1470 Rice Creek Drive
A. PUBLIC PURPOSE SERVED BY REQUIREMENT:
Section 205.053, 4A, requiring a front yard setback of 35 feet.
Public purpose served is to allow for off-street parking
without encroaching on the public right of way. Also for
aesthetic consideration to reduce the "building line of
sight" encroachment into the neighbor's front yard.
B. STATED HARDSHIP:
Without requested variance, house would'.have little useable
rear yard.
C. ADMINISTRATIVE STAFF REVIEW:
Rough field measurements show approximately 75 feet from
the front property line to the toe of the steep embankment
to the rear. The hill varies from a 2:1 to a 1:1 slope in
areas up to a plateau about 30 feet above the street. It
is difficult, without topographical information, to determine
exactly how much rear yard would or would not exist. A
front walk -out design would enable some landscaping of
the rear yard into a flat area, but not without the loss
of several small trees in the existing embankment.

NOTICE IS HEREBY GIVEN that the Appeals Commission of the City of Fridley
will meet in the Council Chambers of the City Hall at 6431 University Avenue N.E.
on Tuesday, February 14, 1978 at 7:30 P.M. to consider the following matter:
A request for a variance of the Fridley City Code
as follows:
Section 205.0531 4A, to reduce the required front
yard setback from 35 feet to 25 feet,
to allow the construction of a house and garage
on Lot 3, Block 2, Heather Hills 3rd Addition,
the same being 1470 Rice Creek Drive N.E.,
Fridley, Mn. (Request by Commercial Erectors,
5298 Fillmore Street N.E., Fridley, Mn. 55421)
Anyone who desires to be heard with reference to the above matter will
be heard at this meeting.

Ms. Gabel said that 'vera though the hardship was vague,
she also. would like to s, o the ti'oes saved; and If Mr. Machlitt
had that much equipment, then she would rather see it put into
a garage than left ou' in the open.

Chairperson Schnabel said that Mr. Boardm I had
distributed a summary of the variances for R-1 Zones from
1976 through 1977. She said that the action re ated to a
suggestion that had been made by Mr. Kemper whe the review of
the Zoning Ordinance was being discussed. She ointed'out
that of all the requests that had been made, th Appeals Commission
had only ,denied threel
Chairperson Schnabel said that she wanted copy of the
summary sent to each member of the Appeals Comm sslon for
their review. �I
Mr. Moravetz said that there could be seveLl more front yard
variance requests from the Hyde Park area. He aid that the
requests will involve many of the same problemsjthat were faced

Mr. Kemper asked if it would be possible for Staff to look
at the requests in the same "light's as the questions that
were brought up regarding the first three.i.tems of the
February 141 1978, Appeals Commission.meeting.
Mr. Moravetz said that they would definitely be handled
using the February 14th meeting as a guideline.
ADJOURNMENT
MOTION by Mr. Barna, seconded by Mr. Kemper, to adjourn the
February 14, 1978, Appeals Commission meeting. Upon a voice
vote, all voting aye, the motion carried unanimously. The
