Mr. Bolin stated the petitioner is requesting a variance to decrease the rear yard setback from 31.25 feet to 10.5 feet to make the existing home a legal non -conforming use. The code requires the rear yard setback of 25% of the lot depth, or 31.25 feet. The property is located at 1561 Rice Creek Road, which is at the comer of Squire Drive and Rice Creek Road. SEPTEMBER 8. 1999 PAGE 2 Mr. Bolin stated the petitioner's hardship statement in summary states they are asking for a variance for the way the house is situated on the property for future use should something happen to the house. Mr. Bolin stated that at the time the building permit was issued for this home, staff had a different interpretation of the front yard. The current code considers the side facing Squire Drive as the front yard, and that is the reason for the variance. Mr. Bolin stated similar variances have been granted. Staff recommends approval of the variance request in order to correct the non-conformity...lf the request is approved, staff recommends the following stipulation: 1. Property owner shall obtain building permits prior to construction. Mr. Bolin stated the stipulation would pertain to the proposed addition the petitioner is planning to add in what is the side yard of the home. This addition meets all the setback requirements. When the petitioner came in for the building permit, the non- conformity was noticed and that is the reason for the variance request. Mr. Kuechle asked what the setbacks are now for what was originally considered the front yard. Mr. Bolin stated that at one time when Rice Creek Road was considered ,the front yard, the front yard setback at that time should have been 35 feet. According to.the survey in the address file, the current home is 34.8 feet from Rice Creek Road. Mr. Kuechle asked if the side yard setback adjacent to a street is now 17 feet. Mr. Bolin stated, yes. Dr. Vos asked how far the home is set back from Squire Drive. Mr. Bolin stated the home is set back approximately 44 feet. Dr. Vos asked to clarify the change in the code. Mr. Bolin stated that since 1988, the code has made a distinction for comer lots stating the shortest street frontage is the front yard or, in this case, Squire Drive. Mr. Gruebele stated his only comment is that the addition will be a four -season porch. Dr. Vos asked the petitioner if he had gotten any comments from the neighbors. Mr. Gruebele stated the neighbors said it was fine. Mr. Bolin stated ots 20, 21, 22 and 23 are zoned C-2, General Business, and Lots 24- 30 are zoned R- General Multiple Units. On an aerial photograph, one can see that over time people hve established an informal alleyway across the rear portion of the property. It is actu lly a paper alley that has never been fully installed or maintained by the City. These pro erties were platted in 1886. From 1955 to about 1996, these properties were occu ied by a gas station and a business that restored fuel pumps. In 1996, the last building was demolished. Mr. Bolin stated the peti 'oner is requesting six variances: 1) to reduce the setback from the adjacent residential d trict on the east side from 50 feet to 30 feet; 2) to reduce the setback from the adjacent esidential district on the north side from 50 feet to 3 feet (this variance will be elim\e"minated if ZOA #99-04 is approved); 3) to reduce the required parking setback frstreet right -of --way from 20 feet to 18 feet (this variance can be eliminateoving two parking stalls, #15 and #16 on the site plan, 2 feet to the east); 4ce the parking setback from an alley from 15 feet to 13 feet (this variance can inated by moving three parking stalls, #23, #24 and #25, 2 feet to the wesreduce the required parking space width from 10 feet to 9 feet (this variance cainated by adding one foot to each parking space); and 6) to reduce thnumber of parking stalls from 32 to 25 (this variance could be eliminare onfiguring the parking lot). ANALYSIS Section 205.07.03.D.(3) requires a minimum rear yard setback of 25% of the lot depth, with not less than 25' permitted or more than 40' required. Mr. & Mrs. Gruebele, property owners, are seeking to decrease his required rear yard setback from 31.25' to 10.5' to correct a non conformity with their existing home, in order to construct an addition to the home. The petitioners property is located on the northwest corner of the intersection of Rice Creek Road and Squire Drive. The home is built facing Rice Creek Road, though the front of the lot as defined by Code would be that portion abutting Squire Drive. Therefore, the Code defined rear yard lot line is only 10.5' from the west side of the existing home. While the proposed addition does not require a variance, the fact that the dwelling unit does not meet the rear yard setback crates a non -conforming condition. Therefore, the petitioner is required to process the variance request to make the property a legal non- conforming lot prior to the issuance of a building permit. As the variance request is to correct a unique existing nonconforming condition, staff recommends approval of the request. To deny the request would require continuance of the non -conforming condition or that the existing home be removed in order to meet the Code requirement, neither of which are practical solutions.
