The strict enforcement of this code would cause undue hardship on property owner and therefore is asking for variance from this ordinance regarding placement of containers. On this property there is severe ground slope along front yard of the building — around 80" in elevation — and coming down to the one car garage entrance, located on the street level in the corner and under the building structure. On the other side of the building, there is another ground slope coming to the driveway and neighbor border. This side of the front yard has 2 step retaining walls with large arborvitae trees. First step is around 12" high and second retaining wall about 30" with installed 40" metal fence on it. This topography, retaining walls, fence and trees where unchanged since I've moved to this property 16 years ago. Since then I've stored waste container in the same place — in my front yard under the tree. Presently I do have 2 containers about 90 gal. each for Yard Waste and Solid Waste which are disposed on weekly basis. Existing single car garage exclude possibility of keeping containers there because they would protrude and block the entrance for my SUV car. I do use my house for business — licensed by Anoka County — and I need those containers for proper operation. I do believe that my topographic and practical difficulties are reasonable to ask for granting this location a variance from existing regulation.
