Fridley, Mn. 55432 Re: Refuse Storage and Collection Dear Mr. Brasch: During a random refuse survey of your neighborhood on April 6, 1977, it was observed that your use of refuse containers was in violation of Chapter 113, Refuse Disposal, of the City Code. The following article was printed in the Spring Newsletter and is being enclosed to inform you of your moral and legal. obligations as a resident of Fridley: "An all encompassing term for household solid waste is refuse, and all refuse can be broken down into two distinct subdivisions - rubbish and garbage. Rubbish is waste newspapers, leaves, metal, wood, clothing and similar items. Garbage is food scraps and packages that contained food. Now, besides it being the law, it is a good sanitary practice to remove and dispose of all refuse generated in the home at a sanitary landfill a minimum of once a week. Equally important is the need to store refuse properly while it is waiting for weekly pickup. When- ever garbage is stored in only a plastic bag, it is very easy for animals and rodents to break open the bag causing the contents to be scattered throughout the neighborhood creating a nuisance and a health hazard. Because of this, the City Ordinance requires that all garbage be stored inside a metal 32 gallon container with the lid in place. Only yard wastes and similar rubbish items may be placed in plastic bags for pickup. Finally, although plastic bags of rubbish may be placed at the curb for pickup, all metal cans must be stored in the rear yard, or out of sight from the street. For. purposes of collection a metal container may be placed a maximum of three (3) feet in front of the dwelling unit, but never should it be placed at the curb for pickup." .t. The following is a list of items that we noted to be unsafe, some more than others. The items needing attention as soon as possible are; 1. Remove the temporary wiring in the basement and plug the washing machine into the outlet provided for such use. If an extension cord is used it should be much heavier than the one in use now. 2. Relocate the.fuel oil storage tank from in front of the electrical fuse box. There must be at least 3 feet of clear space in front of this box. 3. One leg is missing on the oil tank which should be repaired. The tank should be level and can not be setting on wood. The tank should also be properly vented. The vent now has back pitch on it. 4. Ground the electrical system and correct the wiring in the basement which leads to the detached garage. 5. Replace the light switch that is located at the bottom of the stairway leading upstairs from the first floor. 6. Properly install a light fixture on the ceiling in the master bedroom. 7. Remove styrofoam insulation around the rim joist in the basement and replace it with fiberglass batts. 8. Install handrails on all stairways in the structure. If open on one side, install the rail on the open side. The following three items should be done when it is convenient but certainly not longer than 30 days; 1. Cement up the capped hole in the chimney. 2. Install a products of combustion alarm at the top of the stairs in the hall near the bedrooms. 3. Protect the oil line that is located in front of the furnace. History On October 23, 1995, the building department issued a wrecking permit to allow removal of the home at 6291 Central Avenue NE. The owner had previously been issued a variance and special use permit to build an addition to an existing structure within the side yard setback, and a second garage. In order to allow reuse of the materials, the owner methodically dismantled the home board by board. Slow yet continual progress on the demolition kept the permit alive. Once the 1' floor was totally removed, only the open foundation remained. Staff contacted the owner, Mr. Paul Litwinczuk, in November of 1996 regarding the hazardous condition of the remaining foundation. To date, the foundation has not been removed or the hole protected. On January 3, 1997, two separate violation letters were issued to the property owner. The first letter outlined the expiration of the previously approved variance (issued 10/25/97), expiration of the previously approved special use permit (issued 9/12/95), short term actions necessary to protect the open foundation, and provisions of the code pertaining to accessory buildings with no principal building. The second letter outlined the nuisance abatement process and established a January 23, 1997 compliance date for removal of the open basement/excavation. On January 14, 1997, a citation was issued to the property owner for failure to protect the hazardous basement/excavation. The arraignment is scheduled for February 20, 1997. 5.01 On January 22, 1997, Mr. Litwinczuk contacted staff to state a new home will be completed by the end of June. Staff explained that because no action to protect the hole or to remove the foundation had been taken for over a year, the City is forced to schedule removal of the foundation. Mr. Litwinczuk was given the option to remove the foundation and fill the hole to grade by February 13, 1997, or the City will remove it and assess the cost including an additional 25% administrative fee. Status Mr. Litwinczuk has agreed to remove the foundation before February 13, 1997. Mr. Litwinczuk asked for the lowest bid the city had received and indicated he would be contacting that company, Kevitt Excavating, to schedule his own removal date. Staff informed Mr. Litwinczuk that the February 13, 1997, removal date will be strictly adhered to and should he fail to carry out his own removal, the City will proceed with removal of the hazardous excavation in accordance with state statute. The City Attorney has advised that a resolution is needed by the Council prior to removing the foundation and filling the hole. If Mr. Litwinczuk does indeed remove the foundation by the Council meeting, the item may be pulled from the agenda. Recommendation To assure the foundation is removed on or before February 13, 1997, by either Mr. Litwinczuk or the city, staff recommends the city council review and approve the attached resolution authorizing the order to fill the open basement/excavation. Dear Mr. Litwinczuk: A number of issues have recently been brought to my attention concerning your property at 6291 Central Avenue. Issue #1 On October 25, 1995, the Fridley City Council officially approved your request for a Special Use Permit at 6291 Central Avenue. In addition, on September 12, 1995, the Fridley Appeals Commission approved a setback variance to accommodate an addition that would be constructed 7 feet from the southern property line. To date, construction has not been initiated. Fridley City Code allows a period of one year to commence construction upon approval of a land use application such as a Variance or Special Use Permit. Unfortunately, construction has not been initiated at the above referenced site and both the Variance and Special Use Permit have been voided. Issue #2 It has been observed by the City's Building Official, Ron Julkowski, that wrecking permit #23833 issued on October 23, 1995, has not been satisfactorily completed as the foundation and open basement remain on the site. THIS IS HAZARDOUS. Filling in and removing the foundation were listed as a stipulation of the building permit. To resolve this issue you shall immediately enclose the entire foundation with a temporary safety fence. In addition, you will be required to remove and fill the entire foundation in accordance with the attached nuisance abatement letter. Should this inspection reveal unsatisfactory completion of a safety fence you will be cited for permitting a public nuisance. Fridley City Code states that "No accessory building or structure shall be permitted on any lot prior to the time of the issuance of the building permit for the construction of the principal building. " To resolve this issue the accessory structure shall be removed or construction of a principal structure must commence immediately. Should you fail to initiate construction of a principal structure, or remove the existing accessory building by January 23, 1997 (nuisance abatement date) a citation will be issued. Issues #2 and #3 have very serious consequences. Each individual criminal citation can result in a maximum fine of $700 and/or 90 days in jail. Issue #1 On October 25, 1995, the Fridley City Council officially approved your request for a Special Use Permit at 6291 Central Avenue. In addition, on September 12, 1995, the Fridley Appeals Commission approved a setback variance to accommodate an addition that would be constructed 7 feet from the southern property line. To date, construction has not been initiated. Fridley City Code allows a period of one year to commence construction upon approval of a land use application such as a Variance or Special Use Permit. Unfortunately, construction has not been initiated at the above referenced site and both the Variance and Special Use Permit have been voided. served by the City's Building Official, Ron Julkowski, that wrecking permit #23833 issued on October 23, 1995, has not been satisfactorily completed as the foundation and open basement remain on the site. THIS IS HAZARDOUS. Filling in and removing the foundation were listed as a stipulation of the building permit. To resolve this issue you shall immediately enclose the entire foundation with a temporary safety fence. In addition, you will be required to remove and fill the entire foundation in accordance with the attached nuisance abatement letter. In order to allow reuse of the materials, the owner methodically dismantled the home board by board. Slow yet continual progress on the demolition kept the permit alive. Once the I' floor was totally removed, only the open foundation remained. Staff contacted the owner, Mr. Paul Litwinczuk, in November of 1996 regarding the hazardous condition of the remaining foundation. To date, the foundation has not been removed or the hole protected. On January 3, 1997, two separate violation letters were issued to the property owner. The first letter outlined the expiration of the previously approved variance (issued 10/25/97), expiration of the previously approved special use permit (issued 9/12/95), short term actions necessary to protect the open foundation, and provisions of the code pertaining to accessory buildings with no principal building. The second letter outlined the nuisance abatement process and established a January 23, 1997 compliance date for removal of the open basement/excavation. On January 14, 1997, a citation was issued to the property owner for failure to protect the hazardous basement/excavation. The arraignment is scheduled for February 20, 1997. On January 22, 1997, Mr. Litwinczuk contacted staff to state a new home will be completed by the end of June. Staff explained that because no action to protect the hole or to remove the foundation had been taken for over a year, the City is forced to schedule removal of the foundation. Mr. Litwinczuk was given the option to remove the foundation and fill the hole to grade by February 13, 1997, or the City will remove it and assess the cost including an additional 25% administrative fee. Status Mr. Litwinczuk has agreed to remove the foundation before February 13, 1997. Mr. Litwinczuk asked for the lowest bid the city had received and indicated he would be contacting that company, Kevitt Excavating, to schedule his own removal date. Staff informed Mr. Litwinczuk that the February 13, 1997, removal date will be strictly adhered to and should he fail to carry out his own removal, the City will proceed with removal of the hazardous excavation in accordance with state statute. The City Attorney has advised that a resolution is needed by the Council prior to removing the foundation and filling the hole. If Mr. Litwinczuk does indeed remove the foundation by the Council meeting, the item may be pulled from the agenda. Recommendation To assure the foundation is removed on or before February 13, 1997, by either Mr. Litwinczuk or the city, staff recommends the city council review and approve the attached resolution authorizing the order to fill the open basement/excavation.
