remembered some of the provisions in
the -building ordinance are good, but some are very unnecessary, such as
having a stair hatch to the roof in a very small building. Councilman Liebl
said that basically it will be adopting the 1970 Building Code. He thought
it would make our requirements a little tougher and upgrade our commercial
and industrial buildings. Mayor Kirkham said the Council would be interested
in any constructive criticism Mr. Harris may have to offer, and the Ordinance
can be amended at any time there are improvements to be made in it. He
suggested Dick get a copy of it and look it over.
MOTION by Councilman Harris, with the thought in mind that changes can be
made to the Code if justifications are shown, to adopt Ordinance #479 upon
second reading, waiving the reading, and publish. Seconded by Councilman
Breider. Upon a roll call vote, Harris, Breider, Kelshaw, Liebl and Kirkham
voting aye, the motion carried unanimously.
PROGRESS REPORT FROM NSP:
Mr. Warren Johnson from NSP brought the Council up to date on the progress of
the relocation of the transmission line. He stated that one section of the
line has been built from I. 694 and Main Street north to 61 Way. They ran
into a conflict with the railroad facility at 61st Way where the line will
cross over the railroad property, and they are working with Burlington
Northern on this. They have hbd five meetings together since he last reported
to the Council March 5, 1971. He said they are close to resolving the in-
duction problem, but they cannot commit themselves to a date that an agree-
ment will be reached. This will have to be completely resolved before
energizing the line. Mr. Johnson was thanked by the Council for his report.

REPORT ON COMPLAINT REGARDING YARD FLOODING PROBLEM AT 6335 PIERCE STREET,
(RON SLATER):
The City Engineer drew the Council's attention to.the letter in the Agenda,
that had been prepared to be sent to the property owners_in that area,
offering them fill for their yards. He said that if the Council felt it

as satisfactory, it would be mailed to the residents in the area.
MOTION by Councilman Harris to approve the communication for mailing.
Seconded by Councilman Liebl. Upon a voice vote, all voting aye, Mayor
Kirkham declared the motion carried unanimously.
DISCUSSION REGARDING ACQUISITION OF PROPERTY FROM ST. WILLIAM'S CHURCH FOR
TRUNK
The City Engineer gave the Council a copy of a letter received from St.
William's Church dated May 3, 1971. He said that it is in.regard to the
proposal worked out with the Church committee with several minor changes.
He read Item #7 which asked that the City pay the sum of $275 to the Church
for expenditures incurred in ... the appraisal of the property.under discussion,
and Item #10 which asked that the City pay all legal fees and other costs
for transfer of said property to City. Councilman Harris asked the City
Attorney -if there would be any problems with Item #10 and the City Attorney
said no.
MOTION by Councilman Harris to change the figure in Item #6 which the City is
to pay the Church for professional traffic flow survey to be made of Church
parking lot from $600 to $875, and approve the agreement with these changes.
Seconded by Councilman Liebl. Upon a voice vote, all voting aye, Mayor
Kirkham declared the motion carried unanimously.
DISCUSSION REGARDING ACQUISITION OF PROPERTY FROM SHELL. OIL COMPANY FOR
TRUNK HIGHWAY #47 SERVICE ROAD DETACHMENT NORTH OF 61ST:
The City Engineer pointed out that in their letter, Shell Oil Company
suggests working out an agreement to resolve.the deed, and the City can
proceed on that basis. The City has agreed to pay $23,250,00, and if they
comply with the conditions the City can pay the money.
MOTION by Councilman Harris to reaffirm our proceedings on the acquisition
of property from Shell Oil Company. Seconded by Councilman Liebl. Upon a
voice vote, all voting aye, Mayor Kirkham declared the motion carried
unanimously.
REQUEST TO BUILD GARAGE IN COMMERCIAL AREA, BY RICHARD BISTODEAU:
The City Engineer explained that Mr. Bistodeau owned a 60 foot wide lot with
a single family dwelling and he wished to put up a garage. Our ordinance
requires that non -conforming use cannot be expanded on, and his lot is in a
commercial area. The Council looked at the plan showing where Mr. Bistodeau
wished to place the garage. The garage will be way at the back of his lot
and the driveway will come out on Main Street. Mr. Bistodeau explained that
he would like to build a garage to house his camper truck and boat and
trailer so people will not be aware when he is away. His home has been

Dear Mr. Shimanski:
A plumbing permit was issued on September 19, 2000 to install a bathtub at your address.
According to section 4715.2800 of the State Plumbing Code, a final inspection shall be conducted
on the plumbing authorized by this permit. As of this date, no inspection has been called for.
The permit fee that was paid covers the inspections to make sure the work was completed
according to the State Plumbing Code. We will keep your permit open for another 30 days and if
we do not hear from you within this time to set up the inspection, we will expire the permit and
no further action will be taken.
