Mr. Bolin stated that the petitioner is seeking to reduce the required front yard setback from 35 feet to 25 feet in order to construct an attached garage addition on the site of the existing garage. This would encroach into the current front yard setback. The petitioner desires to construct a 24 feet by 24 feet garage expansion, thus reducing the required front yard setback from 35 feet to 25 feet. The petitioner's property is located at 550 Rice Creek Boulevard. It is zoned on R-1, Single Family, as are all surrounding properties. The petitioner's property is surrounded by Rice Creek along the eastern and southern edges of the property. The front yard is relatively level. There is a severe slope in the rear yard going down to the creek. The petitioner's property was platted in 1962, the same year the home was built. Mr. Bolin stated the petitioner's hardship statement is as follows: "To maintain on level ground without affecting the creek's embankment, which has recently been stabilized, he would need a variance on the street setback regulations to proceed with the proposed project." Mr. Bolin stated the petitioner would like to expand directly off the front corner, out 24 feet, and then back 24 feet. The back edge of the property is where the bluff down to the creek starts. Staff has no recommendation since a similar variance has been granted in the past. The setback was reduced to15 feet for a garage for variance, VAR #97-06, at 198 Mercury Drive. Staff has identified some options to the 24 feet by 24 feet garage that would not require a variance. One option would be a 20 foot by 29 foot addition stepped back seven feet from the front corner. The petitioner would lose about 36 square feet of the storage space, but a garage addition that size would meet the front yard setback and also would not encroach on the bluff line. Another option would be a detached garage in the northern portion of the yard. Mr. Bolin stated that if the Commission recommends approval, staff recommends the following stipulations: 1. All necessary permits shall be obtained from the City prior to construction. 2. A hard surface drive shall be installed within 12 months from the date of final variance approval (consistent with the City's driveway pavement program). 3. The building materials for the addition shall be architecturally compatible with those of the principal structure. 4. The garage shall not be used for home occupation. 5. Mr. Bolin stated that one neighbor had called and stopped in to state that he was in support of this project. The petitioner, Dr. Todd Johnson stated that he would be glad to clarify his proposal instead of the two suggestions by Staff. The 20 feet by 29 feet recommendation does not appeal to him because he needs the space for storage, and he needs space for a fairly large play area for a basketball court. Dr. Johnson stated that he has coached basketball for the last four years. The seven foot setback really encroaches the top of the bluff of the creek. There is a pretty steep drop about three feet back from his proposal. If he did the additional four feet that the City was proposing, the drop would be even closer. He and his neighbors agree that it makes more sense to come out straight out with the addition. The 25 foot setback is from where the lot line is with an additional eight feet or so before you reach the curb. Aesthetically, it would not be infringing on the street, per se. That section is very wooded. The level on the north side is very low, being a flood area, and he is not sure where a garage could fit there. His shed in that area gets flooded. Mr. Kuechle asked how the driveway was proposed to be. Dr. Johnson stated that it would be replaced with a new driveway. It would be more of a U-shaped driveway with a large play area. Mr. Kuechle asked if he had considered setting the garage back 12 to 18 inches. Dr. Johnson stated that the problem would be with the centering of the basket and would create a dangerous situation with the corner sitting out there. Aesthetically, he feels that the garage looks best straight out. Mr. Kuechle stated that setting the garage back break up the roof line a little bit. Dr. Johnson stated that the new roof line would be staggered and be a little shorter. The gutter would be the same height, but then they would actually slope the garage more than it is now. Dr. Vos asked Dr. Johnson to clarify his hardship. Dr. Johnson stated that it is a two -car garage, and he needs additional storage. He has a very large lot and because of the meandering nature of the creek, his property is shaped very irregularly. He has plenty of footage to the south of the property, but it is difficult to build on because of the shape. Dr. Vos asked Dr. Johnson why he did not go deeper with the garage. Dr. Johnson stated that the present garage has a work area back there and he does not need additional room back there. He is looking at putting a kennel on the back of the property. MOTION by Dr. Vos, seconded by Mr. Tynjala, to close the public hearing. We had made an agreement verbally, after numerous requests for a written contract (3), whereby Mr. Eilertson would erect a 24X 24 attached garage on my property at 550 Rice Creek Blvd. Fridley, MN 55432. Mr. Eilertson was to provide the permit and handle all carpentry issues. I was to provide a level block foundation and coordinate tree removal since Mr. Eilertson was not comfortable due to size of some trees and ability to save some existing trees. My complaints with Mr. Eilertson are numerous as follows: 1. He claims to be the general contractor but I lined up all of the additional work and paid them all independently of him. This can be verified with subcontractors. 2. The work was done in a very slow and disorganized manner. Tresses sat on the ground over 3 months and then they needed to be reordered due to deterioration or wrong size. The work began in May 2000 with a downpayment of $5000.00, and the job was still incomplete in Dec. 2000 when he stated he was finished. 3. Quality of work is very poor with a number of defects: a. The eaves of the old garage and new garage do not line up. b. The headers are also a good 6" off in the opposite directions. c. (check with any builder on this one) He charged me 25% margin on materials that were prepaid and told me the door and access door would be an additional charge. So there I was, 10 days before Christmas with an unfinished unusable garage. Mr. Eilertson is talking with my neighbors threatening to picket my office for non-payment.
