PRE 2010 DOCSSTATE OF MINNESOTA COUNTY OF ANOKA CITY OF FRIDLEY A TEMPORARY CONSTRUCTION AND WORK EASEMENT This AGREEMENT entered into this 7th day of Nov. , 1975 by and between Herbert W. and Judith M. Lennox husband and wife, hereinafter referred to as the "Owners", and the City of Fridley, a municipal corporation, Anoka County, Minnesota, hereinafter referred to as the "City". WHEREAS, the City desires to do certain slope construction and maintenance work on the owners property, and WHEREAS, in the process of performing the aforementioned slope construction and maintenance work the City must obtain temporary easement rights over the property of the owner, THEREFORE, said owners do hereby grant a temporary slope construction and work easement to the City over the West 20 feet of Lot 4, Block 2, Spring Valley Addition. It is further agreed that said temporary slope construction and work easement shall remain in effect until December 1, 1975. This agreement may be extended by mutual agreement of both parties. That the easement rights granted to the City shall include the right to enter said property to construct a slope and to make improvements on the referenced property, including the grading of material without further consent from the owner of said property. The owner hereby relinquishes any right to any claim against the City for reasonable damages, in connection with said slope construction and work performed within the time limit of this agreement. The soils encountered were visually identified by our Technician at the time of the borings. The water table was checked immediately after withdrawal of the auger allowing little or no time for stabilization, and therefore should not be depended upon for setting basement elevation. Fluctuations in the level of the hydrostatic ground water table can be expected. In the area of proposed construction, we would recommend removal of all deleterious materials and backfilling with clean mineral soils placed with side slopes of one foot vertical to one foot horizontal, starting two feet outside of the proposed footings, whereby the pad increases in size with depth. Accordingly, the bottom dimension would exceed the footing length by 4 feet plus two times the depth, with the structure then being centered on it. The fill material should be compacted to a minimum of 90% of modified Proctor and two #4 reinforcement bars placed in the footings. We also recommend that drain tile and sump be provided in case a wet basement condition developes due to the fluctuation of the ground water and characteristics of the soils. Topsoil was found below the front garage footing area. This was removed and replaced with sand fill. On August 16, 1978 we took a density test in the compacted sand fill. The density test result was 99% being well above the minimum recommended of 90%. Based on the above, it is our opinion the foundation fill is satisfactory to support this dwelling, with two #4 reinforce- ment bars in the footings. Although no water was encountered in our probings, our past experience in this area has shown drain tile may be necessary. If you have any questions, please call. The property owner confirmed the location of the failure by television inspection of the service connection. The failure appeared to be at an elbow where the service dipped down to connect to the City main. Me television inspection of the service clearly showed a void around the service at the point of failure. The decision was made to relocate the sewer manhole on the east lot line of 1441 Rice Creek Road by jacking a casing under the road for the following reasons: 1. The sewer main at this location is 17 feet deep and approximately 6-8 feet below the water table, requiring dewatering and a large excavation in a heavily traveled, recently constructed street. 2. Jacking a casing to the manhole allowed the work to be ccupleted without disrupting traffic or excavating in the reconstructed street.
