This was most unfortunate, however the final outcome was that no lives were lost. As you are aware your dwelling was built in 1938 according to City records. At that time, and until the time of the fire, the dwelling was habitable and functional. To date the house can no longer be lived in because of the structural and smoke damage caused by the fire. The City ordinance states that when building damage exceeds 50%, and the building is nonconforming, it cannot be rebuilt as it existed but must meet the requirements of the City Code. Because the commission has the power to require that appropriate notice is given to it and other interested parties (including interested third parties), the opportunity to appeal is not negated by the court's interpretation. Inverse Condemnation 46 ZD 245 — California Unconstitutional taking is not caused by remodeling costs incurred in order to comply with barrier removal requirements of the Americans with Disabilities Act. Pinnock v. International House of Pancakes Franchisee, U.S. District Court, S.D. California [trial court], Decided November 8, 1993, 844 F. Supp. 574 Facts. On June 21, 1992, a disabled man who uses a wheelchair attempted to use the restroom at an International House of Pancakes restaurant. The entrance to the restroom was not wide enough to admit Theodore Pinnock's chair and he was forced to crawl into the restroom. Pinnock filed suit in federal court claim- ing violations of state health and safety laws, the Unruh Civil Rights Act, and the Americans with Disabilities Act (ADA). The restaurant owner made sev- eral affirmative defenses, including a claim that costs associated with barrier removal mandated by the ADA work a taking without compensation in violation of the Fifth Amendment. The United States joined the suit to defend the ADA and all parties moved for summary judgment. Holding. The court granted summary judgment in favor of Pinnock. An un- constitutional taking occurs, the court said, when a regulation: 1) compels a permanent physical invasion of prop- erty, 2) denies the owner of all economi- cally beneficial use of the property, or 3) does not substantially advance a legiti- mate governmental objective. The remod- eling required by the ADA is not a physical invasion, the court explained, because the act proscribes the use of only part of the restaurant and does not physically intrude upon the owner's property. As to economically beneficial use, the court said that although the remodeling would result in a loss of approximately 20 seats in the restaurant, this was not enough to deny all economically viable use. Finally, the court defended the barrier removal requirements, saying they directly rem- 10 August 1994 Land Use Law edy discrimination against individuals with disabilities. This is the ultimate pur- pose of the act, and these goals are clearly a legitimate governmental objective. Re- jecting all the owner's other claims the court granted summary judgment in fa- vor of the United States and Pinnock. Nonconforming Uses 46 ZD 246 — California Owner of fire -damaged nonconforming building may rebuild it only when it is damaged more than 50 percent of replacement cost but not more than 50 percent of fair market value. Manhattan Sepulveda, Ltd. v. City of Manhattan Beach, Court of Appeal [intermediate court], Decided February 17, 1994,27 Cal. Rptr. 2d 565 Facts. In July 1990, fire damaged a large portion of a nonconforming structure housing three small businesses. The city zoning ordinance does not allow recon- struction of a nonconforming building when more than 50 percent of its value is destroyed. Although the uses conformed to the zoning, the building was nonconform- ing in a number of respects including parking, front setback, sprinkler system, energy, and accommodation of the handi- capped. After the fire, the' city deter- mined that rebuilding the structure would cost more than 50 percent of its value prior to the fire and denied the owner's application to restore the structure. The owner contended that it should be al- lowed to rebuild because less than 50 percent of the fair market value of the building had been destroyed. On appeal, the board of building ap- peals agreed with the owner that the "value" of the building should be as- sessed at its market value rather than replacement cost and recommended the owner be allowed to restore it. The city council denied the owner's appeal, say- ing that using replacement cost as the valuation method was consistent with other parts of the city code. The trial court denied the owner's petition to re- build the property, and the owner ap- pealed. Holding. The court ruled in favor of the property owner. The court said the com- monly understood definition of "value" is fair market value. In absence of clear intent to the contrary, the court explained, words in a statute should be given their ordinary meaning. In this case, the city could not show another instance in which replacement cost was used to determine value for the purposes of enforcing the ordinance. Even though replacement cost was used to determine value in other sections of the code pertaining to enlargement of nonconforming uses, the court said the two sections are not analogous because more restrictive standards are desirable in regulating the expansion of noncon- forming uses. Because the court could find no legislative intent to use replace- ment cost rather than fair market value in determining whether a nonconform- ing use could be rebuilt, the court al- lowed the owner to rebuild the noncon- forming structure. Signs and Billboards 46 ZD 247 — California Billboard owner does not have vested right to continue billboard erected via conditional permit with rider that billboard would be removed after permit expires. Metropolitan Outdoor Advertising Corp. v. City of Santa Ana, California Court of Appeal [intermediate court], Decided March 10, 1994,28 Cal. Rptr. 2d 664 Facts. In 1981, an advertising company was granted a conditional use permit to erect a billboard on the condition that when the permit expired the company would remove the sign at its own ex- pense. After the expiration date the com- pany requested a variance to maintain the billboard. The request was denied by the planning department, and the city council affirmed the decision. On ap- peal, the trial court ruled in favor of the city and also denied the company's mo- tion for a writ of mandate. The company appealed. Holding. The California court of appeal ruled in favor of the city. In its petition for a writ of mandate, the company claimed a fundamental vested right in the continued use of the billboard. Fun- damental or vested rights, the court ex- plained, are those of sufficient signifi- cance to preclude extinction by a nonjudicial power. Here, the court said, the company was bound to remove the sign by the terms of its own agreement.
