on a petition for a variance pursuant to the City of Fridley's Zoning
Ordinance, for the following described property:
To increase the total floor area of all accessory buildings from 1,356
square feet to 1,932 square feet, to allow the construction of a garage on
Lot 30, Block 2, Irvington Addition, and Lot 14, except the south 390 feet,
Auditor's Subdivision No. 22, the same being 1420 Rice Creek Road N.E.

CONSIDERATION OF VARIANCE REQUEST VAR #91-07 BY YOAVA KLUCSAR•
Per Section 205.07.01.B.(1) of the Fridley City Code, to
increase the total floor area of all accessory buildings
from 1,356 square feet to 1,932 square feet, to allow the
construction of a garage on Lot 30, Block 2, Irvington
Addition, and Lot 14, except the south 390 feet,
Auditor's Subdivision No. 22, the same being 1420 Rice
Creek Road N.E.
MOTION by Mr. Kuechle, seconded by Dr. Vos, to open the public
hearing.
UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON SAVAGE DECLARED THE
MOTION CARRIED UNANIMOUSLY.
Ms. McPherson stated this property is located south of Rice Creek
Road and east of Central Avenue. The property is zoned R-1, single
family dwelling unit, as are the properties to the north, south,
east, and west. The petitioner is requesting a variance to allow

an increase in the maximum square footage of all accessory
buildings from'1,400 sq. ft., the maximum allowed by code, to 1,932
sq. ft. The petitioner has also applied for a special use permit
as the second accessory building is over 240 sq. ft.
Ms. McPherson stated that currently located on the property are a
single family dwelling unit, an existing garage, and a slab poured
in 1987 in conjunction with a 28 ft. x 11 ft. addition to the
existing dwelling unit. At that time, the petitioner questioned
the Building Department staff as to whether or not he could pour
the concrete slab and use it as a parking area. At that time, the
petitioner was told a variance and special use permit were
necessary per code requirements if a second garage were to be
built.
Ms. McPherson stated the petitioner's property is a little over one
acre in size, and the petitioner has located the second garage pad
in such a manner so that in the future, a breezeway could be
constructed between the house and the garage to create one single
unit. The existing garage is located on the property in such a
manner that should the petitioner choose to subdivide the property,
it would be possible to allow one garage to exist on one lot and
the house and second garage to exist on the other lot without any
conflicts with either the Building or Zoning Codes. There is
adequate separation between all the structures and neighboring
structures on other lots so the second garage would not adversely
impact any abutting properties.
Ms. McPherson stated the Engineering Department has requested that
a single curb cut be maintained on Rice Creek Road with a shared
driveway between the two garages.
Ms. McPherson stated that because the lot is one acre in size and
large enough for at least two building sites, granting the variance
would not create any adverse conditions for the structures on site
or adjacent structures. Staff recommends the Appeals Commission
recommend to City Council approval of this variance request with
three stipulations -.-
One curb cut shall be maintained from Rice Creek Road.
2. The petitioner shall provide a hard surface driveway by
November 1, 1991.
3. Special Use Permit, SP #91-06, shall be approved.
Ms. Smith asked if it would make sense to close off the east curb
cut and make another curb cut on the west side closer to the
proposed garage.
Ms. McPherson stated the Engineering Department was not specific
as to whether a new curb cut should be created, or if the existing

curb cut should be maintained. The Engineering Department just
feels that because of the traffic on Rice Creek Road and the
various improvements that have occurred, having two curb cuts so
close together could constitute a potential traffic hazard. She
could discuss this more with the petitioner.
Ms. Savage asked Mr. Klucsar to explain to the Commission what his
hardship is for needing the proposed garage.
Mr. Klucsar stated he has antique cars, and he needs another garage
to store the cars. He stated he currently lives at 1337 Hillcrest
Drive. His future plans are to sell his current home, subdivide
the property at 1420 Rice Creek Road, and build another house to
live in. If he sells his current home, then he will need a garage
for storage. He stated that the existing house at 1420 Rice Creek
Road, which is vacant, has a very shallow basement and crawl space,
so there is not much room for storage in the basement. He stated
he feels the addition of the proposed garage will be an improvement
for this property.
Ms. Ida Mae Kassow, 1400 Rice Creek Road, stated she lives directly
to the west of Mr. Klucsar. She stated she has no problem with the
variance for the construction of this garage. The property is a
little over an acre, and her property is 1 1/2 acres, so she will
not be able to see the garage. She also would not have any
objection to Mr. Klucsar splitting his property and creating two
lots in the future.
MOTION by Ms. Smith, seconded by Ms. Beaulieu, to close the public
hearing.
UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON SAVAGE DECLARED THE
MOTION CARRIED UNANIMOUSLY.
Mr. Kuechle stated he would recommend approval of the variance with
the stipulations recommended by staff. The proposed garage and the
house could be connected in the future and become one unit. Also,
this is a very large lot. The lot coverage is still going to be
one-fourth of what most lots in Fridley are. Since the alignment
is such that if the petitioner decided to split the lot in the
future, it would work out well as the existing garage would be on
a separate lot.
Ms. Smith stated she had a problem with stipulation #1 about the
one curb cut from Rice Creek Road. The petitioner has stated that
he intends to split the property into two lots in the future, and
she is not sure one curb cut will work for two lots. If the
petitioner creates a new lot, then he will have already put in one
driveway and if the driveway is where the existing driveway is now,
the two lots would have to share a driveway which may or may not
be a problem. She could easily foresee two curb cuts for the two
lots in the future.

Ms. McPherson stated staff would not have a problem with deleting
stipulation #1 if that is the Commission's recommendation. The
placement of the driveway and curb cut may be discussed at the
Planning Commission meeting with the special use -'permit. It can
be discussed further with the petitioner at that time.
Dr. Vos asked if the two accessory buildings can' -exceed the total
square footage of the first floor area of the house.
Ms. McPherson stated that she did not think the total square
footage was a problem in this case. The City has issued special
use permits in the past where all the accessory buildings have
totalled more than the first floor of the house. That would also
not be a problem if the petitioner does, in fact, split the lot.
Dr. Vos stated he is also concerned about the curb cut and that it
could complicate rather than help the situation. Maybe they can
leave the stipulation, make it understood that the petitioner must
maintain one curb cut, but not specify which one. It does not seem
very efficient to have a curb cut come in and then have the
petitioner put in a new driveway across the front of the house to
a new house.
Mr. Kuechle stated he wondered if they would be putting a hardship
on the petitioner by requiring only one curb cut when the
petitioner plans to split the lot in the future.
MOTION by Mr. Kuechle, seconded by Ms. Smith, to recommend to the
City Council approval of variance request, VAR #91-07, by Yoava
Klucsar, per Section 205.07.0l.B.(1) of the Fridley City Code, to
increase the total floor area of all accessory buildings from 1, 356
square feet to 1,932 square feet, to allow the construction of a
garage on Lot 30, Block 2, Irvington Addition, and Lot 14, except

Request
The petitioner is requesting a variance to increase the
maximum square footage of accessory buildings from 1,400
square feet to 1,932 square feet. The request is for Lot 30,
Block 2, Irvington Addition, and Lot 14, except the south 390
feet, Auditor's Subdivision No. 22., the same being 1420 Rice
Creek Road N.E.
Site
Located on the property is a single family dwelling and an
existing garage with a concrete slab for the proposed garage.
The property is zoned R-1, Single Family Dwelling, as are the
properties to the north, south, east, and west.
Analysis
Section 205.07.01.B.(1) requires that the total floor area of
all accessory buildings shall not exceed 1,400 square feet.
Public purpose served by this requirement is to maintain the
residential quality of a neighborhood by limiting the total
square footage of accessory buildings.
In 1987, the petitioner applied for a building permit to
construct a 28' x 11' addition to the rear of the existing
dwelling unit. At that time, the petitioner questioned
whether or not he would be permitted to pour a concrete pad
for a 24' x 24' garage. As the petitioner already has a
garage, he was told that a special use permit would be
required, as the proposed second garage would be over the 240
square feet allowed for a second accessory building. In
addition, the square footage would also be above the 1,400
square feet permitted for all accessory structures, and a
variance would also need to be granted. These requirements
were indicated on the building permit in the form of a
stipulation that no permit for a second garage would be
permitted until the original garage was removed (see attached
1987 permit).

Applicants for vacations must submit the legal description of the
parcel (easement, street, etc.) to be vacated.
Complete site plans, signed by a registered architect, civil
engineer, landscape architect, or other design professional, to
include the following:
A. General:
1. Name and address of project
2. Legal description (certificate of survey may be required)
3. Name, address, and telephone number of applicant,

The petitioner's property is slightly over one acre in size.
The petitioner has located the second garage in such a manner
that it would be possible for a breezeway to be constructed
between the existing house and the garage. In addition,
should the petitioner choose to subdivide the property, it
would be possible to allow one garage to exist on one lot and
the house and second garage to exist on another lot. The
proposed second garage will not adversely impact adjoining
property owners, as there is adequate separation between
structures. The Engineering Department has requested that
one curb cut be maintained and be shared between the two
garages.
Recommendation
Because the lot is one acre in size and large enough to
accommodate at least two building sites, granting the variance
will not create any adverse impacts, nor will it be contrary
to the intent of the code. The proposed garage will be a
logical addition to the property. Staff recommends that the
Appeals Commission recommend approval of this variance
request, to increase the maximum allowable square footage of
accessory buildings, with the following stipulations:
1. One curb cut shall be maintained from Rice Creek
Road.
2. The petitioner shall provide a hard surface driveway
by November 1, 1991.
3. Special use permit, SP #91-06, shall be approved.
Appeals Commission Action
The Appeals Commission voted unanimously to recommend to City
Council approval of the request as presented.
City Council Recommendation
Staff recommends that the City Council concur with the Appeals
Commission action.

On April 2, 1991, the Fridley Appeals Commission approved your
request for a variance, VAR #91-07, to increase the total floor
area of all accessory buildings from 1,356 square feet to 1,932
square feet, to allow the construction of a garage on Lot 30, Block
2, Irvington Addition, and Lot 14, except the south 390 feet,
