That the Petitioner is the developer and Contract of Deed Holder o`f Lots 1, 2, and 3, Block 3 and Outlots 1 and 2, Cochran's Addition, and now being divided into a proposed plat known as Briardale, approximately 12.8 acres of land substantially as shown on the attached Exhibit "A", hereinafter called the Development. That the applicant hereby petitions for the approval of the Development Plat. WHEREAS, the Petitioner proposed to develop for residential purposes the Development by either sale of individual lot or lots only or sale of individual lots and homes; and WHEREAS, the City must approve the Development and is responsible for the design and construction of public utilities and roads within its boundaries; and WHEREAS, the City and the Petitioner intend that the development take place in an orderly and predetermined manner; NOW, THEREFORE, the petitioner agrees as follows, that: 1. The complete roadway grades and lot grades for the entire Development will be submitted to the City Engineer for approval. 2. The sanitary sewer system for the Development will be designed such that the manhole located at Rice Creek Road and Benjamin Street will determine the exit point for the Development's sanitary sewer system. 3. The Lots 13, 14, 15, 16, and 17, Block 3 of the Development, will be used as a retention basin for storm water until such time as a storm sewer outlet for the Development is built. 4. An escrow amount of $8.00 per 100 square feet for the area of each lot will be placed with the City for the building permit issued for that lot to cover future storm sewer improvements, with any improvements made z within the Development credited to the developer's escrow account. S. The Petitioner agrees that the conditions of this petition are to run with the property and be made binding upon all future owners of said Development and pursuant thereto. Our inspection records indicate that the footings were poured on or about September 21, 1973., Since. more than 120 days have elapsed since any visable construction has occurred on the home, the City has no choice but to declare the permit null and void. Since this basement has been left open and constitutes a life hazard, you must fence the area off so that the basement is inaccessible to the public. (6) Permit Number 11,953: was issued for 1613 Briardale Road, the same being Lot 6, Block 2, Briardale Addition. The permit was issued on December 29, 1972. Our inspection records indicate that the footings were poured'on or about August 13, 1973„ Since more than 120 days have elapsed since any visible construction has occurred on the home, the City has no choice but to declare the permit null and void. The basement on this lot must also be fenced to prevent the probability of an unsuspecting person from walking and falling into the basement. (7) Permit Number 11,938: was issued for 1633 Briardale Road, the same being Lot 8, Block 2, Briardale Addition. The permit was issued on December 29, 1972. Our inspection records indicate that<the footings were poured on or about August 8, 1973 ince more than 120 days have elapsed since any,visible progress has been made on the home, the City has no choice but to declare'the permit null and void. The basement on this lot must also be fenced,. We would appreciate your prompt attention to resolving these matters. Fridley, Minnesota 55432 Re: Voided Permits for Seven Homes Dear Mr. Miller: This is to confirm our telephone conversation of December 5, 1974. Please recall our December 3, 1974 meeting when it was decided that we would check with our City Attorney about the possibility of the City adminis- tration renewing your permits for the seven homes in Briardale Addition. I have reviewed this possibility with Mr. Herrick and he advised us that there is no means by which the administration can authorize the renewal of a permit nearly two years old. He also doubted that the City Council would have the authority either, however if you choose to write a letter to the City Council, he would then research the situation more throughly and would be able to advise the Council on this matter the night they are confronted with your request if you choose to make it. The next Council meeting is December 16, 1974 and items to be considered for that meeting must be reviewed by the City Manager's office no later than. noon on the previous wednesday (December ll, 1974). As agreed at our December 3, 1974 meeting, the City administration would wait until legal interpretation of the Code had been made, or possible Council action on the 16th of December, before making a final decision on this matter. Between now and the 16th however, please consider your permits void" and your cooperation in not going ahead with construction with the one exception will be appreciated. In a case where existing off-street parking facilities, to the use of the public tree of charge or at reasonable [Variance] rates. have unused parking capacity. the Board of Appeals may recommend to the City Council the reduction of the parking space requirement for any use not more than 500 feet distant, by not more than the number of stalls of unused capacity. 2. In a case where any public or private off-street parking facility, to be open to the use of the public free of charge or at reasonable rates, is under construction or planned, and where there is reasonable assurance that such development will be carried to completion and will when completed relieve the parking demand in an area within 500 feet thereof in some measure or in full measure, the Board of Appeals may recommend to the City Council to establish a reasonable time period within which any use or uses within such area shall provide required spaces for parking stalls. Upon completion of all or a portion of such development, the provisions of the preceeding paragraph #1 may be applied. 3. In a case where the customary mode of transportation of a majority of the patrons, employees and proprietors of any use, to and from the area in which such use is located, is other than by private automobile, the Board of Appeals may recommend to the City Council a reduction, by not more nthan 50 per cent, the parking space requirement for such use. 4. In a case where it is clearly shown by the applicant that the provision of space required herein for parking stalls, due to the particular nature of a proposed use or other conditions, would be unnecessary hardship, the board may recommend to the City Council a variance of such requirement. 5. In a case where it is clearly shown by the City that the provisions for parking space required for specific district uses is inadequate, additional off-street parking will be required by the City. Building 205.16. BUILDING PERMITS Permits All 205.161. All Districts Districts A building permit shall be acquired before the erection, construction, reconstruction, alteration, enlargement or moving of any building except that such permit shall not be required if the full value of said work is less than $150.00. 1. Each application for a building permit shall be accompanied by a Certificate of Survey, drawing, or plat, in duplicate, drawn to scale and showing the lot, the proposed building and dimensions of the lot and building; the location and proposed use of the buildings; the location, dimensions, present and proposed use of any existing building on the same lot; the setback and dimensions of front, side and rear lots and such other information as the zoning administrator shall require for the enforcement of this ordinance. If interior finishing of a home or building is to be done, the material accompanying the application, as noted above, for a permit will not be required. 2. Once construction of the foundation has been completed, a certificate of survey showing the location of the foundation shall be required, before the framing of the structure is begun. 3. Construction shall commence within ninety (90) days from the date of the issuance of the building permit unless written application is made for the extension of said time, in which event the extension of time shall be at the discretion of the zoning administrator. If not commenced within said (90) day period of extension as granted by the administrator, such permit shall be void. 4. No building permit shall be issued for the construction, reconstruction, alteration, enlargement or moving of any building unless said proposed work Is in conformity with the Fridley building code. Permit Required Required In addition to other regulations and requirements herein, no building or use shall be permitted in any District nor 205-63 M BUILDING CODE APPENDIX E PERMITS AND INSPECTIONS 1. Application for Permits (a) Permits Required. No person, firm, or corporation shall erect, con- struct, enlarge, alter, repair, move, improve, remove, convert, or demolish any building or structure in the municipality, or cause the same to be done, without first obtaining a separate building permit for each such building or structure from the Administrative authority. (b) Application. To obtain a permit the applicant shall first file an application therefor in writing on a form furnished for that purpose. Every such application shall: 1. Identify and describe the work to be covered by the. permit for which application is made; 2. Describe the land on which the proposed work is to be done, by lot, block, tract, and house and street address, or similar description that will readily identify and definitely locate the proposed building or work; 3. Show the use or occupancy of all parts of the building; 4. Be accompanied by plans and specifications as required in Sub- section (c) of this Section; 5. State the valuation of the proposed work; 6. Be signed by the permittee, or his authorized agent, who may be. required to submit evidence to indicate such authority; 7. Give such other information as reasonably may be required by the administrative authority. (c) Plans and Specifications. With each application for a building per- mit, and when required by the administrative authority for enforcement of any provisions of this Code, two sets of plans and specifications shall be suh- mitted. The administrative authority may require plans and specifications to be prepared and designed by an engineer or architect licensed by the state to practice as such. When authorized by the administrative authority plans and specifications need not be submitted for the following: 1. One-story buildings of Type V conventional woodstud construc� tion with an area not exceeding six -hundred square feet (600 sq. ft.). 2. Group 7, Division 1, Occupancies of Type V conventional wood- stud oodstud construction. 3. Small and unimportant work. (d) Information on Plans and Specifications. Plans and specifications shall be drawn to scale upon substantial paper or cloth and shall be of suffi- cient clarity to indicate the nature and extent of the work proposed and show in detail that it will conform to the provisions of this Code and all relevant laws, ordinances, rules and regulations. The first sheet of each set of plans shall give the house and street address of the work and the name and address of the owner and person who prepared them. Plans shall in- clude a plot plan showing the location of the proposed building and every existing building on the property. In lieu of detailed specifications, the ad - 246 APPENDIX E MINNESOTA STATE j ministrative authority may approve references on the plans to a specific l section or part of the Code or other ordinances or laws. Computations, stress diagrams, and other data sufficient to show the cor- rectness of the plans, shall be submitted when required by the administrative authority. 2. Building Permits (a) Issuance. The application, plans, and specifications filed by an applicant for a permit shall be checked by the administrative authority. Such plans may be reviewed by other departments of the municipality to check compliance with the laws and ordinances under their jurisdiction. If the administrative authority is satisfied that the work described in an applica- tion for a permit and the plans filed therewith conform to the requirements of the Code and other pertinent laws and ordinances, and the fee specified in Section 3(a) has been paid, he shall issue a permit therefor to the applicant. When the administrative authority issues the permit, he shall endorse in writing or stamp on both sets of plans and specifications "APPROVED." Such approved plans and specifications shall not be changed, modified, or altered without authorization from the administrative authority, and all work shall be done in accordance with the approved plans. The administrative authority may issue a permit for the construction of part of a building or structure before the entire plans and specifications for the whole building or structure have been submitted or approved provided adequate information and detailed statements have been filed complying with all pertinent requirements of this Code. The holder of such permit shall proceed at his own risk without assurance that the permit for the entire building or structure will be granted. (b) Retention of Plans. One set of approved plans, specifications, and computations shall be retained by the administrative authority for a period of not less than 90 days from the date of the completion of the work cov- ered* oveyed' therein, and one set of approved plans and specifications shall be re- turned to the applicant, which set shall be kept on such building or work at all times during which the work authorized thereby - is in progress. Plans, submitted for checking, for. which no permit is issued, and on which no action is taken by the applicant for 90 days, shall be returned to the last known address of the applicant; to renew action on said plans, a payment of a new plan -check fee shall be required. (c) Validity. The issuance or granting of a permit or approval of plans and specifications shall not be construed to be a permit for, or an approval of, any violation of any of the provisions of the Code. No permit presuming to give authority to violate or cancel the provisions of this Code shall be valid, except insofar as the work or use which it authorizes is lawful. The issuance of a permit based upon plans and specifications shall not prevent the administrative authority from thereafter requiring the correction of errors in said plans and specifications or from preventin-g building opera- tions being carried on thereunder when in violation of this Code or of any other ordinance of the municipality. (d) Expiration. Every permit issued by the administrative authority under the provisions of this Code shall expire by limitation and become null and void, if the building or work authorized by such permit is not com- 246 r BUILDING CODE APPENDIX E menced within 60 days from the date of such permit, or if the building or work authorized by such permit is suspended or abandoned at any time after the work is commenced for a period of 120 days. Before such work can be recommended a new permit shall b b _aingcl s._o_to do, . original plans and specifications for such work; and provided, further, that such suspension or abandonment has not exceeded one year. (e) Suspension or Revocation. The administrative authority may, in writing, suspend or revoke a permit issued under provisions of this Code whenever the permit is issued in error or on the basis of incorrect informar tion supplied, or in violation of any ordinance or regulation or any of the provisions of this Code. 3. Fees (a) Building Permit. Fees. A fee for each building permit shall be paid to the administrative authority as set forth. The determination of value or valuation under any of the provisions of this Code shall be made by the administrative authority. Where work for which a permit is required by this Code is started or proceeded with prior to obtaining said permit, the fees above specified shall be doubled, but the payment of such double fee shall not relieve any per- sons from fully complying with the requirements of this Code in the execu- tion of the work nor from any other penalties prescribed herein. Courts have frequently ruled that Building Permit Fees cannot be used as revenue raising device, but should equal actual cost of administration and enforcement of the Code. Due to wide variation of this cost, no attempt is made here to set the actual fees. There are two accepted methods of setting these fees. One is the basis of estimated cost. The other on a unit basis; such as cubic feet of structure, number of electric outlets, and so forth. Each municipality should set its fees on the basis as outlined above. (b) Plan -checking Fees. When the valuation of the proposed construc- tion exceeds $$1,000.00 and a plan is required to be submitted by Sub -section (c) of Section 1, a plan -checking fee shall be paid to the administrative au- thority at the time of submitting plans and specifications for checking. Said plan -checking fee shall be equal to one-half of the building permit fee. 4. Inspections. (a) General. All construction or work for which a permit is required shall be subject to inspection by the administrative authority, and certain types of construction shall have continuous inspection by special inspectors, as specified in Section 5. A survey of the lot may be required by the administrative authority to verify compliance of the structure with approved plans. C(b) Inspection Record Card. Work requiring a building permit shall not be commenced until the permit holder or his agent shall have posted an 247 APPENDIX E MINNESOTA STATE inspection record card in a conspicuous place on the front premises and in such position as to allow the administrative authority conveniently to make the required entries thereon regarding the inspection of the work. This card shall be maintained in such position by the permit holder until the Certificate of Occupancy has been issued. (c). Approvals Required. No work shall be done on any part of the building or structure beyond the point indicated in each successive inspection without first obtaining the written approval of the administrative authority. Such written approval shall be given only after an inspection shall have been made of each successive step in the construction as indicated by each of the inspections required in Subsection (d). There shall be a final inspection and approval on all buildings when com- pleted and ready for occupancy. (d) Called Inspections. No reinforcing steel or structural framework of any part of any building or structure shall be covered or concealed in any manner whatever without first obtaining the approval of the administrative authority. The administrative authority upon notification from the permit holder or his agent shall make the following inspections of Type V buildings and shall either approve that portion of the construction as completed or shall notify the permit holder or his agent wherein the same fails to comply with the law. 1. FOUNDATION INSPECTION: To be made after trenches are excavated and forms erected and when all materials for the foundation are delivered on the job. Where concrete from central mixing plant (commonly termed "transit mixed") is to be used, materials need not be on the job. 2. FRAME INSPECTION: To be made after the roof, all framing, fire -blocking, and bracing are in place and all pipes, chimneys, and vents are complete. 3. LATH AND/OR WALLBOARD INSPECTION: To be made after all lathing and/or wallboard, interior and exterior, is in place and all plastering materials are delivered on the job, but before any plastering is applied or before wallboard joints and fasteners are taped and finished. 4. FINAL INSPECTION: To be made after building is completed and ready for occupancy. (e) Other Inspections. In addition to the called inspections specified above, the administrative authority may make or require any other inspec- tions of any construction work to ascertain compliance with the provisions of this Code and other laws which are enforced by the Building Department. For the purpose of determining compliance with Section 4(h), the admin- istrative authority may cause any structure to be reinspected. 5. Special Inspections (a) General. In addition to the inspections to be made as specified in Section 4, the owner or his agent shall employ a special inspector who shall be present at all times during construction on the following types of work: 1. CONCRETE: On concrete work when the design is based on an 'T,," in excess of 2000 pounds. 2. MASONRY: Masonry work shall have special inspection when required in Chapter 24. 248 BUILDING CODE APPENDIX E 3. WELDING: On all structural welding. 4. REINFORCED GYPSUM CONCRETE: When cast -in-place re- inforced gypsum concrete is being inixed or deposited. 5. SPECIAL CASES: On special construction or work involving unusual hazards or requiring constant inspection. The administrative authority may waive the requirement for the employ- ment of a special inspector if he finds that the. construction or work is such that no unusual hazard exists. (b) Special Inspector. The special inspector shall be a qualified person approved by the administrative authority. The special inspector shall furnish continuous inspection on the construc- tion and work requiring his employment. He shall report to the administra- tive authority in writing, noting all Code violations and other information as required. (c) Approved Fabricators. Special inspections required by this Section and elsewhere in this Code shall not be required where the work is done on the premises of a fabricator approved by the administrative authority to perform such work without special inspection. The certificate of approval shall be subject to revocation by the administrative authority if it is found that any work done pursuant to the approval is in violation of this Code. 6. Certificate of Occupancy (a) Use or Occupancy. No building or structure in Groups A to H, inclusive, shall be used or occupied, and no change in the existing occu- pancy classification of a building or structure or portion thereof shall be made until the administrative authority has issued a Certificate of Occu- pancy therefor as provided herein. (b) Change in Use. Changes in the character or use of a building shall not be made except as specified in SBC 302 of this Code. (c) Certificate Issued. After final inspection when it is found that the building or structure complies with the provisions of this Code, the admin- istrative authority shall issue a Certificate of Occupancy which shall contain the following: 1. The building permit number. 2. The address of the building. 3. The name and address of the owner. 4. A description of that portion of the building for which the cer- tificate is issued. 5. A statement that the described portion of the building complies with the requirements of this Code for group of occupancy in which the. proposed occupancy is classified. 6. The name of the administrative authority. (d) Temporary Certificate. A temporary Certificate of Occupancy may be issued by the administrative authority for the use of a portion or por- tions of a building or structure prior to the completion of the entire building or structure. (e) Posting.
