Ms. McPherson stated the variance request is to increase the size of the first accessory structure from 1,000 square feet to 1,264 square feet. The subject parcel is located at 501 Rice Creek Boulevard which is east of University Avenue and south of 69th Avenue. The property is zoned R-1, Single Family Dwelling, as are the surrounding parcels. Ms. McPherson stated the petitioner is processing a vacation request to vacate drainage and utility easements along the rn APPEALS COMMISSION MEETING. The parcel is actually comprised of three parcels - the original lot as platted and two small "slivers" of property adjacent to the north and west lot lines. The petitioner has requested the vacation in order to construct an addition to the existing two -car garage attached to the single family dwelling. The addition is proposed to be 22 feet x 22 feet and would increase the first floor area of the accessory from 1,000 to 1,264 square feet. Ms. McPherson stated the request meets the setback requirements of the R-1 district. The addition does not adversely impact the lot coverage or site lines from the adjacent properties. The Planning Commission voted to recommend approval of the vacation request to the City Council and that is moving forward. The request is within previously granted variances of this type. If the Appeals Commission chooses to approve the request, staff recommends the following stipulations: 1. The petitioner shall use the existing driveway opening. 2. The petitioner shall provide a hardsurface driveway to the -- addition by November 1, 1995. 3. The addition shall be architecturally compatible with the existing dwelling. Ms. Beaulieu asked if the City had previously approved variances of this type. Ms. McPherson stated the City has granted similar variances to allow increases in first accessory structures over 1,000 square feet. The largest variance she is aware of was to approximately 1,400 square feet. Mr. Nordstrom stated he is requesting the variance because he has two collector cars in his existing garage so the cars used everyday are outside. In the summer, the cars are sometimes in the street. Their property is on a "U" shaped street at the bottom of the "U". Sometimes there is speeding traffic in that area and he would prefer to keep his cars off the street. He would like to keep them in the garage but he cannot because it is a two stall garage. He would like to build another two stalls which would be setback a few feet from the existing garage. It would have the same roof pitch and same architecture as the existing structure. Ms. Savage asked if the neighbors had any objections. Mr. Nordstrom stated he had talked to his neighbors and they had no objections. Dr. Vos stated the s request ito o over 1 000 s q g quare feet. The staff report states the existing garage is 26 feet x 30 feet. The garage is actually 22 feet x 30 feet but it would still go over 1,000 square feet by adding on 22 feet x 22 feet. He wanted the garage to be larger but he did want to get any closer to the curve in the road. He had originally planned to build 24 feet x 24 feet, but scaled it back. He wanted room for two cars and still be able to open the car doors. Dr. Vos stated the existing garage is actually 22 feet x 30 feet or 660 square feet so the variance request is actually to 1,144 square feet. Dr. Vos asked if he did not put it back any further because of the easement. Mr. Nordstrom stated he had vacated the easement, but he did not want to get too close to the new easement which is 12 feet. MOTION by Mr. Kuechle, seconded by Ms. Smith, to close the public hearing. UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON SAVAGE DECLARED THE MOTION CARRIED AND THE PUBLIC HEARING CLOSED AT 7:40 P.M. Ms. Beaulieu stated she would be inclined to vote in favor of this variance request. The neighbors have no objections. Staff indicated we have granted similar variances before. It seems to be an improvement to go from on -street parking to a garage. The request should be changed to increase from 1,.00.0 square feet to 1,144 square feet which, is what is being proposed at this time. She would recommend approval with the stipulations. Mr. Kuechle concurred. The request is not that large. The house itself is a fairly large house and the proportions would not look bad. If the architecture blends it in, it will not look like one long roof. He would be inclined to recommend approval to 1,144 square feet with the stipulations. Ms. Savage agreed. It seems like a minimal variance request. It does not appear that it would have an adverse effect on the characteristics of the neighborhood. She would agree with the recommendation to approve. ANALYSIS: i i l Section 205.07.01.B.(4).(a) requires that a first accessory building shall not exceed 100t of the first floor area of the dwelling unit or a maximum of 1,000 square feet. Public purpose served by this requirement is to maintain the residential quality of a neighborhood by limiting the size of accessory structures. Located on the subject parcel is a single family dwelling unit with an attached garage of 780 square feet (y,x 301-). The petitioner is proposing to add an additional 484 square feet for a total of 1,264 square feet. The dwelling unit is 1,424 square feet in area. The petitioner is also in the process of vacating drainage and utility easements along the north and west lot lines of Lot 9, Block 2 Holiday Hills. The petitioner acquired two additional "slivers" of property along the north and west lot lines. The easement along the west lot line is in the middle of the buildable area where the proposed addition would be located. The Planning Commission recommended approval of the request to the City Council. UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON DECLARED THE MOTION CARRIED AND THE PUBLIC HEARING OPEN AT 8:25 P.M. Ms. McPherson stated the subject parcel is located at 501 Rice Creek Boulevard N.E. which is south of 69th Avenue and east of University. The request is to allow an increase in the size of a first accessory structure from 1,000 square feet to 1,264 square feet. The petitioner is also processing a vacation request to vacate the easement. The Planning Commission reviewed the request and recommended the City Council approve the vacation request. Ms. McPherson stated the subject parcel is zoned R-1, Single Family Dwelling. Located on the parcel is a single family dwelling with an attached garage. The existing garage is 780 square feet (26 feet x 30 feet). The petitioner is proposing_ -to add an additional 484 square feet, which is an addition of 22 feet x 22 feet. The total square feet would then be 1,264. The dwelling unit is 1,424 square feet in area. Ms. McPherson stated the addition meets the setback requirements and does not adversely impact sight lines. The existing driveway should be used by the petitioner, and the petitioner would be required to provide a hard surface driveway. The addition is to be architecturally compatible. The request is within previously granted variances. Staff has no recommendation. If the Commission chooses to approve the request, staff recommends the following stipulations: 1. The petitioner shall provide a hard surface driveway to the addition by November 1, 1995. 3. The addition shall be architecturally compatible with the existing dwelling. Dr. Vos asked if the easements along the north and west were utility easements. Ms. McPherson stated these are drainage and utility easements. The petitioner has acquired two "slivers" of property along the north and west lot lines. The existing easements are being vacated and new 12 -foot easements would be dedicated along the new lot lines. No utilities are within the easements and this change would not affect drainage patterns on the site. The petitioner was not present at the meeting.
