Anoka, Minnesota 55303 Re: Structural Finals on Homes in Jim Lund Estates Dear Mr. Lund: You have been requesting finals on the homes built in Jim Lund Estates. Upon making these inspections, we have noted that there are no door closers on the door leading from the dwelling unit to the garage. This is a requirement of the Building Code and therefore you must install them. Make sure that they.are capable of completely closing the door as some that we have seen are not capable enough and do not close and latch the door. This is necessary to keep the integrity of the firewall between the house and the garage. We ask for your cooperation in getting these installed on all your homes prior to your requesting finals and those with people in and already finaled must be installed on or before February 7, 1975. Jeanetta 7350 Pinetree Lane Fridley, Minnesota 55432 January 18, 1976 Re: VA Loan No. 253763 In February, 1975, using my VA loan, I obtained a mortgage from Banco Mortgage Company and purchased a home built by Jim Lund Construction Company. Since that time I have contacted Mr. Lund on numerous occasions in an attempt to correct the problems existing with this new house, the results of which have been negative. My only recourse is to now file a formal complaint with the Veterans Administration. An attachment listing all the specific items is set out for your review. Some of the defects are minor and cause only unnecessary irritation. Additional defects are major, costly and dangerous. Mr. Lundts statement and excuse for the poor workmenship is that the "properties sold so rapidly he was forced to contract out much of the work". To say the least, I am greatly concerned about my investment, consisting of a $33,000 mortgage and other items bringing my investment to at least $40,000 into this property. I do not know what'VA can do for me, but I would sincerely welcome an inspector or representative from your office to check out my allegations. Example: I have an outlet in the kitchen which v sparks every time you plug something into it. On occasion my lights dim when the refrigerator goes on. 3. I had leaky faucets in the kitchen and bathtub, along with problems of the toilet not flushing properly. Mr. Lund did send two men over, but I still have the dripping faucets and in addition a new one in attempting to �✓� regulate the hot and cold faucets in the tub. The toilet does flush now, but the handle flops. A most recent encounter with Mr. Lund was over ill-fitting windows and doors and my leaking roof. The window and doors which they supposedly fixed last February are covered with ice, snow and frost on the inside. The ice on all windows is approximately 3 inches high and maybe a quarter inch thick. The window casings are covered with frost. When I open the cabinet under the kitchen sink you can feel a definite breeze, and the same is true inihe master bedroom. I don't know if it is because of the windows or lack of insulation. There is a howling noise as though there were a blizzard outside. This noise occurs even in the summer with the slightest breeze. You can see daylight through the side of the front door and, of course, there is snow and frost at the bottom. When I reported this to Mr. Lund early in December he sent a young man over. The workman took one look at the situation and said he didn't know what to do and he would have to go back and ask a carpenter. He did return later that afternoon and spent two hours working on the problem. I still have ice and snow and problems closing and/or locking the doors. The workman didn't know what to do about the window problem. When I asked what the plan was to fix my roof he didn't know, but thought he would "throw some tar up there". I left a message for Mr. -Lund the next day saying this was a very nice young man who came to help, but I wanted someone who knew the business to fix my house. I have not heard from him. 5. My basement leaks. The water stains are still there, as well as the cracks and holes in the floor which I asked to be fixed when I moved in. Numerous nails, inside and out, have not been recessed. A man had started to fix these as he did the bulging plaster board stripping but he left without finishing. 6. The original plans for the house had a clothes chute designated to be put in the bathroom. It was forgotten. I did let Mr. Lund talk me into putting it in a hall closet. My mistake this time -- now a pair of socks may not even ` get through the chute. Mr. Lund has been "going to fix it" for a year. All that chute really needs might be some metal sheeting. Loan Guarantee Division Anoka, Minnesota Veterans Administration Center 55303 Fort Snelling Saint Paul, Minnesota 55111 Gentlemen: This letter is written in response to a letter from veteran Delores A. Jeanetta to the Veterans Administration alledging numerous complaints about myself and a house I built for her. I will answer each allegation in the order in which she wrote them. 1) Claim that results have been negative in correcting problems. a) I repainted the outside of the house. 1 1/2 times, the second time, Gordon Nelson from Nelson's Wallpaper & Paint store looked at the house and said the paint was not flawed, that there was a film on the paint caused by either watering while the house was hot, or from oil in the air from blacktopping the street. I repainted the side, even though her neighbor said she watered the sod, and the water was constantly hitting the house. b) I had the nicks and flaws in the wails fixed and repainted 2-3 times, including ones she made while moving in. c) I had the clothes chute worked on twice, this is not in the plans submitted. d) The windows were worked on once and the company's truck was scheduled to work on them this fall, no one would answer the door, even though the driver said there was someone in there. The truck is scheduled for February 2nd, I trust she'll be there. e) I had a small bubble in the kitchen linoleum fixed and also a hole in the linoleum (admittedly made by her) repaired, at no charge. f) I had the front door weatherstripping adjusted twice and the back door adjusted once. G) The heating system was balanced. h) Fducets were worked on twice, the first time inserts were changed, the second time the faucets were replaced. The plumbers were told of the leak in the shower at this time and they ran the water, checked for leaks, put silicone seal around the faucets but couldn't find the leak. The owner would not get out of bed to show the plumbers where the alledged leak was. i) My workmen have been over to her house all through the -year, either they couldn't ;get in or hese terms were so vague that no one could do anything. I have a policy of having my wife or secretary calling all, new homeowners at (least once, then we follow up with a letter including if possible a copy of their survey, the letter has room at the bottom for complaints. Both the call and letter were given to D. Jeanetta, we fixed her complaints then, and later, My wife had a call from the person living with her (Nina Dittner) and Nina said she had a list. She dould'nt find the list, My wife called her back the next day, Nina still couldn't find it, then she was asked to mail the list when she did find it, Nina still hasn't done this. About 4 months ago Delores called me and wanted 4 things done. 1) painting outside adjusted, 2) linoleum bubble repaired. 3) front door adjusted. 4) faucets and drain plub in bathroom adjusted. I touched up 2 and totally repainted 2 vall5ops the outside, they did not need it, because the entire house was primed once and painted second coat twice. The painter can attest to the fact that he touched up the eves, shutters, painted the south and west walls completely over again and completely repainted the garage door, because the door was shut when the paint was still wet the first time. The painter suspects the homeowner of shutting the door, but can't prove it. The painter also said he had to walk through dog feces in the house and that he painted and fixed numerous dog scratches. I also had the front door adjusted again. Up until about a month ago, to the best of my knowledge she was completely satisfied with the house. She had not called me or wrote any letters to let me know there was anything wrong. How she could write this letter -and let her dogs scratch up her woodwork and walls and urinating and depositing waste on her basement floor! 4 months ago when Delores requested the 4 items above repaired,, I repeatedly asked her if that was all I could help her with and she repeatedly said that was all she could think of. About a month ago on a very cold day, Delores called up and said that I should get over there quick, because there was frost at the bottom of her door and bottom of some windows. I sent a man over to her house and he worked on both items. fie told me that the humidity seemed above normal in the house, and that the frost was very slight. She called me immediately after my man had left the house and said he did not know what he was doing and that I should send someone else over. I at that time arranged for the window factory service man to meet me there on February 2nd to examine the windows and see if there was any problem with them. When I met with Delores, she claimed the frost to be 3 inches high and 1/4 inch thick on all the windows and door. Nina Dittner's son said it was not that bad, and was possibly 112 inch high. I would see no damage to ther woodwork and when asked if water ran down the window or walls she said no. She has a humidifer on her furnace. In summery of these charges, from the day people move in my houses and for years later, I will relatively promptly do whatever they ask of me to make them happy. If their request is anywhere near reasonable, I will satisfy it. In this particular case I did just about all I possibly could. Never once did I tell her, I would not do any more work on any item. All our buyers have my personal home number, and my home address. I have heard from Real Estate 10 that they have been looking at double btimgalows since last fall, It is my honest opinionthatthey do not want a house and are unhappy they bought one. Problems listed below: 1) shower leaks: I was totally unaware of this until she wrote the letter, as I stated earlidr-e,the plumber was over there and worked on everything. The shower could leak because she runs too much water on the ceramic floor, which is not meant to be completely waterproof. I cannot say what it is until I check it out, I can say that if it is a plumbing leak I will absolutely fix it promptly. 2) 1 was totally unaware of lights dimming or the spark from the outlet, again I will have to check it out, 11rhat is her refrigerator like? what appliance is she plugging into the outlet and what condition is it in? 3) On the day of the alledged frost, my workman said it was very slight (1/2" up from edge of window and 1/4" up from the edge of the door) when I asked her after her letter, if any water ran down walls from frost or any other problems resulted from this frost she said no problems resulted. I assured her, I would work on the windows until she vas happy with them. The cold under the cabinet is under- standable because with all the cabinet doovs shut, the temperature there is some- what less than room temperature, however I will not know for sure what the problem is until I can check it and see how bad it really is. 4) I was totally unaware of any leaky basement until this letter. I had been in the basement recently and various times in the summer, and never seen any sign of dampness or water. I suspect that she saturated the top rows of blocks from the outside while she watered her sod extensively. I know of no holes in her basement and no significant cracks, all concrete floors of this size have a few hairline cracks. They cause no harm and are more acceptable than expansion strips. 5) I knew the clothes chute was a problem in the past, however I had mien work on it twice and have not (until this letter) heard anything more about it. The clothes chute was not called for in the original plans and specs. 6) Gordon Nelson, my painter, and myself could not find any peeling of paint. The painting I did on the outside of the house was done to make her happy, the outside of all houses are not flawless, however, I think this house is above average. 7) The neighbors tell me her sod was all growing in the fall. I inspected the sod laying job during and after completion, and it all looked good to me. She seems to be saying here that she did not like the workmen on the job, nothing is said about the workmanship. 8) Of 22 houses I built around her, all but her are completely happy, some have one or two things they. want me to do for them, but they are happy, not unhappy as she claims. In fact of all the houses I have built, none claim to be unhappy except Delores Jeanetta. I have lists of all the people I've built for and their phone numbers, they can be called, and my claim substantiated, not just allegations as Delores claims. In summary on this house as on all my houses I make a special effort to take care of callbacks promptly and meticulously. I don't have many callbacks, and not only do I take care of the ones I have, if there is a problem the people are responsible for I usually take care of that at the same time at no charge to them. This woman has been unusually demanding, and unreasonable on many items. I've tried to make her happy and I felt I succeeded in meeting her demands. She has been very abusesive to my workman and several times turned them away when they have come to work on her house. Nevertheless, I have never scolded her, never told her that I could not or womld not take care of any problem she would give me. If she would not have wrote the letter, I am confident I would have made her happy, but now that she wrote it, I will ma -Le an even more positive effort to satisfy her complaints. After I knew of this letter, I promised her I would personally come into her home and watch the workmen and see exactly what she wants. If she stall wants the Veterans Administration to check her house after this date, I am truly sorry and I feel that I have done my best. She just told me that she will not let anyone worts on her house un, ti 1 further notice.
