RECEIVING Pl"UNG amiSSION MINIMS OF N170050 9, 19MI: r 9A. _ A= BUILDING:_A 26' BY 40' GARAGE AT4470 RICE CREEK Ujr&�r_ CARL ASPROTH: Mr. Flora, Public Works Director, stated this is a request for a special use permit for the property at 470 Rice Creek Terrace for the construction of a 1,040 square foot accessory building on the property. Mr. Flora stated staff had some concern with the size of the building and there is not a survey identifying the square footage already built on the property. He stated another concern was the construction of a tunnel. He stated the petitioner indicated the tunnel was necessary as it would connect the house to the basement of the new garage and the owner's son, who is in the taxidermy business, would be moving display cases presently in the basement of the house to the basement of the new garage for storage. Mr. Flora stated the Planning Commission had a problem with a home occupation in an accessory building, as this is not allowed under the code. Mr. Flora stated there were a number of residents at the Planning Commission meeting who were opposed to this request for a special use permit. Mr. Flora stated the Planning Commission recommended denial of this request as it was their feeling the Commission cannot legally grant the request because of the intended use of a second accessory building and the proposed building is not compatible with the neighborhood. Mr. Flora stated the convenants placed on this property, as well as others in the area, didn't allow for a second unattached garage on the homes. 4. 5. 6. " May Nee stated this ordinance has the effect of committing resources from the le of unclaimed property from the Police Pension Fund to the General Fund. Mr. , City Clerk, stated this issue was raised by a patrolman who is not in a Police pension. He stated the end result is whether the money from the le of unclaimed property goes into the General Fund or Police Pension d and the only one who benefits from the proceeds funding the Police pe ion is the city, as it reduces the amount the City must contribute fund the pension. He further stated the amount paid to an officer out the pension is established by statute and is not affected by the sources o funding. MOTION by Counci Hamernik to waive the reading of the ordinance and approve it'upon f rst reading. Seconded by Councilman Fitzpatrick. Upon a voice vote, all ting aye, Mayor Nee declared the motion carried unanimously. Mr. Herrick, City Attorne , stated, previously, it had been to the advantage of the City,in me cases, to prosecute under an ordinance rather than a State statute cause the way the fines were split. He stated there have been some ch es made so that is no longer the case and the police now charge all violati ns under State statutes that would be applicable to this ordinance. MOTION by Councilman Fitzpatrick to wave the reading of the ordinance and approve it upon first reading. Second by Councilman Schneider. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously. E FRIDLEY CITY CODE ENTITLED "PENALTI"ENDING SECTION 901.01 ENTITLED "GENERAL PROVISIONS"• Mr. Qureshi, City Manager, stated fines have been inb eased and this will bring the City's ordinance into compliance with the State statutes. MOTION by Councilman Schneider to waive the reading of the ordinance and approve it upon first reading. Seconded by Councilman Fitzpatrick. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously. 9B. Councilman Hamernik asked if the petitioner had brought in a survey of the lot. Mr. Flora stated staff has not received any further information from the petitioner. 7he petitioner, Mr. Asproth, was not present at this meeting. Councilman Hamernik stated he was contacted by Mrs. Elaine Knoff, 6776 7th Street, who wished to go on record as being opposed to this special use permit. MOTION by Councilman Hamernik to concur with the recommendation of the Planning Commission and deny this request for a special use permit, SP #83-11. Seconded by Councilman Fitzpatrick. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously. Mrs. Marlene Knight, 513 Rice Creek Terrace, reviewed some of the covenants placed on her property, as well as others in this area. She stated she felt the Council should be aware that they exist when considering permits or special uses for this particular area. Mr. Herrick, City Attorney, stated the owner of the lot is required to abide by the covenants, but if there is a violation, it is not the City's responsibility to enforce the covenants. He stated this has to be done by the surrounding property owners or the persons who benefit from the covenants. Councilman Hamernik asked what the petitioner's choices would be if he should decide to pursue this further. Mr. Flora stated this particular request to construct the garage has been denied, but he could submit another alternate proposal if he so desires. He stated if it requires any special permits or variances, the process would have to be completed through the various commissions. Mr. Flora, Public Works Director, stated th' is a request for a variance to reduce the required rear yard setbac rom 25 feet to 15 feet to allow the construction of a cover for a 1 Ing dock. Mr. Flora stated there has been a problem with the loadi dock at this location because of ice build-up on the truck ramp wh° almost makes the loading dock unuseable. Mr. Flora stated, in o er to correct this situation, the owner is proposing to constru a cover over the ramp. Mr. Flora stat the Appeals Commission recommended approval of this variance wi the stipulation there be no outside storage after constructi the petitioner review the existing landscaping and add some if nece ary; and that the east wall of the enclosure be constructed to a one- r fire rating since it is closer than 20 feet to the lot line. MOTION by Councilman Hamernik to concur with the recommendation of the Appeals Commission and grant this variance request to reduce the rear yard setback from the required 25 feet to 15 feet to allow construction of 9B-2. 9C. a cover f r the loading dock at 7895 Rancher's Road, with the following. stipulate ns: (1) There be no outside storage after construction; (2) That the petite ner review the existing landscaping and add some additional landscapi if necessary; and (3) That the east wall of the enclosure be constructed to a one-hour fire rating since it is closer than 20 feet to the lot line Seconded by Councilman Barnette. Mr. Flora, Public rks Director, stated there is a free standing sign located on this propkrty and the code only authorizes 80 square feet. He stated the sign pos which is located in front of the barber shop was noted to be in need of intenance and the owner was so informed. The sign was originally erected i 1970, under the existing code, and the routine maintenance done did not fect its status as a legal nonconforming sign. Ube present sign "Don's Bar!Tr and Beauty Salon" was erected on June 1, 1977 and sometime after that te, and for about two years prior to this period, the structure remaine vacant and resulted in the structure losing its legal nonconforming status. Mr. Flora stated the sign has no%no en repaired and an additional 4 x 6 foot sign was added in additiothe original 3 x 5 foot sign which increased the square footage froto 120 square feet. Mr. Flora stated the Appeals Commission felt the two signs were quite similar and the smaller 3 x 5 foot sign should be eliminated. If this was done, the variance would be to increase a signage from 80 square f eet to 105 square feet. MOTION by Councilman Schneider to concurwi h the recommendation of the Appeals Commission to increase the square foo ge of a free standing sign from 80 to 105 square feet with the understandlpg the smaller 3 x 5 foot barber shop sign will be removed. Seconded by Cbuncilman Hamernik. Upon a voice vote, all voting aye, Mayor Nee decla d the motion carried unanimously. MOTION by Councilman Schneider to concur with the recommen ation of the Parks and Recreation Commission to enter into an agreeme t with the Northeast Chamber Orchestra for an upper limit of five concerts te City for 1984 at $150 per concert and with the Fridley City Bar six concerts in the park with an upper limit of nine total concerts in the City at $150 a concert. F1ora,rPublic Works Director DATE: November 10, 1987 S U BJ ECT: Rice Creek Improvement Projects As you may recall, the City supported the Rice Creek Watershed District proposal to implement a program to fund self-help erosion and bank stabilization projects commencing FY 1988. To date, we have not been officially notified that the program will be funded or implemented by the District next year. The Rice Creek Watershed District Board of Managers have informed one resident, David Harris, that he is to obtain City Council support for an improvement project to remove sedimentation along his property on Rice Creek. The original plan was for the District to advertise the program and to establish a period for cities to receive submissions, establish a priority and transmit them to the District for consideration and funding establishment. It was also understood that the City need not be a partner for the funding of the submitted projects. Mr. Harris has requested the City to approve his project and submit it to the Rice Creek Watershed District for funding. If the Council desires, we can place this on the November 23 Agenda to formally receive the petition and transmit it to the Rice Creek Watershed District for consideration and any specific guidance regarding our funding participation. It is understood that a permit would be required and in this process, the City would then be knowledgable of what is to be accomplished and its effect on other properties of creek residents. Fridley, Minn. 55432 ATTENTION: Mayor and Members of City Council Gentlemen: During this past summer I had the opportunity to present to the Board of Managers of the Rice Creek Watershed District, information regarding the problems that are occurring on my property at 470 Rice Creek Blvd. At this meeting I was requested to describe to the Board of Managers the effects of the excessive material that has been deposited on our shoreline along with pictures to graphically explain this ever damaging problem. At that time I inquired of the Board of Managers if they had a policy regarding work to be done on the creek that would help alleviate these types of problems. They advised me they would take this matter under consideration and correspond with me after some additional studies had been completed. They have now contacted me and indicated they have set up a policy wherein the cities would make an application to the Rice Creek Watershed District for maintenance -type repairs and the interested parties could participate in rectifying these conditions. Within the past 30 days I have had John Flora from the City over to review the problem. As I am sure he will relate to you, my property has grown an additional 25' wider as the creek has continued to erode the banks on the south side at this location. What this had done is threefold:. moved the creek further away from me, it is a collection spot for all of the debris that is coming down the creek and even more importantly, will continue to erode the banks of my neighbors across the creek. IW.M This letter is my formal request that a project be initiated to remove this material from my property and be placed across the creek to help stabilize the creek in those areas that so desperately need it. This would minimize the cost as there would not need to be any material hauled away but virtually moved from one bank to the other.
