Mr. Freeberg of 301 Rice Creek Terrace N.E. has submitted a request to discharge a firearm within the City limits and also to construct a firing range on his property. The property is zoned R-1, Single Family Dwelling of which there are associated accessory uses permitted in the Zoning Code. One of the permitted accessory uses is that of private recreation facilities. Does Mr. Freeberg's proposed use fall under the definition of privately -owned recreation facilities, and are there any other liability issues which the City may need to be concerned about with this request? Lenzmeie DATE: 1/12/93 SUBJECT: Quentin Freeburgl-s License To Discharge A Firearm On 1/12/92 I went to the Freeburg residence at 301 Rice Creek Terrace and inspected the site and the plans Mr. Freeburg designed for a firing range. He told me his intent is to use the range to teach his two children, ages 12 amd 14, the proper handling and use of tirearms. He plans to use a BB/pellet Crossmen brand rifle which is capable of firing a BB at 590 FPS and a BB/pellet Crossman brand pistol which is capable of firing a BB at -390 FPS. He would like to have his range approved before April of 93 so that he'could start buiding it as soon as the whether permits. The range Mr. Freeburg plans to build will be behind his house. His lot is on the south side of Rice Creek and boarders University Ave. and the walkway. Because of the lowland of the creek his lot is very deep allowing him to have'a 100 foot range behind his house with a lot of room to spare. He plans to build a 4 x 8 foot wooden barrier covered with styrafoam behind his garage. In front of the barrier he plans to place a bale of hay with the target afixed to it. Since the elavation of the house is on the highest part of his property, the barrier is about 20 feet lower then his garage. The shooter using the range would be standing a short distance from the creek and shooting towards the back of the house and garage where the target and barrier would be located. Shots that would miss the target would probably be caught by the barrier. If the shots were too wild they would be stopped by the house or garage. The range would be parrallel to the public walkway and about 75 feet east of it. Mr. Freeburg felt the only danger with the range would be to members of his own ramily who walk to the back yard while the range is in use. He plans to minimize that risk with some range rules. Also included in those rules would be the requirement that whenever his children use the range one of the parents would have to be with them. Other then the danger to his own family I see there may be a risk of stray shots going over the barrior and over the house. Those shots would eventually come down and it is possible that someone could be injured by them. If it were decided that Mr. Freeburg be allowed to go forward with his range it may be desirable that the permint contain language that would retrict the use of the range to guns of the calibre mentioned in this memo or guns of a lessor calibre. less. I am of the opinion that the use could be within that definition. You then go on to ask whether there are any other liability issues which the City may need to be concerned about. Fridley City Code, Chapter 103, is entitled "Dangerous Weapons". Included within the definition of "dangerous weapons" are high velocity pellets of any kind but not limited to BB guns and air rifles. This Ordinance provides that it is unlawful to discharge a dangerous weapon within the City of Fridley. An exception to this prohibition allows the Public Safety Director to issue a fire arms permit. Clearly, the Public Safety Director could issue this permit and could make it subject to reasonable conditions. I have two concerns about the issuance of a permit in this situation: 1. The possibility of the City being held liable for issuing a permit in case someone is injured by the discharge of the fire arm. An Equal Opportunity Employer James P. I believe that the City would incur some risk in issuing this type of permit. I have reviewed the Memorandum, together with the attachments, and have also discussed this matter with Jim Hill. In your Memorandum you asked whether this proposed use could be considered a private recreation facility. I am of the opinion that the use could be within that definition. You then go on to ask whether there are any other liability issues which the City may need to be concerned about. Fridley City Code, Chapter 103, is entitled "Dangerous Weapons". Included within the definition of "dangerous weapons" are high velocity pellets of any kind but not limited to BB guns and air rifles. This Ordinance provides.that it is unlawful to discharge a dangerous weapon within the City of Fridley. An exception to this prohibition allows the Public Safety Director to issue a fire arms permit. Clearly, the Public Safety Director could issue this permit and could make it subject to reasonable conditions. I have two concerns about the issuance of a permit in this situation: 1. The possibility of the City being held liable for issuing a permit in case someone is injured by the discharge of the fire arm. An Equ i' 0i,pwtunit% Empi wr James P. I believe that the City would incur some risk in issuing this type of permit. I also question whether the public reaction to issuing permits for discharging this type of weapon within the City would not be a negative reaction. I suggest that the Public Safety Director discuss this matter with Mr. Freeberg and determine whether some alternative arrangement cannot be worked out.
