Councilman Schneider questioned if they are a licensed vehicle, but not in use,
if they would come under the public nuisance ordinance.'
Mr. Herrick, City Attorney, explained, in order to be a public nuisance, it has
to be something that adversely affects the health, safety or welfare of a sub-
stantial number of people. He stated, if the City can develop rationale that
would support that test, then it might be something the City would attempt
to get action on or an opinion from the court.
Councilman Schneider asked, when you speak of the public health, safety or
welfare, can it be interpreted to include the lowering of property values.
Mr. -Herrick felt this would fall under what would be considered a private
:nuisance. He pointed out a public nuisance affects a substantial number of
the public and it is a crime or misdemeanor, and a private nuisance is a civil
action brought by the party that is adversely affected.
Councilman Schneider asked Mr. Herrick if he had any problem.with the wording
of the ordinances as they are submitted here this evening.
Mr. Herrick stated he was satisfied with the changes and the key is that it is
defining a public nuisance as one that is affecting one or more people.
FIRST READING OF AN ORDIN.INCE AMENDING CHAPTER 18 OF THE CITY
MOTION by Councilman Schneider to waive the reading and approve the ordinance
upon first reading. Seconded by Councilwoman Moses. Upon a voice vote, all
voting aye, Mayor Nee declared the motion carried unanimously.
CONSIDERATION OF FIRST READING OF AN ORDINANCE ESTABLISHING A NEW CHAPTER 110
OF THE FRIDLEY CITY CODE ENTITLED PUBLIC 'NUISANCE AND REPEALING PRIOR CHAPTER
MOTION by Councilman Schneider to waive the reading and approve the ordinance
upon first reading. Seconded by Councilman Barnette. Upon a voice vote, all
voting aye, Mayor Nee declared the motion carriend unanimously.
Councilman Schneider thanked Mr. Flora and the staff for their work put into
these ordinances.
DISCUSSION OF.REMOVAL OF BOARDED UP RESIDENCE, 1632 RICE CREEK HILLIPS: POS, LEVY F
Mr. Flora, Public Works Director, stated an investigation was made at the
property at 1632 Rice Creek Road for the possibility of a nuisance. He stated
this is a boarded up, abandoned single family residence which also contained
for licensed vehicles on the property.
Mr. Flora stated the City has not been able to obtain entrance to the dwelling,
however,.Mr. Phillips was sent a letter asking him to meet with the -City per-
sonnel at the.site, but the City still has not been able to contact him.
Councilman Schneider asked if Mr. Phillips was aware this item was to be dis-
cussed this evening. Mr. Qureshi, City Manager, stated he was not advised the
item was on the Council's agenda. He felt the City should develop a course of
action and then advise him accordingly.
Councilman Schneider stated the property is generally maintained on the outside
and the grass is cut, but questions, because of the age of the'structure and
"lack of upkeep, whether there is a safety hazard involved. He questioned how
the City would gain access to determine if there are any problems.
Mr. Herrick, City Attorney, stated the fact that the house isn't occupied
probably would limit the agreement whether it is fit or unfit for habitation.

Mayor Nee stated the Council encourages regular block parties in the neigh-
borhood, however, this one did seem quite extreme and not consistent with
others.
Mr. Herrick, City Attorney, felt any person sponsoring a party of this ature
would be incurring a substantial legal liability. He pointed out wit that
quantity of beer and if a•person was served while he was intoxicated nd there
was an accident, they would sue the persons sponsoring the party.

( by Mr. Kreger. Seconded by Councilman Barnette.
. Wagner stated they expect to be out of town on the dat when this party
planned and questioned, with the flyers out, if there ould be any trouble.

WEATHERIZATI N PROGRAM - KATHY BROWN, ANOKA CO TY COMMUNITY ACTION:
Kathleen Brown, with the Anoka County Commu ty Action Program, appeared
before the Coun it regarding the weatheriz ion program. She stated she has
contacted all se 'or citizen groups in th County, however, there are other
persons who may b eligible for assistan a in weatherization of their home
and they are tryin to reach these indi ideals.
Ms. Brown explained t e purpose of th program is to try and conserve energy
for the future. She s aced she know there are persons in the County that
need this help and are of aware of the program and requested the Council's
assistance.to inform per ns who mf be eligible.
Councilwoman Moses suggest so flyers be•left at the library and also
distributed at the energy fa'r.
Mr. Qureshi, City Manager, sta ed the City does have a Human Services Specialist
and these flyers would also b irculated to the proper personnel.
NEW BUSINESS:
Mr. Flora, Public Works DiActor, stat d, after review of the nuisance draft
ordinance by the City Pro ecutor, Mr. N quist and the City Attorney, Mr. Herrick,
only a few items were no specifically a ressed in the City's existing codes
and these items have be n incorporated int changes to the Code, Chapters 18
and 110.
Mr. Flora explained he first ordinance, as sh n on Page 1A of the agenda
book, is now covere in existing Code 110, howe r, it was felt it would be
more appropriate t have this section concerning nstruction works hours
and alternate hoe work permit under Chapter 18, t e construction and building
code.

He stated he i uld have no problem if the City were to post the building saying
occupancy is prohibited until the property is inspected by the City. He stated
the City staff shouldn't go into the structure, without permission of the owner,
or a.search warrant from the court. Mr. Herrick pointed out, in order to obtain
a search warrant frw the court, someone will have to sign an affidavit showing
cause why the judge should issue that warrant.
Councilman Schneider stated there are other properties in the City which are in
a "boarded -up" situation and asked Mr. Herrick if he was aware of any communities
that have ordinance against keeping properties in this state. Mr. Herrick stated
he seemed to recall that the City of Minneapolis stated they wouldn't take action
against properties simply because they were boarded -up.
Councilman Schneider questioned if State legislation had passed regarding in-
spection of cesspools and septic systems by the State or local communities to
insure that ground maters weren't being polluted. Mr. Herrick stated he would
check into this matter further.
Councilman Schneider stated, if nothing can be done at -this point, he wished
staff to keep on top of the matter and make whatever inspections that can be
made without entering the property, and if there is a probable cause to bring
it back to the Council.

SUBJECT: Possible Hazardous Structure at 1632 Rice Creek Road/Levy Phillips
Dear Mr. Herrick:
The question has been raised whether or not a residential dwelling located at 1632 Rice Creek
Road owned by Levy Phillips could be considered a hazardous or substandard structure. This
question is the result of a recent police shooting and criminal investigation of the site that revealed
unsafe and unsanitary conditions.
The questions or issues I would like to address concerning this situation are:
1. Can we acquire and use documentation from the recent criminal investigation as
evidence that the structure is unsanitary and unsafe?
2. Based on our current knowledge of the property (see attached property
evaluation), can we enter and inspect the property for code compliance?
3. If it is determined that extensive building and zoning code violations exist, what
steps must be taken to improve the structure? Can we require these improvements
to take place before occupancy is re-established?
4. If improvements to the property are necessary, and the current property owner is
still being detained under criminal/mental evaluation by Anoka County, who is the
most appropriate legal contact?
It is possible, but not probable that Levy Phillips will return to occupy this dwelling. If Mr.
Phillips does return, I am concerned that the conditions of the structure will not be safe, sanitary
'and in compliance with the necessary code requirements. It is my intention to verify that the
structure is safe and compliant before anyone returns.

and is under criminal/mental evaluation.
1. Is the property connected to city water and sewer?
a) The property is not currently being billed for sewer or
water services.
b) There are no services noted on the as -built surveys from
project 48 schedule B of April 1961. The as-builts do
show a Y connection available from the street.
c) The assessing files show that the property is connected
to sewer and water services. The city assessor has never
been permitted access to the house. The assessed value
of this property is derived using the estimated value of
the land and structures as viewed from the street.
2. Is the house structurally sound?
a) All windows on the house are currently boarded up, it is
not known if any other points of entrance to the house
and shed are secure.
b) Recent criminal investigations of the site have revealed
potentially unsafe and unsanitary conditions.
C) The property owner has boarded up the windows since 1980
if not earlier. Boarding up the windows for this long
period could lead to poor ventilation which creates
warping, damp stagnant air, peeling paint and degradation
of the structural components of the building.
d) A visual inspection from the street has indicated that
the existing siding and roof may not be impervious to
weather and rodents.
3. In the owners absence, who is responsible for maintaining and
securing the property?
a) On 6-28-95 the property owners sister informed city staff
that she is mowing the lawn. It is not known if she has
gained permission from the property owner to conduct
these activities or even be on the property.
4. Should any of these questions need further investigation who

Last week I made a follow-up call with Eleanor Beardsley, Levy Phillips' sister. During the
conversation, I learned the following:
During a court appearance the week of 7/17/95, Mr. Phillips did not secure a court
appointed attorney; however, he did request his sister, Mrs. Beardsley, to hire an
attorney to handle all of his affairs. The attorney's name is:

2. Mrs. Beardsley was very concerned about the lack of security at the house
immediately following the investigation. She was apparently concerned that the
front door had police tape on it, but no lock. She has since placed a padlock on
the door.
3. Mrs. Beardsley assured me that nobody would be occupying the structure, her
brother is very sick, and in all likelihood, will not be returning. It is her opinion
that the structure will eventually be taken down.
4. Mrs. Beardsley confirmed that their is no water or sewer hook-up at this address.
5. Mrs. Beardsley informed me that her brother's attorney will most likely be in touch
concerning the condition and progress of the property.

regarding the property. It appears that she may have gained considerable influence regarding Mr.
Phillips' affairs.

Notice of Release
The Minnesota Pollution Control Agency (MPGA) has been informed that a release of petroleum has occurred from
storage tank facilities which you own and/or operate. We appreciate your timely notification so this site can be handled
in an efficient manner.
Legal Obligations
Federal and state laws require that persons legally responsible for storage tank releases notify the MPCA of the release,
investigate the release and, if necessary, clean up the release. A person is considered legally responsible for a tank
release if the person owned or operated the tank either during or after the release, unless specifically exempted under the
law. If you believe that you are not legally responsible for this storage tank release, please contact the project manager
listed below.
If you are not legally responsible for the release, but hold legal or equitable title to the property where the release
occurred, you may volunteer to take corrective action. Responsible persons and volunteers who take corrective action
may be eligible for reimbursement for a major portion of the costs of corrective action. The legislature has established
the Petroleum Tank Release Cleanup Account to reimburse responsible persons and volunteers. The account is
administered by the Petro Board which is part of the Minnesota Department of Commerce. Final decisions regarding the
amount of reimbursement are made by the Petro Board. All questions about eligibility and reimbursement should be
directed to the Petrofund staff at 651/297-1119 or 651/297-4203.
Request to Take Corrective Action
The MPCA staff requests that you take steps to investigate and, if necessary, clean up the release in accordance with the
enclosed MPCA fact sheets. The site investigation must fully define the extent and magnitude of the soil and/or ground
water contamination caused by the release. A report (Excavation Report and/or Remedial Investigation/Corrective
Action Design (RI/CAD)) which details the results of the investigation or concludes that excavation was sufficient to
clean up the release must be submitted to this office within 10 months of the date of this letter. Please refer to MPCA
fact sheets for information pertaining to the amount of work needed at the petroleum release site(s).

Sites with free product (free-floating petroleum), drinking water supply impacts, surface water impacts, indoor vapor
impacts, fire or explosion hazards, or ground water impacts which pose a significant threat to public health or the
environment, are considered high priority for staff review. If one or more of these situations apply to your site, an
RI/CAD report must be submitted within 90 days. In addition, if you know or discover that there is free -product from a
well, excavation, or borehole, you must notify the MPCA within 24 hours and IMMEDIATELY begin interim free
product recovery.
If you have not already done so, the MPCA recommends that you hire a qualified consulting firm registered with the
Petrofund staff that has experience in conducting petroleum release site investigations and in proposing and
implementing appropriate corrective actions. A list of registered contractors and consultants is available from the
Petrofund staff. The MPCA reserves the right to reject proposed corrective actions if the requirements of the site.

requested work. If you do not respond within this time frame, the MPCA staff will assume that you do not intend to
comply, in which case the MPCA Commissioner may order you to take corrective action. Failure to cooperate with the
MPCA in a timely manner may result in reduced reimbursement from the Petro Board. See Minn. R. 2890.0065, subp. 1,
item C. The enclosed fact sheets will provide you with the information necessary to complete a successful investigation
and cleanup. If you have any questions concerning this letter or need additional information, please contact me at

Dear City of Fridley,
We have purchased the lot on Stinson and Rice Creek Road with the intent of
building a beautiful home and an underground swimming pool in the spring.
We are moving to Fridley because of the great Community. Also, I have
researched many schools and have decided my children will receive a great
education in this District.
The City has asked us to have the driveway come off Rice Creek Rd. Also,
the water and sewer has to come from Rice Creek Rd. The home we are
building is a modified two story, which means the garage will be in front of
the home. If we have to move the garages to the side the house it would not
fit on this property facing Rice Creek Rd. Also, the cost of restructuring the
home would be thousands of dollars. We are at the maximum dollar capacity
right now, so this is a hardship request, asking you to give us the variance we
need to build our home. There is an ordinance stating your garage cannot be
more than 5 feet in front of your home. Our garage will be extended more
than 5 feet, but it will not stick out any f u then than our neighbors. We have
lined up our garages to be even with theirs.
If we turn the house to face Stinson the driveway would be a danger, because
the lot is 8 feet higher than the street at the curb. Our driveway would be
straight up. Plus, we would have no room in the backyard for the 24 x 48 -
foot swimming pool with the 10 -foot cement apron needed around the
swimming area; we are building for our children.

RE: Swimming Pool Construction at 1632 Rice Creek Road NE, Fridley
Dear Sirs:
This letter is to make clear this department's requirements for the swimming pool
construction at the above address.
1. As indicated, three (3) skimmers approved by the National Sanitation Foundation will
be provided.
2. As indicated, five (5) inlets of approved design for fresh and/or repurified water will
be provided.
3. The filter and pump shall be approved by the N.S.F. and be of sufficient capacity to
provide a minimum turnover of at least two (2) times in 24 hours. This department
recommends a turnover rate of 6 - 8 hours.
4. A deck of at least three (3) feet wide, measured from the pool waters edge, shall be
provided which extends completely around all private residential pools. Above
ground.private residential pools may be provided with decking of a minimum size of
4 feet by 4 feet at pool entry points and provided that such decking has the approval
of the City.
5. Fencing or other effective means including but not limited to walls or buildings,
acceptable to the City. Fencing shall meet the following criteria:
a. The fencing shall prevent the entrance of children and be without hand or
footholds that would enable a person to climb over it.
b. The fencing shall be at least 6 feet high and entrances shall be equipped with
self-closing and self -latching gates capable of being locked.
c. Self-closing and self -latching devices shall be placed at the top of the gate or
otherwise inaccessible to small children.
d. The opening between the bottom of the fence and the ground or other surface
shall be not more than four inches.

6. An automatic chlorinator should be provided with a suitable test kit.
7. All electrical and plumbing installations shall be inspected and approved by the
City Inspection Department.
8. All overhead electrical lines must be a minimum of 10 feet horizontally from the
pool surface and 18 feet straight line distance from the waters edge. An alternative
is to bury said lines.
9. The pool fill spout must be protected by a vacuum breaker or air -gapped.
10. Suitable safety equipment to include but not limited to a ring buoy and rope that is
1 1/2 times the pool diameter, and shepherds crook pole must be provided and
maintained with the pool at all times.
Furthermore, these and any other requirements must meet the provisions of the Fridley
City Code, Section 115, Swimming pools. The building permit is approved contingent
on final inspections and approval by the City.
