SUBJECT: Retaining Wall at 6100 Rainbow Drive
You have requested that we look at repair of a field stone
retaining wall at 6100 Rainbow Drive. I inspected this wS11 this
week. It is located along the 61st Avenue side of the property
and is situated a few feet behind the sidewalk, which would
indicate that the wall is just inside or on the right-of-way line.
The wall is generally in good shape with a couple of areas where
the mortar has fallen out, but the wall is still intact.
As a policy, Public Works does not repair these types of walls as
they are considered to be the property owner's responsibility just
as maintaining the lawn in the boulevard is the responsibility of
the property owner.

The purpose of this letter is to follow up on our telephone
conversation in which you requested that the City repair your
retaining wall. As you made the request, you pointed out that
former City Manager, Nasim Qureshi, had promised that the City
would maintain the wall. Since the City cannot find any
documentation of that promise by Mr. Qureshi, I am willing to offer
the following proposal:
The City will repair the wall once. I have asked Mark Winson, our
Assistant Public Works Director, to make an appointment with you
to look at the wall again to determine the extent of the City's
repair work. I leave it in Mr. Winson's hands to decide the nature
of our responsibility. The work should be done by City staff yet
this fall.
Since we have many walls of this nature throughout the City and
have not established that the City is responsible for maintaining
U-iose walls, I would direct that the City not become further
responsible for your wall or other walls beyond the year 1990. I
believe that you agreed with this in our telephone conversation.
If there is a difference of opinion, please give me a call.
Hopefully, the repairs that we will implement this year will last
for a long time, and save you future headaches with repair
problems. Thank you for contacting us. If you have any other
problems, please do not hesitate to call.

DATE: September 28, 1990
SUBJECT: Retaining Wall at 6100 Rainbow Drive
Per the City Manager's direction, I met with Harold Bistodeau of
6100 Rainbow Drive to discuss repairs to the flagstone retaining
along the right-of-way line. Mr. Bistodeau related how he has
maintained the wall for years by mortaring the spaces between
stones and placing a concrete cap on the top. I explained that,
per his conversation with the City Manager, the City would one time
only, remortar the open joints and place a concrete cap on the wall
where the existing cap has deteriorated.
Mr. Bistodeau asked if the City would build a new wall in the area
between his two (2) driveways, where he had removed the wall
originally constructed by the City as it had crumbled. I stated
that we would not. Mr. Bistodeau asked if the City would rebuild
the portion of the wall that curves back further into his property.
I explained that the City would not do this work. Mr. Bistodeau
said he would check on contracting that work out. I asked that he
inform me of his decision on this, as I would rather have the
repairs done to the portion of wall we are repairing after he had
the other work done. He said that he would contact me in a couple
of weeks.
We will get two (2 ) or three (3 ) quotes for performing the work
that I agreed to do.

SUBJECT: Retaining Wall at 6100 Rainbow Drive
I spoke with Mr. Harold Bistadeau regarding the repair of his field
stone retaining wall at 6100 Rainbow Drive. During my previous
discussions with Bistadeau, we had discussed the -fact that he
wanted to do some repairs to that portion of the wall extending
into his property. We received a quote. from our 1990 Miscellaneous
Concrete Curb, Gutter, and Sidewalk contractor for 1990 of $300 to
do the pointing and to place.a new capon the existing wall.
Based upon my discussion with Mr. Bistadeau today, -he has not been
able to find a contractor to do the work on this wall and,
therefore, wishes to hold off on the repairs by the City until next
year. I asked him to contact me again. in spring, 1991 when he had
resolved the issue of the repairs to his portion of the retaining
wall.
