GENERAL INSTRUCTIONS
The following must be secured before moving permit will be issued:
1. A building permit for new location of building to be moved. To obtain this building permit, the following is
required:
(a) The building to be moved must be inspected for structural soundness by the building inspector. Phone this
office for inspection. SUnset 4-7470.
(b) A survey of lot to which building is to be moved. This survey must be made by a licensed surveyor.
(c) The building and moving permit must be obtained at the same time.
2. Tax receipt showing that all real estate taxes due have been paid. Duplicate receipts may be obtained at Anoka
County Auditor.
3. Approval from, the Fridley Water and Sewer Department showing that bills chargeable against the property to
be moved have been paid and water connections have been discontinued at the curb line or at the main. (See
reverse side of form.)
4. Approval from Fridley Director of Public Works office approving routing.
5. Notification to, and signature of utility companies. (See reverse side of form.)

COUNTY OF ANOKA ) BUILDING PEP14IT
WHEREAS, Nedegaard Construction Company, Inc., fee owner of Jot 1, Block 1,
Rice Creek Estates Second Addition, has applied to the City of Fridley for
approval of a building permit to construct a single family dwelling to be located
at Lot 1, Block 1, Rice Creek Estates Second Addition, the same lying in the
South Half of Section 13, Township 30, Range 24, City of Fridley, County of
Anoka, State of Minnesota; and
WHEREAS, the City of Fridley finds that approval of the building permit will
be in the public interest, welfare and convenience to the people of the City of
Fridley if the above understands and agrees to the items below.
NOW THEREFORE, NOTICE IS GIVEN that the above fee owner, its successors and
assigns do hereby convenant and agree to comply with the following conditions
which are stipulations to the requested building permit:
1) Fee owner understands that the public right-of-way adjacent to Lot 1,
Block 1, Rice Creek Estates Second Addition is presently unimproved and the
City will not improve the roadway until the property to the east is properly
platted and graded and appropriate right-of-way is dedicated for street
purposes which would allow the City to complete the improvement of Woodside
Court lying between Rice Creek Drive and Lot 1, Block 1, Rice Creek Estates
Second Addition.
2) Fee owner understands that the City cannot improve any portion of
Woodside Court adjacent to Lot 1, Block 1, Rice Creek Estates Second Addition
since proposed street grades would direct drainage toward the east and
existing topography would not permit proper drainage without dedication of
right-of-way and subsequent street improvement as noted in item #1 above.

3) Fee owner would install a hard surface driveway in the existing right-
of-way of Woodside Court to provide access to Lot 1, Block 1, Rice Creek Estates
Second Addition; however, fee owner understands that all maintenance of the
driveway, including surface treatment and snow removal, is the responsibility of
the fee owner.
4) Fee owner understands that the driveway constructed in Woodside Court
would be removed at the time of proposed street improvement without any
compensation for existing driveway.
5) Fee owner understands that upon completion of the proposed street
improvement, the driveway will be realigned to come off the newly improved street
and any realignment costs will be at the expense of the fee owner.
6) Fee owner understands that future street improvement costs will be assessed
against Lot 1, Block 1, Rice Creek Estates Second Addition and other benefitted
properties as per existing City assessment policy and agrees to $2,000 for
payment of the special assessments related to the street improvement.
7) Fee owner understands that without street improvement of Woodside Court,
the City cannot ensure proper drainage and subject property may be subjected to
water problems.
8) Fee owner understands that without proper platting and grading of the
property to the east, subject property will need to be regraded at future date
to conform to proposed platting and grading. All regrading will be at fee
owner's expense. In order to develop Lot 1, Block 1, Rice Creek Estates Second
Addition, retaining walls will be required along property lines to eliminate
any erosion or safety hazards due to existing topography of property to the
east. In future, when property to the east has been platted and regraded to :
conform to adjacent properties, retaining walls may be required to be removed
at fee owner's expense.

9) Fee owner must ensure that development of single family residence on
Lot 1, Block 1, Rice Creek Estates Second Addition will not be detrimental to
surrounding property; and appropriate grading, retaining walls, and other
means will be taken to ensure no negative impact of development on surrounding
properties. It is understood that appropriate grading, retaining walls and
other means might need to be removed, replaced, revised, changed, etc., when
property to the east is platted and graded properly.

The Mayor asked If the date of February 13, 1973 would be convenient
for the Council members, Councilman Starwalt said he would be able to
attend the noon luncheon on that date,
Councilman Nee said the letter stated the invitation was issued for
ofher members of the community. The City Manager said their first
concern was to set a date when the Council would be able to attend.
After this, he added, invitations would be issued to others.
MOTION by Councilman Nee to receive the letter and set a date for the
noon luncheon with Mr, John Innes, District Manager for Northwestern
Bell Telephone Company,for February 13, 1973• Seconded by Councilman
Starwalt, Upon a voice vote, all voting aye, Mayor Llebl declared
the motion carried unanimously.

X MR. MARC WHITEHEAD: CRIES BROTHERS:
The City Attorney said the letter proposed a solution t10 the long
standing problem with Mr. Chies. He called to the Council's attention
the recent Public Hearing in which a decision for Mr. Chles to do the
work was reached. He added, his office was advised by the Engineering
Department that it would not be practical to do the work until spring.
At this time, Mr. Whitehead is offering the City of Fridley $1,500 to
enable someone other than Mr. Chles to complete the work and discharge
Continental from further liability on the bond, He stated this amount
would be sufficient to remove the hazards in the area, but not sufficient
to finish the grade for development. He said he recommended acceptance
of the offer.
Councilman Utter asked the City Engineer's views on the offer. He said
the amount wouldjust barely take care of some of the dangerous slopes,
But, he added, it may be a step in the right direction.
Councilman Nee asked if the bonding Company had the right to withdraw
the bond,
Thp City Attorney said the bond had been issued in 1965 in the amount
of $9,000, the Council approved the bond and the amount was to cover
the grading for development, He said this would not be possible with
the currently offered amount of money, he added it would only eliminate
the danger factor. TheCity Attorney said If the offer is not accept-
able, he suggested taking action which would bring the matter to an end.

Councilman Starwalt suggested the City 1,1ry to obtain the entire $9,000,
The City Attorney stated the maximum amdunt of the bond is $9,000, The
City has not decided it would take that�Iamount to do the work, He
said this would have to be settled between the City and the bonding
company, he added there would be legal fees Involved. He added he would
like to see the matter disposed of in some manner,

Councilman Starwalt asked if It would be possible to offer them a counter
proposal. The City Attorney said at the time of the construction, the
bonding company had offered the City $2,500 to complete the work, 'He
said he did not know W that amount could be obtained at the present time.
Mayor.Liebl said that since 1964, the City has been trying to stipulate
an-agreement with Mr. Chies. He suggested the City collect as much as
possible at the present time. He asked the City Attorney if the bond
had expired, and If the present offer was a good will gesture. The
City Attorney said the bond had not run out, He added, if action were
taken,the City would have to show the amount of work that has not been
completed and the number of dollars required to complete the work.
The problem would be convincing the court that the City was acting in
good faith in giving Mr. Chies a great deal of time to complete the
project. He said if the City wanted him to start action, this informa-
tion would be related to Mr. Chies and the bonding company.
MOTION by Councilman Starwalt to instruct the City Attorney to proceed
with legal action on a final settlement. Seconded by Councilman Breider,
Councilman Nee asked if there Is presently an order requiring Mr. Chies
to do the work in the spring? The City Attorney said the recent Public
Hearing declared a nuisance and orders were given to abate that nuisance,
He said, if the City was required to do the work, the owner would be
charged for that work on his tax statement. When this was orginally
proposed,the bonding company offered the City $2,$00 to do an acceptable
job. Councilman Starwalt asked if for this amount the complete job
could be accomplished or if it would cover the abating of the nuisance
only. The City Attorney answered, the matter of abating the nuisance
has always brought about differences in opinion between Mr, Chies and
the City Engineering Department.
The City Engineer said they had discussed the matter many times, and many
extensions had been issued on the permit, He said since the time of the
original plans the Planning Commission had approved new pA ans for the
area, He said the last action was to get the property in to shape so .
that It does not create a hazard, and enabling someone to develop it,
This would save a great deal of time, he added, He brought to the
Council's attention the number of times this had been discussed without
any result, He said he would recommend approval Qf the offer,
Mayor Liebl asked if th*t City would be 4410 to prove in r.Qurt that it
would be entitled to $6,000? The City Engineer said the original plan
called for development of 10 acres, and,this is not true at the present
time, Mayov Llebl stated the present plans conflict with the original
plans submitted, The City Engineer saki the agreements between the City
and Mr, Chles had becom6 a give and talo matter, He recalled the Council
had approved extension on the permit, Councilman Breider stated the
City no longer wants the original plan,

The motion and second were withdrawn.

Councilman Starwalt asked the possibility of leaving the matter as set
in the Public Hearing, requiring Mr. Chies to abate the nuisance in the
spring.
The City Attorney agreed, the City Engineer's points were valid. He
added, It would be difficult at this time to determine what the obliga-

The City Attorney said if the City were forced to do the work and
the amount actually needed to complete the project were more than the
offered $1,500, the City could assess the remainder to the property
owner, Mr. Chies.
The City Engineer said he had talked to Mr. Chies about abating the
slopes and had been advised the work could not be done until the spring,
Councilman Breider said in his opinion, $1,500 wou ld not bean adequate
amount to accomplish much.
The City Attorney asked Councilman Breider if he would agree to reject
the offer at this time and ask Mr. Chies to complete the work in the
spring as previously agreed upon? Councilman Breider said he would
agree with this action. .
MOTION by Councilman Breider to reject the proposed offer of $1,500
and adhere to the original plan of requiring Mr. Chies to complete
the work in the spring. Seconded by Councilman Starwalt. Upon a voice
vote, all voting aye, Mayor Liebl declared the motion carried unanimously,

The Mayor said the letter brought out the point that the Council had
only paid the attorneys fees for the Islands of Peace Project and did
not include the payment of the lease.
MOTION by Councilman Utter to pay the state of Minnesota from the Parks
and Recreation Fund and rather than from the Islands of Peace funds.
Seconded by Councilman Nee. Upon a voice vote, all voting aye, Mayor
Liebl declared the motion carried unanimously.

IMPRFAS, all of the property owners whose property is liable to be assessed
with the making of these improvements (as noted in said Notice) were given ten
(10) days notice by mail and published notice of the Council hearing; through
two (2) weekly publications of the required notice, and the hearing; was held
and the property osiers heard thereon at the hearing as noted in the said notice.
NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Fridley,
Anoka County, Minnesota as follows:
1- That the following improvements proposed by Council Resolution No.
49-1975 are hereby ordered to be effected and completed as soon
as reasonably possible,to wit:
Street improvements, including grading,stabilized base, hot -mix
bituminous mat, concrete c"srb and gutter, storm sewer system, water
and sanitary sewer services, and other facilities located as follows:
Rice Creek Estates and Rice Creek Estates Second Addition, Bounded
by Rice Creek Road and 61st Avenue N.E. and that portion West of
Benjamin Street N.E.
2. That, wurk to be performed under this project may be performed under
one or more: contracts as may be deemed advisable upon receipt of bids.
3. That the Public itiorks Director; Richard Sobiech, & the City's Consulting
lingineers are hereby designated as the Engineers for this improvement.
