Re: Construction Without Obtaining a Building Permit
Dear Mr. Kiewel:
It has been brought to our attention that interior work has been
completed on your residence, located at 1631 Rice Creek Rd NE,
which is not covered on your Building Permit #23017 for installing
three basement windows. A building permit is required for interior
remodeling and inspections need to be performed on framing,
electrical wiring, etc. prior to covering.
We also were informed that you were attempting to sell this
property and were listing it as a duplex. This property is not a
legal duplex and zoning restrictions will not allow it to be
converted to a duplex. Therefore we ask that you not treat it as
such.

We expect that you will obtain the necessary building permits and
have the required inspections performed. An investigation fee will
be added to the permit that will be equal to the permit fee.
If this matter is not resolved by January 16, 1995, it may be
turned over to the City Prosecutor for his legal consideration.

Dear Mr. Kiewal,
On September 7, 1995 I issued a first notice of noncompliance
letter to your attention at 1631 Rice Creek Road. At that time I
explained Fridley City Code requirements for vehicle parking,
outside storage, and grass maintenance. Since that time city staff
has visited the site on occasion to discuss a variance application
and the remaining code issues. Although improvements have been
made, several issues still need to be resolved. The purpose of
this letter is to serve as your 2nd written notice for being in
violation of City Code. Failure to correct these violations may
require legal action.
The following is a complete listing of code violations in need of
correction. Please review the actions needed to correct carefully.

1. A surety bond or certified check in the amount of $ (5% of value of work to be completed) must
be submitted after approval of application and prior to any work commencing. This bond or check is to ensure
satisfactory performance and compliance with the below stated stipulations. The surety bond or check shall
be kept active until the completion of work and/or expiration of permit and can only be released by written
notification of the City after a satisfactory final inspection has been performed by the City.
2. All access and street frontage of the land alteration site must be controlled by a fence, a minimum of four (4)
feet in height. All entrances must have gates that are capable of being locked.
3. Only rock, sand, gravel, dirt, or similar natural earth fill is permitted. No concrete, asphalt, or demolition
wastes will be permitted as fill unless a demolition landfill permit is first obtained from Anoka County.
4. Operations shall be limited to daylight hours and shall not interfere with the health and safety of surrounding
residents and the premises shall be maintained at all times so as not to create a nuisance.

received a complaint from a New Brighton resident this fall asking about the grading that you
are doing in the back yard. He stated that work was being performed on the weekend using a bull
dozer.
Please be advised that your Land Alteration Permit expired on September 30"', 2005. This was
the date you told me that you would be completed with your grading and retaining walls. I would
request that you stabilize the site and perform no other work until another land alteration permit
is issued.
Also, in regards to the retaining walls, I noticed you used plastic barrels as a retaining wall. You
did not disclose that you were considering using an alternative or experimental retaining wall
product. Currently, plastic barrels are not an approved product for retaining wall construction.
Approved materials include timbers, segmental blocks, poured concrete, and boulders. 1 do not
know of any plastic barrel engineering data for retaining wall construction. This is a safety issue
for you, the future property owner, and your neighbors.
Structural information needed for approval of this alternative retaining wall include:
• Internal friction of the soils
• Drainage
• Geosynthetic reinforcement
• Factors of Safety
• 1.5 for sliding
• 2.0 for overturning
• 2.0 for bearing capacity
• Angle of wall inclination
• Shear capacity and/or plastic barrel deformation

data to support the use of plastic barrels, please provide engineering data for the plastic barrels.
Also, provide information regarding W protection to the plastic barrels.

2. Please include site stabilization plan for the spring melt with the new land alteration
permit.
3. Engineering data to support the use of plastic barrels as a wall by February 28, 2005.
