APPEALS COMMISSION MEETING MINUTES: MOTION by Mr. Jones, seconded by Ms. Jackson, to approve the August 23, 2000 Appeals Commission meeting minutes as presented. UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON KUECHLE DECLARED THE MOTION CARRIED UNANIMOUSLY. 1. PUBLIC HEARING: VARIANCE REQUEST VAR #00-22, BY JON AND SUSAN TYNJALA: Per Section 205.04.06.A of the Fridley Zoning Code, to increase the height of a fence in the front yard from 4 feet to 6 feet to allow the construction of a fence in the code -defined "front" yard on Lot 37, Block 2, Harris Lake Estates, generally located at 1581 Rice Creek Road. MOTION by Mr. Jones, seconded by Dr. Vos, to open the public hearing. UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON KUECHLE DECLARED THE MOTION CARRIED AND THE PUBLIC HEARING OPENED AT 7:31 P.M. Mr. Bolin stated that Jon and Susan Tynjala would like to construct a six-foot tall fence in the code -defined front yard of their property located at the corner of Rice Creek Road and Squire Drive. The Code requires that a fence in the front yard not exceed four feet in height. This situation is unique because the petitioner's home fronts on Rice Creek Road. The actual code- defined front yard is Squire Drive because that is the narrowest lot width that has street frontage. The fence is going to be in what the petitioners consider their side yard. APPEALS COMMISSION MEETING, SEPTEMBER 13, 2000 PAGE 2 Mr. Bolin stated the property is zoned R-1 single family, as are all the surrounding properties. The lot was platted in 1973, and the home was built the following year. The petitioner has indicated that he will keep the fence back 20 feet from the curb which keeps it at about three feet inside the ten foot utility easement. There are no utility easements on the street side of Squire Drive. Staff requires a "hold harmless" agreement for a portion of the fence that will be located on the east side of the home. Upon further review by the Engineering staff, there is a 36 inch storm drainage pipe that runs through this easement. If something ever happened to that pipe, the City would need to service it. The petitioner has indicated that there will be a gate on the east side. The Engineering staff does not have a problem with the fence being built over the easement as long as there is a signed "hold harmless" agreement. Mr. Bolin stated that the petitioner's hardship states: "The proposed fence would enclose the back yard and would extend into what the City considers our front yard to within 20 feet of the curb on Squire. We wish to construct a fence because we have two small children and the lack of enclosure is a safety issue. Both Rice Creek Road and Squire are heavily traveled. On numerous occasions vehicles have cut the corner of Squire over our lawn. Safety is a our primary concern." Mr. Bolin stated that going six feet does not cause any concerns for vision on the corner of Rice Creek Road and Squire Drive. The fence would extend out from the side of the home staying 20 feet back from the curb. There is quite a bit of space there and staff has no concerns about the corner vision safety zone. Staff has no recommendation as similar variances have been granted in the past. A variance was granted along East River Road increasing a fence height from four feet to six feet in the code -defined front yard. Also, along East River Road, a fence height was increased from four feet to seven feet in the side yard of a corner lot. The petitioners, Jon and Susan Tynjala, 1581 Rice Creek Road, stated that the design of the fence has gone through different gyrations. They now want to cut it at the northeast corner and they are not going to go into that east side. Dr. Vos asked if they were going into the easement. Ms. Tynjala stated that they are not. They are just going off the back:corner., Dr. Vos asked what the fence will be made of. Mr. Tynjala stated that it would be made of cedar. Mr. Kuechle asked if there were any calls from neighbors. Mr. Bolin stated that they have not had any calls from neighbors. MOTION by Ms. Jackson, seconded by Dr. Vos, to close the public hearing. UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON KUECHLE DECLARED THE MOTION CARRIED AND THE PUBLIC HEARING CLOSED AT 7:40 P.M. APPEALS COMMISSION MEETING, SEPTEMBER 13, 2000 _ PAGE 3 Dr. Vos stated that it seems like a reasonable request because of the code -defined front yard and side yard. The six-foot fence would seem to be natural there because it looks like a side yard. He would recommend approval. The neighbors to the west do not have any problem. Ms. Jackson stated that she would consider Rice Creek Road the front yard. Mr. Kuechle concurred. The traffic on Rice Creek Road is heavy and this is warranted for safety. The true front yard is not what is legally defined as a front yard so he would be in favor of this. Mr. Jones stated he agrees for the same reasons. He can see the need for the safety issue. It looks like the front yard is on Rice Creek Road. He would be in favor for approval for the same reasons. MOTION by Dr. Vos, seconded by Ms Jackson, to approve variance request, VAR #00- 24, by Jon and Susan Tynjala. Mr. Bolin stated no building permit is required for the fence.
