It is my opinion that the City has no legal authority to become involved in a dispute between the homeowner and his builder for defected construction. These are matters that must be resolved through civil procedures either by negotiation or suit between those parties but the City should not be a party or a witness on either side. I would classify all of the complaints in the above category with the exception of the failure to vent the kitchen range fan which would be a code violation. Therefore, it is my opinion that the only action the City could take would be to enforce the venting of the kitchen range fan and the other matters are matters that will have to be resolved without interference by the City.
