Dear Mr. and Mrs. Oswald:
It has come to our attention that you have two tall antennas on
your property. While radio and television antennas are permitted
in residential districts, they may not extend to a height more than
20 feet above the dwelling roof unless a special use permit is
obtained. From my observation, it appeared that one or both of
these antennas may extend above the permitted height.
I have enclosed an application form and meeting schedule should you
wish to apply for a special use permit to maintain these antennas
at their present height. Please complete and return this applica-
tion with a $200 application fee (non-refundable) and a rough site
plan.
Should you not wish to apply for a special use permit, you must
remove the. antennas or reduce them to a height not greater than 20
feet above the height of the dwelling roof.

Communication Interference
Recently, I received a complaint from a resident regarding
interference resulting from ham radio transmissions on an adjacent
property. Since that time, I have received letters from 'four
neighbors indicating that they have been having problems with their
telephones, television sets, and other household appliances as a
result of these transmissions. These residents are requesting that
the City take action to alleviate their problems.
I have spoken with the party operating the ham radio, and he stated
that he is operating in full compliance with his license from the
Federal Communications Commission (FCC). To this point, I have not
yet attempted to verify his operator's license nor determine
whether he is currently operating within the FCC requirements.
However, I have spoken with an FCC representative in the past and
have been told that it is not uncommon'for interference to result
even when an operator is acting within the FCC standards. The FCC
requests that complainants consider purchasing low cost filters and
other devices to minimize the effect of such transmissions on these
household items, but the complainants do not believe it is their
responsibility to correct the problem.
The Fridley Zoning Code requires that a special use permit be
obtained for all private radio or television antennas exceeding a
height of 20 feet above the dwelling roof. While this appears to
be the case in this instance, I am aware from a previous
conversation with an FCC representative that reducing antennae
heights in these cases does not decrease and may actually increase
the interference experienced by neighbors.
Assuming that the ham radio operator is currently licensed by the
FCC and is operating in full compliance with the FCC regulations,
I would pose the following questions to you:
1. Given the FCC's authority in communications
matters, does the City have any obligation or
authority to address such issues?

As you may recall, Mr. George Paquin spoke during the open forum
portion of the January 3, 1994, City Council meeting regarding
interference from a CB radio operation at 6330 Quincy Street.
According to Mr. Paquin, he and other residents in this neighbor-
hood have been enduring negative effects• on their telephones,
televisions, and other electric devices as a result of this
interference.'
On January 10, 1994, Mr. Dennis Oswald, operator of the CB radio
in question stopped at the Fridley Municipal Center to discuss this
matter with me. At that time, he indicated that he had seen a
rebroadcast of the City Council meeting and that he wished to take
whatever action necessary to get this problem resolved. He stated
he had spoken with Mr. Albert Jerrick of the FCC regarding the
proposed inspection of his operation and that he wished to
cooperate with the* FCC and the City in any way possible. Based on
his cooperative nature, Mr. Jerrick indicated that it might be best
for Mr. Oswald and the neighbors to attempt to work this out
through mediation prior to any FCC inspection.
Mr. Jerrick has contacted Mr. Paquin and discussed this matter
fully with him. Mr. Paquin agreed to pursue mediation provided
that an inspection could still be considered at a future date if
mediation does not produce some positive outcome. Mr. Jerrick
stated that this appears to be the most appropriate approach to him
as well.
Following the discussion of this item at the January 3, 1994,
Council meeting, Councilmember Steve Billings indicated an interest
in being a part of a future mediation session should such a meeting
be arranged. Based on this information, staff would like to
arrange a meeting with Mr. Oswald, the affected neighbors, Council -
member Billings, and staff members to discuss resolving this issue.
Unless otherwise directed, staff will contact Councilmember
Billings and proceed to arrange this meeting.
