Mr. Hick9k stated that he would like to introduce the newest Planning Commission
Membe , Barbara Johns. The City would like to welcome her and thank her for her
interein the Planning Commission. The Planning Commission is an important role in
the processing of land use action items in the City. Ms. Johns is also the Chairperson
of the Environmental Quality and Energy Commission.

Mr. Bolin stated that r. Tappe is requesting a special use permit to allow the
construction of a 720 quare foot accessory building to be used strictly for vehicle
parking and storage. econd accessory buildings over 240 square feet are a permitted
special use in the R-1 ning district, provided that the total square footage of all
accessory buildings doe not exceed 1,400 square feet.
Mr. Bolin stated that the p perty is zoned R-1 single family. The properties to the north
and south of the property a e also R-1, single family. To the east are the Burlington
Northern Railroad tracks. T the west across East River Road are more single family
homes. This lot was platted 1941, and the home was built sometime prior to 1949.
The proposed drawings provi ed by the petitioner and,the builder indicate that with the
existing garage and a small st rage shed that is also located on the property, the
proposed accessory structure ill total 1,350 square feet, well within the acceptable
square footage.
Mr. Bolin stated that the propose garage will be located east of the current garage

Mr. Bolin stated the actual size of the lot is different than the size the builder submitted,
which was 120 feet wide by 500 feet deep. In reality, the lot is only 100 feet wide and
360 feet deep on the northern edge and 34 feet deep along the southern edge of the
property. The property is still 35,000 squarekeet. It is not the 60,000 square feet as
originally thought. Because of that, an additil stipulation is added requiring the
petitioner to have the property surveyed befot goes to the Council to identify and

also seeking a variance from the Appeals
Commission to increase the allowable square
footage of all accessory buildings form 1,400
square feet to 1,666 square feet to allow the
construction of an additional 33' X 30' (990

REQUEST
Jim Kiewel, property owner at 1631 Rice Creek Road, is requesting a special use permit to allow
the construction of a 990 square foot accessory building. Petitioner is also seeking approval
from the City Council to increase the Code allowable square footage of all accessory buildings
form 1,400 square feet to 1,666 square feet to allow the construction of this additional 33' X 30'
detached garage.
Accessory buildings over 240 square feet are a permitted special use, provided the total size of all
accessory structures does not exceed 1,400 square feet. The existing garage, shed, and the
proposed accessory building are a total of 1,666 square feet, which is 266 square feet more than
the total allowed by Code.
The petitioner is also seeking a variance from the Appeals Commission to allow the total square
footage of these accessory structures to exceed 1,400 square feet. The public hearing on the
petitioners variance has been postponed from April 12 until May 10 due to the lack of a quorum
at the Appeals Commission meetings. The 60 Day Agency Action requirement has been
extended on both requests to allow this Special Use Permit request and the Variance request to be
heard by the City Council at the same meeting (May 24, 2000).
PROPERTY HISTORY
The property is located north of Rice Creek Road near the New Brighton border. The home is a
1,500 square foot walkout rambler with a 576 square foot (24'x24') attached two car garage.
The home was built in 1953. and the attached garage was added in 1961. The petitioner has
owned the property since 1994 and in 1995 applied for a variance to construct an attached garage
addition to increase the size of accessory structures to a total of 2,064 square feet.
A previous variance request, VAR #95-23 to allow an accessory structure to exceed the principal
building in size, was approved by the City Council on February 26, 1996 after two revisions
were made to reduce the total square footage of the accessory building to 1,392 square feet.
The existing 24' by 24' attached garage was built as a two story garage (walkout site allowed a
garage below the standard garage), which made the actual square footage of the original garage
1,152 square feet. The original request for Variance #95-23 was to place a 24' X 38' addition
attached to the existing garage and home. A variance was needed as this request would not only
exceed the square footage of the home, but would also exceed the 1,400 square foot limit for all
accessory buildings. This request increased the total square footage of accessory buildings to
2,064 square feet and was denied by the Appeals Commission at their September 12, 1995
meeting.
When the variance request went to the City Council on October 2, 1995, the petitioner reduced
his request to 1,776 square feet of total accessory buildings by reducing the size of the existing
lower garage unit to 288 square feet. This request was denied by the City Council.
The petitioner then asked the Council to reconsider his request on October 23, 1995. The
petitioner agreed to remove the garage door from the lower level and block the space in so that it
was not considered part of the accessory structure. This reduced the petitioners request to 1,392
total square feet of accessory structures. The City Council tabled this request to explore the
necessity of any changes to the accessory structure portion of the Code. On February 12, 1996
the City Council determined that the ordinance did not need to be changed and at their February
26`x', 2000 meeting granted approval of VAR #95-23 to allow the size of a first accessory
building to be 1,392 square feet.
Because the 1995 proposal was for the expansion of an attached garage, a special use permit was
not necessary.
RECOMMENDATIONS

City Staff recommends approval of this special use permit request if the following modification is
made.
0 The proposed size of the building exceeds the total allowable square footage for accessory
buildings, therefore, the petitioner must reduce square footage of proposed garage and meet
Code requirements for size.
STIPULATIONS
Staff recommends that if the Special Use Permit is granted, the following stipulations be
attached.
1. Petitioner shall obtain all necessary permits prior to construction.
2. The petitioner shall provide a hardsurface driveway by May 1, 2001.
3. The accessory structure shall not be used to conduct a home occupation.
4. Approval is dependent upon the approval of VAR #00-04.
