UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON KUECHLE DECLARED THE MOTION CARRIED UNANIMOUSLY. PUBLIC HEARING: CONSIDERATION OF VARIANCE REQUEST. VAR #00- 01. BY WENDY WEAVER: To reduce the required side yard setback on a corner lot from 17.5 feet to 11.1 feet to expand an existing nonconformity on Lot 1, Block 2, Parkview Oaks First Addition, generally located at 5503 Regis Trail MOTION by Dr. Vos, seconded by Ms. Beaulieu, to waive the reading and open the public hearing. UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON KUECHLE DECLARED THE MOTION CARRIED AND THE PUBLIC HEARING WAS OPENED AT 7:35 P.M. Mr. Bolin, Planning Assistant, stated that petitioner is seeking a variance to not only recognize an existing non -conformity with the existing garage, but to also expand on the non -conformity by building an additional living area above the garage. Section 205 of the City code requires a minimum side yard setback of 17Y2 feet for garages on corner lots. r" APPEALS COMMISSION N,- :TING, JANUARY 26, 2000 PAGE 2 Mr. Bolin stated the property is surrounded to the north, east, and west by single family homes. A church is located to the south. The petitioner's hardship summary states that "the entry garage does not meet code and the house was built in 1963 and we are wanting to build a 12 foot by 17 foot 4 inch addition on top of the existing garage flat roof." The petitioner is asking that the setback of 11.1 feet be recognized as an acceptable setback on this property in order to expand the living area by adding on to the top of the garage. Mr. Bolin stated staff has no recommendation on this request as it is within previously granted dimensions. Similar variances granted in the past included Variance #98-14 where the side yard setback was reduced to 10 feet for the installation of a swimming pool and fencing and Variance #98-21 where the setback was reduced to 10 feet to recognize an existing non -conformity which was the garage. If the Commission approves the variance, staff recommends the following stipulation: 1. The petitioner shall obtain all necessary permits prior to construction. Mr. Bolin stated the setback from the actual property line is 11.1 feet, although it is actually set back over 24 feet from the curb. This does not create any vehicular vision problems. Ms. Beaulieu asked if the 17.5 feet setback requirement is the same for a garage and living quarters. Mr. Bolin stated that is correct. Mr. Kuechle stated that the addition is not going to be a real problem because there is a garage there now. Mr. Bolin stated that is correct. Recognizing the existing non -conformity enables the City to issue a building permit to allow expansion on that non -conformity. Mr. Kuechle asked if the addition was going to impinge on the 17.5 feet. Mr. Bolin stated that it was not going to. Wendy Weaver, 5503 Regis Trail, stated that Mr. Bolin covered everything very well, and she did not have anything to add. Dr. Vos stated that he assumes that it will look similar to what she has already. Ms. Weaver stated that it would have the same roofline as the house. MOTION by Ms. Beaulieu, seconded by Dr. Vos, to close the public hearing. Dr. Vos stated that he looked at the property. There is another 13 feet from the lot line to the curb, and it is hard to tell that this is going to be tight in that neighborhood especially if the wall of the addition is not going to come out as far as the garage wall. This variance is mostly to take care of a non -conformity so they can get a building permit to put an addition on their house. He would vote to approve the variance. Ms. Beaulieu agreed that the addition would be an improvement to the property. Mr. Tynjala also agreed. Variance request VAR #00-01 is to reduce the required side yard setback, for an existing garage on a corner lot, from 17.5' to 11.1'. The petitioner would like to expand the size of her existing home by placing a 12' x 17' addition over a portion of the existing block garage. The addition would make the existing garage more architecturally compatible with the design of the home. Visiting the site, staff determined that the existing location of the garage and the proposed home expansion would not have a negative impact on neighboring properties or on traffic site lines. Though the garage is setback from the property line by only 11.1', it is setback a total of 24.8' from the curb on Regis Lane.
