I received a call from Mayor Nee pertaining to mud debris on Rice Creek Road
as a result of Tom Brickner development.
We inspected.the area today and found the only debris on Rice Creek Road was
a result of unpaved driveways at 1370 and 1400 Rice Creek Road.
The occupant at 1400 Rice Creek Road has in the past complained to us about
the storm water from Ben Moore Drive running down and across his large elon-
gated lot. This will continue to occur until substantial fill is placed to.
provide development -and storm water drainage.systems installed. We do have
sketchy plans for this area and Council had selected one for area development.

down the hill and across the rear of this property. The drainage system serving
this area could be altered in the future if a new road and development was constructed.

We have been discussing this item with Mr. Brickner for sometime. He
will be constructing a berm at the top of Ben More Drive cul-de-sac to
stop water from draining to the northwest. This should solve the
problem until this area is developed and streets and storm systems
installed.

The storm water from the catch basin on Ben More Drive flows
north through property owned by Tan Brickner then across property
owned by Mrs. Ida Kassow. The water causes erosion in Mrs.
Kassow's garden when we have heavy rains.
I met with Mrs. Kassow in February and agreed that I would ask
Tom Brickner to construct a small berm on his property to control
the water. I talked with Tom on Mare 18th and met him on site
on April 29th and he agreed to build the berm as soon as the
frost was gone and he had equipment available.

SUBJECT: Backyard Erosion
At the request of Mayor Nee,we inspected the erosion that occurred to the
garden at the property of 1400 Rice Creek Road on Monday, April 28, 1986.
The drainage pipe at the end of Ben More Drive discharges onto the vacant
property below Ben More then proceeds through a depressed area down the
slope through the garden and on to Rice Creek Road.
Two years ago, Mr. Brickner, who owns the property above, constructed a
swale area to detain the storm water run off. Due to the accessive amount
of rain that occurred, it was inadequate to deal with this event.
The City will deliver approximately 1.5 yards of black dirt to the site in
an attempt to replace the material that was eroded away.
We are investigating the ownership of the property below Ben More and will
obtain elevations in an attempt to determine if the area can be graded to
hold large volumes of storm runoff and how any overflows can be dealt with.
If this is an appropriate solution, we will attempt to negotiate with Park
Construction when they are working on the Woodbridge project to move a
dozer to the site and move the debris to provide a holding area.

We have received several cmplaa nts from residents living on Rice
Creek Road that water from the Ben More Drive cul-de-sac flows
through their yards causing erosion problems. We have reviewed
this problem and will construct a temporary solution to the
problem by grading a holding area for storm water frcan Ben More
Drive on a vacant lot owned by Tom Brickner. This holding area
will serve as a temporary retention pond until the area is developed
and storm sewer lines can be installed.
I talked to Toro Brickner on September 17, 1986 and he gave us
permission to perform the necessary'grading on his property to
create this retention area. I also talked to Mark Bue (6229
Central Ave., 574-1802) on September 2.2, 1986 and received per-
mission to use his driveway to access the site for this project.
We have obtained quotes to perform this work and Julian Johnson
Construction Company has been selected to do the work. They
will mdve onto the project on September 25, 1986 and hope to
have it ccanpleted that day.

Re: Paved Driveways
Dear Mr. Jankowski:
In 1997, the City Council adopted an ordinance declaring gravel driveways a public nuisance.
They were declared a public nuisance for a number of reasons, such as: they can cause
erosion, contaminate soil with oil and other vehicles fluids, and deposit soil and gravel in the
City's storm sewers and detention ponds. When gravel driveways were declared a public
nuisance, the City Council gave property owners five years to have their gravel driveways
paved. The five-year deadline is quickly approaching, which means all gravel driveways within
the City of Fridley must be paved with approved concrete or asphalt by December 31, 2002.
If on December 31, 2002, your driveway hasn't been paved a citation will be issued and filed at
the Anoka County Courthouse. A misdemeanor citation is a criminal offense and is punishable
by up to 90 days in jail and/or a $700 fine.

On Monday, March 26, 2007, the Fridley City Council officially approved your request for a
Preliminary Plat, PS #07-02, to replat two single family lots to create three single family lots,
legally described as Lot 15, Auditor's Subdivision #22 and Lot 1, Block 1, Klucsar Addition,
generally located atA-40G and 142 ee
Approval of this Preliminary Plat is contingent upon the following stipulations:
1. Property owner of record shall obtain all necessary permits prior to construction.
2. Property owner of record at time of building permit application to pay required $1,500
park fee prior to issuance of a building permit for Lot #2.
3. Property owner of record at time of building permit application to pay all water and
sewer connection fees prior to issuance of a building permit.
4. Provide proof that any existing wells or individual sewage treatment systems located
on the site are properly capped or removed.
5. Petitioner shall provide easements as shown on preliminary plat drawing.
6. Driveway on Lot #1 shall be moved to be within 3 feet of the property line or moved
to be within the property line and a letter shall be submitted stating that the property
owner of Lot #2 is in agreement with the fact that the driveway on Lot #1 is located
on the property line.
The Council action described above is only to approve the preliminary plat. You must have an
approved final plat prior to recording at Anoka County. When the final plat has been prepared
by your surveyor, a copy of the plat should be sent to the Anoka County's Surveyor's office for
review. Once that review is completed, please submit three full size copies of the final plat to
the Community Development Department. The Community Development staff will contact you
as to which council meeting the item will be scheduled for consideration (it will be placed under
the "consent agenda"). After Council action on the final plat, the mylars of the plat must be
submitted to the City for signature by the Mayor and City Clerk. Once signed, the plat is ready
for recording at Anoka County. The final plat must be submitted for action within six months of
approval of the preliminary plat.

Dear Mr. Jankowski:
On Monday, August 13, 2007, the Fridley City Council officially approved your request for a
Final Plat, PS #07-02, to replat two single family lots to create three single family lots, legally,
described as Lot 15, Auditor's Subdivision #22 and Lot 1, Block 1, Klucsar Addition, generally
located at 1400 and 1420 Rice Creek Road.
Approval of this Final Plat is contingent upon the following stipulations:
1. Property owner of record shall obtain all necessary permits prior to construction.
2. Property owner of record at time of building permit application to pay required $1,500
park fee prior to issuance of a building permit for Lot #2.
3. Property owner of record at time of building permit application to pay all water and
sewer connection fees prior to issuance of a building permit.
4. Provide proof that any existing wells or individual sewage treatment systems located
on the site are properly capped or removed.
5. Petitioner shall provide easements as shown on preliminary plat drawing.
6. Driveway on Lot #1 shag be moved to be within 3 feet of the property line or moved
to be within the property line and a letter shall be submitted stating that the property
owner of Lot #2 is in agreement with the fact that the driveway on Lot #1 is located
on the property line.
7. Petitioner shall obtain a permit from Anoka County before commencing with work in
the County right-of-way.
