SUBJECT: Streambed and Bank Stabilization Program
Dear Chairman Cardinal:
The City of Fridley has received one request from Tom Kaufhold
representing the 5 properties at 361, 375, 389, 403, and 419 Rice
Creek Terrace, along a curve in Rice Creek requesting consideration
for project funding by the Rice Creek Watershed District in
accordance with the Streambed and Bank Stabilization Program.
The City Council reviewed this project at their August 12 meeting
and totally support the request.
In addition, the City will join the project to incorporate a storm
sewer outfall on the easterly end of the project. We have
authorized an amount up to $5,000 for the extension of the rip -rap
and filter blanket.
Recommend the Rice Creek Watershed receive the attached project and
approve it for financial assistance in the 1992 construction year.

Purpose: Approval of an SBBS Shoreland Improvement Plan on Rice Creek,
1,330 linear feet.+.
At their meeting on July 28, 1993 , the Board of Managers -
of the Rice, Creek Watershed District reviewed your permit:
application and the recommendation of the District Engineer based
upon the following exhibits:
1. Permit Application dated June 30, 1993.
2. Rice Creek SBBS application, undated and received July 2, 1993.
3. Location map, undated and received July 2, 1993.
4. Plan.profile and sections prepared. by Soil Conservation Service, dated
November 1992, received July 2, 1993..
5. Cash surety in the amount of $5,000.00 received August 12,. 1993. -.
6. Calculations giving flow rates for rip rap sizing, prepared by Soil
Conservation Service, dated October 1992,. received.July 26, 1993.
They found the project as planned to be in accordance with the
Rules & Regulations and Guidelines of the District and therefore
approved the permit as requested, with the following additional
stipulations:
NO ADDITIONAL STIPULATIONS
It is the responsibility of the Permittee to provide all measures
necessary to contain sediment on the site during construction.
This may require the use of erosion control measures not outlined

on the erosion control plan. If this requirement is not met, the
Permittee may be ordered to provide additional erosion control
measures if deemed necessary by the District Inspector.
Immediately upon completion of rough grading, stormwater management
features must be completed according to plans permitted by the
District. It is also the responsibility of the property owner to
provide necessary maintenance to assure that the stormwater
management systems approved as part of this Permit will continue
to function as originally designed.
NOTE FOR PROVIDERS OF A CASH SURETY: Failure to implement and
maintain the sediment -erosion control and cover establishment
measures outlined in the permit exhibits may result in forfeiture
of your cash surety. If such measures are satisfactorily provided,
the cash surety will be returned with interest after permanent
vegetative cover has been established. Please notify the District
Office in writing when permanent vegetative cover has been
established and a final inspection will be -made.
Two (2) inspections of the project site are included with this
Permit: one after erosion control measures are in place and one
after project completion and revegetation, and will be conducted
to assure compliance with all agreements, terms, and stipulations
of this Permit. Failure to comply with the foregoing may result
in rescission of the Permit, and is in violation of Chapter 112.89
MSA, a misdemeanor. Any additional inspection, requested or
required, will be billed at $25/visit.
This document is not transferable, and is valid for one (1) year
after the date of -issuance. No construction is authorized beyond
the expiration date. If Permittee requires more time to complete
construction, a renewal of the Permit will be necessary.
Please contact RCWD at 483-0634 when the project is about to
commence so an inspector may view the work in progress. By
acceptance of this Permit, Permittee has consented to the
foregoing. The enclosed Owner's Certification form must be
completed and forwarded within ten (10) days of project completion.

VISIONS•
This permit is granted subject to the following GENERAL an SPECIAL PRO
GENERAL PROVISIONS
1. This permit is permissive only and shall not release the Permittee from any liability
or obligation imposed by Minnesota Statutes, Federal Law or local ordinances relating
thereto and shall remain in force subject to all conditions and limitations now or
hereafter imposed by law.
2.. This permit is not assignable except with the written consent of the Commissioner of
Natural Resources.
3. The Regional Hydrologist shall be notified at least five days in advance of the
commencement of the work authorized hereunder and shall be notified of its completion
within five days thereafter. The Notice of Permit issued by the Commissioner shall be
kept securely posted in a conspicuous place at the site of operations.
4. No change shall be made without written permission previously obtained from the
Commissioner of Natural Resources, in the dimensions, capacity, or location of any
items of work authorized hereunder.
5. The Permittee shall grant access to the site at all reasonable times during and after
construction to authorized representatives of the Commissioner of Natural Resources for
inspection of the work authorized hereunder.
6. This Permit may be terminated by the Commissioner of Natural Resources at any time
he/she deems it necessary for the conservation of water resources of the state, or in
the interest of public health and welfare, or for violation of any of the provisions
of this permit, unless otherwise provided in the Special Provisions.
7. Construction work authorized under this permit shall be completed on or before date
specified above. Upon written request to the Commissioner by the Permittee, stating
the reason therefore, an extension of time may be obtained.
8. The excavation of soil authorized herein shall not be construed to include the removal
of organic matter (as indicated above) unless the area from which such organic matter
is removed, is impervious, or is sealed by the application of bentonite after
excavation.
9. In all cases where the doing by the Permittee of anything authorized by this permit
shall involve the taking, using, or damaging of any property rights or interests of any
other person or persons, or of any publicly owned lands or improvements thereon or
interests therein, the Permittee, before proceeding therewith, shall obtain the written
consent of all persons, agencies, or authorities concerned, and shall acquire all
property, rights, and interests necessary therefore.
10. This permit is permissive only. No liability shall be imposed by the State of
Minnesota or any of its officers, agents, or employees, officially or personally, on
account of the granting hereof, or on account of any damage to any person or property
resulting from any act or omission of the Permittee or any of its agents, employees,
or contractors relating to any matter hereunder. This permit shall not be construed
as estopping or limiting any legal claims or right of action of any person other than
the state against the Permittee, its agents, employees, or contractors, for any damage
or injury resulting from any such act or omission, or as estopping or limiting any
legal claim or right of action of the state against the Permittee, its agents,
employees, or Contractors for violation of or failure to comply with the permit or
applicable provisions of law.
11. No material excavated by authority of this permit nor material from any other source,,
except as specified herein, shall be placed on any portion of the bed of said.waters
which lies below (as indicated above)... ._
12. Any extension of the surface of said waters resulting from work authorized by this;
.permit shall become protected waters and left open and unobstructed for use by the
public.
13. This permit does not obviate any requirement for federal assent from the U.S. Army
Corps of Engineers, 1421 U.S. Post Office and Custom House, St. Paul, Minnesota 55101-
9808.
SPECIAL PROVISIONS
14. The permittee shall comply with all rules, regulations, requirements, or standards of
the Minnesota Pollution.Control Agency and other applicable federal, state, or local
agencies.
15. Permittee shall ensure that the contractor has received and thoroughly understands all
conditions of this permit.
16. Erosion control measures shall be adequately designed for the site characteristics.
They may include staked haybales, diversion channels, sediment ponds, or sediment
fences. They shall be installed in accordance with "Protecting Water Quality in Urban
Areas - Best Management Practices for Minnesota MPCA, October 1989, prior to
commencement and maintained throughout the project. All exposed soil shall be
stabilized as soon as possible and no later than 72 hours after the completion of the
project. Topsoil should be used to re -dress disturbed soil areas and indigenous plant
species should be used to revegetate disturbed areas whenever possible.
17. Excavated materials shall not be deposited or stored along side the protected water in
a manner where the materials can be redeposited into the protected water by reasonably
expected high water or runoff.
18. A sediment barrier shall be installed around the area of excavation during the project
to limit turbidity to the affected areas. This barrier may involve use of a filter
fabric material attached to stakes or a snow fence anchored to the lakebed. The
barrier shall be removed upon completion of the work, after sediment is settled.
19. All material in, or resulting from, the demolition of the existing structure shall be
completely removed from the floodplain of the river and disposed of in accord with all
local, state, or._federal regulations.
20. Upon completion of the authorized work, the permittee shall submit representative
photographs and any as -built surveys, as appropriate, of the project area to DNR Metro
Region Waters (1200 Warner Road, St. Paul, MN 55106).
21. Where the work authorized by this permit involves the draining, filling or burning of
wetlands not subject to DNR jurisdiction, the permittee shall not initiate any work
under this permit until the permittee has obtained official approval from the
responsible governmental unit as required by the Minnesota Wetlands Conservation Act
of 1991.
