Fridley, MN 55432 Subject: Waste system installation on addition Dear Mr. Wiley: This letter confirms our conversation on November 15, 1989 regarding the use of the product Novaweld C in the installation of a PVC waste system in the addition to our home. We will not hold the City of Fridley or you responsible for any failure of the installation in the future based upon assurances from Mr. James Morrow, Director of Engineering for Genova Products, Inc., the producer of the product. Based upon this letter, you will approve the waste system installation with the Novaweld C product. This letter does not presume approval of the entire system until other portions of the installation are corrected. So that we agree on the circumstances and information surrounding your approval, I've documented the events from the "red tag" on the system until today. I would lie them included in your records and ours to ensure that any future questions will have the benefit of notes made at the time. 1) We began the installation using the Novaweld C product based upon the recommendation of an employee of Knox Lumber in Coon Rapids. Their recommendation was based upon manufacturer's claims. 2) The installation faded the first inspection because the Novaweld C is manufactured to the requirements of ASTM standard F-493 for CPUC and not to ASTM Standard D2564 which is the standard for the PVC waste pipe used in our project. 3) The manufacturer's representative, S.D. McCullough & Associates, Inc., claimed that the product meets or exceeds the D-2564 standard, and is a superior product You asked that the manufacturer document this statement. 4) Mr. James Morrow sent a letter to you dated November 15, 1989 via fax with the original to follow by mail. You provide a copy of the entire fax to me. ( hank you.) The letter stated, in part "This letter is to serve as our warranty that our Novaweld C solvent cement, is manufactured to the requirements of ASTM Standard F-493 and approved by the National Sanitation Foundation for use in solvent welding CPUC potable water systems. This product will meet and/or exceed all requirements of our Novaweld P, which is manufactured to the requirements of ASTM Standard D-2564 and used in solvent welded PVC systems." 5) I talked to Mr. Morrow on November 15 to ask about the letter and to get further, clarification of the statements in the letter. He described the difference in the two products in terms of the Novaweld C being a more aggressive solvent The bond, he said, would end up stronger than with the Novaweld P product He also stated that he used the Novaweld C product in his own home. When asked if the letter was the Genova warranty of product suitability, he said yes. He did say that he couldn't warrant the way the product was used in the installation. I understand the statement, but I assured him that we followed the instructions exactly as printed on the labels of the Genova primer and cement 6) Based upon all of the above factors, we decided to give you this letter and request a waiver from the standards for the use of the Novaweld C in the installation of the waste system. We believe that based upon Mr. Morrows letter, repeated statements of product efficacy by Knox Lumber specialists and the manufacturer's representatives, we can accept the risk of using what they claim is a better product than the Novaweld P. Should the joints fail in the future, we will hold Genova Products, Inc responsible to honor their warranty, and Knox Lumber responsible for the initial product recommendation I appreciate the position that you are in to enforce the codes in the light of changing market conditions.
