Gentlemen:
On June 25, 1965, we put down one soil test boring to aid in evaluating soil
conditions for the rebuilding of the Dr. Erkel residence at 567 Rice Creek Ter-
race in Fridley, Minnesota.
The boring was put down at the location suggested by you and is shown on the
attached sketch. The surface elevation was referenced to the first floor level
of the existing house where shown, taken as 100.0' (an assumed elevation). The
log of the boring, and a chart showing the method of soil classification (U. S.
Bureau of Soils) are attached. The soil was visually classified in accordance
with the above method.
The boring was put down by hand, and was cleaned and advanced with a 4 inch
auger. Soil samples were taken with a 2 inch 0. D. split sampler, and the blows
per foot (B P F) as given along the right side of the logs were recorded on
this sampler driven by a 140 lb. weight falling 30 inches. The consistency of
the cohesive soil was rated by the penetration of the sampler.
It may be seen from the log of the boring that fill was found to a depth of 212'
ft. Granular soils were found from Zit to 61 and a rather stiff clay was
found from 6 ft. to the depth of the boring.
Ground water entered the boring and the level and times of recording are given
on the log. This level can be expected to vary with the seasons of the year
and from one year to the next.
We understand that the house was damaged by the recent tornado. The house will
be rebuilt and the west wall will be moved 4 ft. out from the existing founda-
tion. The new footing will be about 4 ft. below grade. The granular soils

found below 31 ft. would be capable of supporting a normal footing without

Creek normally borders his house_ on three sides. But last week,' he was sur
rounded briefly as the stream flooded its banks and cut his drive ;way off from the

The Department of Natural Resources has reviewed your application for a
permit to place sand and rocks along Rice Creek and to excavate one foot
of material from the bed of Rice Creek, Anoka County, at your property
located in Section 11, Township 30N, Range 24W.
It has been determined that your application as proposed must be denied.
It is the policy of the Department to discourage the excavation of
materials from the beds of public waters, in order to preserve the
natural character of public waters and their shorelands, and maintain
suitable aquatic habitat for fish and wildlife. Bank stabilization
alternatives with minimum environmental impacts would include the place-
ment of sand and riprap. These projects will not require permits.if
constructed within the following restrictions:
A. Beach sand blankets
1. clean, inorganic sand and/or gravel free of pollutants
and nutrients
2. no more than: 6 inches thick, 50 feet wide along the
shore, 10 feet waterward of the ordinary high water
mark
3. site is not a posted fish spawning area
B. Riprap

A permit shall be required for any other beach sand blanket or riprap shore
protection. Before initiating any project, contact Ron Harnack, Regional
Hydrologist, phone 296-7523.
Minnesota Statutes, Chapter 105.45, states in part as follows: "In all
permit applications, the applicant has the burden of proving that the
proposed project is reasonable, practical, and will adequately protect
public safety and promote the public welfare." Our last record of corres-
pondence is a March 23, 1978 letter to you from Sarah P. Tufford. She
asked you to advise us of your intentions, but we have not heard from you.
In view of our observations, we cannot conclude that your proposal is
indeed reasonable, practical and will promote the public welfare. There-
fore, the proposal presented in the application is in all respects denied.
You are advised of your right to demand a hearing. This demand must be
received within thirty (30) days of the receipt of this Order and must be
accompanied with a bond or equivalent security in the amount of $750.00.

MISSISSIPPI RIVER
The elevation of the top of the flood control dike on the Mississippi River West of
Riverview Terrace near 79th Way is 824 feet above sea level. The top of the. road where
the 6p" CMP culvert goes under 79th Way between Broad and Riverview Terrace has
an el vation of ± 818. Therefore the culvert will have to be sandbagged and.pumped,
and toe road built up 6 feet'to keep water from flooding the homes in the surrounding
area. j.
In order to build a dike across 79th Way, 675 C.Y. of fill would be necessary. The dike
wouldbe 100 feet long, 6 feet high and 40 feet wide at the bottom and 20 feet wide at
the tp. It would protect the 67 homes listed on page 2.
RICEICREEK
The homes at 470, 480, 490, 567 and 57 .Rice Creek. Blvd, 6801 Channel Rd, and the
home at 580 69th Ave NE seem to be built higher than the 100 year storm line, but their
lots tll have extensive flooding from the high water. See attached summation sheet
and ap.
52ND AVE NE
The spring thaw could also affect the homes at 1280, 1298 and 1300 52nd Ave NE.
These properties flood from extensive storm runoff and are potential candidates again
this spring.

Dear Mr. Deblon:
Based upon my conversations with you, I understand that the City will be
hearing testimony regarding a proposed expansion of the Erkel residence
and plans to construct a new garage within the CRP -2 Zoning District. It
is my understanding that the structure is non -conforming and the expansion
proposed is converting an existing attached garage into liveable space.
The new garage may be allowed under your ordinance provided that it is
elevated on .fill or flood -proofed in accordance with the State Building
Code to the Regulatory Flood Protection Elevation (RFPE). From a flood
plain standpoint, the existing attached garage may be expanded only if it
can be protected to the RFPE, and does not increase the non -conformity of
the structure (the City may have other specific concerns regarding the ex-
pansion of a non -conforming structure). Since it seems unlikely that the
existing attached garage could be elevated on fill, flood -proofing in
accordance with the State Building Code is the only other apparent option
available. The City's ordinance, state regulation, and federal regulation
prohibit the.granting of a variance to allow for a lesser degree of flood
protection than the RFPE. Should the City grant such a variance, the re-
sponsible course of action for this Department would be to pursue legal
action against the City for non -enforcement of their ordinance, and recom-
mendation to the federal government that the City be suspended from the
National Flood Insurance Program.
I outlined the above information to help provide guidance to the City and
the applicant. The flood plain management act was adopted to reduce flood
damage potential among other things. Allowing a use expansion unprotected
is contrary to this goal.

Ms. Vivian Hoese was present for this matter. Mr. Hill presented the Commission
with plans of the proposed addition. 14s. litiese said they would probably put the
airconditioning unit on the roof of the building. Ms. Gabel asked if there would
be a loss of parking and Ms . Hoese said there would not be and Mr. Hill stated
they would still be within the code but they are asking the petitioner to replace
the temporary bumper blocks with poured concrete. The additional landscaping
suggested in the Staff Report was questioned and Mr. Hill noted thattthe landscaping
appeared adequate.. Ms. Hoese stated that the patient and employee parking will be
separated and there will be no problems with entrances and exits. Mr. Hill said
that Items 3 and 4 on the Staff Report, regarding parking, may not be feasible
for this situation. Ms. Gabel noted that all they are doing is just extending what
they have done previously and she could not see any problems. Mr. Barna said his
only question he had was visibility in the parking lot and he drove through the
area and found no problems.

A. PUBLIC PURPOSE SERVED BY REQUIREMENT:
Section 205.113, 4 (b) requires a minimum of 15 feet for a side yard setback.
Public purpose served by this requirement is to provide adequate open space
around commercial structures for aesthetic and fire fighting purposes.
B. STATED HARDSHIP:
"Existing sideyard setback is 13 feet. New addition would be built even
with existing building. Additional space is needed for offices, orthopaedic
coverage and physical therapy."
C. ADMINISTRATIVE STAFF REVIEW:
This request is to vary a side yard setback in a CR -1 District from the
required 15 feet to 13 feet, to enable construction of a 68 foot by 48 foot
(3,264 square feet) addition to an existing structure. This addition will
be used for additional office space and patient treatment rooms. On September
13, 1976, two variances were approved by the City Council: a front yard
parking setback from 20 feet to 0 feet and a rear yard building setback
from 25 feet to 13 feet. However, this request should have been to vary
a side yard parking setback from 5 feet to 0 feet and another side yard
building setback from 15 feet to 13 feet. The actual variances would
vary less than the request and since there was no opposition to the variance
or construction, the request was not changed.
If this variance is approved, the Appeals Commission may want to'consider
the following:

1. upgrade temporary concrete curbing to permanent 6 inch poured
concrete.
2. plant additional landscape/screen along Osborne Road and Madison
Street.
3. parking aisles are not 25 feet, but 20 feet
4. parking stalls are not 10 feet by 20 feet, but 10 feet by 15 feet.
Items 3 and 4 may not be feaisble to complete, except to the south of the
building.
MOTION by Mr. Betzold, seconded by Mr. Barna, to close the public hearing. UPON A
VOICE VOTE, ALL VOTING AYE, CHAIRPERSON GABEL DECLARED THE PUBLIC HEARING CLOSED
AT 8:17 P.M.
Mr. Barna said that this does provide open space around the structure for aesthetic
and fire fighting purposes; it is still accessible and the addition will not change
anything. Mr. Plemel stated he had no objection to this addition.
MOTION by Mr. Barna, seconded by Mrs. Gerou, that the Appeals Commission recommend
to tie City Council, through the Planning Commission, approval of the variance request
to reduce the required side yard setback from 15 feet to 13 feet, to allow the
construction of an addition of approximately 3,000 square feet, to be used for
additional office and medical space, located on the north 400 feet of the west 217.8
feet of Outlot 1, Melody Manor 4th Addition, the same being 7675 -Madison Street N.E.,
Fridley, Minnesota, 55432, with the stipulation that the petitioner upgrade the
temporary concrete curbing to permanent 6 inch poured concrete. UPON A VOICE VOTE,
ALL VOTING AYE, CHAIRPERSON GABEL DECLARED THE MOTION CARRIED UNANIMOUSLY.
3. OTHER BUSINESS:
Ms. Gabel said she has spoken to Mr. Deblon and apparently he had a variance request
that he thought was withdrawn and the petitioner thought it was on the agenda and
further stated they could discuss this matter but the Commission could take no
action on it as there had been no public notices sent out, etc. Mr. Hill explained
that Mr. Les Gerdin was purchasing a home from Blanche Erkel and they made a re-
quest sometime in the middle of January to vary the code regarding the flood plain.
Apparently, Mr. Gerdin was planning to convert the present garage into living
quarters and to construct a new garage in front of the present garage. He stated
that the City ordinance, the Department of Natural Resources and the federal govern-
ment does not allow any building to exist below the flood elevation. He also stated
that this situation might require a special use permit rather than a variance and
to go through the Planning Commission on March 16th. Ms. Gabel said the City staff
is doing some research on this now as this is a non -conforming use. Mr. Hill
suggested the petitioner to give some consideration to constructing vertical rather
than horizontal; that by building up, they would be outside the flood elevation.
Mr. Hill thought it best that the parties involved get together with the Staff
to discuss this situation. Mrs. Erkel said she has talked to the neighbors and
they have no objections. Ms. Gabel said she could'tiot see any problems either except
for the flood plain restrictions.

Mr. Hill said that any construction done would have to go before the DNR and Rice
Creek Watershed for approval. Mrs. Erkel said she bought the house in 1964 and
as far as she knew, there have been no problems with flooding for 82 years.
Mr. Hill stated that as of January 1, 1983, the State has required the City to
file with Anoka County any variances, special use permits and lot splits and they
will become part of the deed.

On February 16, 1983, I met with Blanche Erkel, owner of the above property,
Leslie Gerdin, the intended buyer and Jack Young, the realtor handling the
transaction. In order to complete the transaction, Mr. Gerdin wished to
expand the residence by converting the existing garage into livable area and
constructing a new 27 foot by 30 foot garage.
In reviewing this request, it was determined that the house was within the
CRP -2 zone and any construction was regulated by ordinance number 728 (see
memo dated 2-17-83 from the City attorney). The City also received
correspondence from the Minnesota Department of Natural Resources regarding
this matter. (see letter dated 2-15-83 from the MnD M
I gave this information to the parties and the suggested vertical construction
as an alternative that would require only a special use permit from the City
Council and review by the MnENR and Rice Creek Watershed District.
The parties said they would review the information and get back to me as 'to
the course of action that would be taken. Mrs. Erkel mentioned that she would
ask her son-in-law, Gerry Sikorski, for any assistance he might be able to
give regarding this matter.
On February 25, 1983, I contacted Les Gerdin. He stated that because of the
cost involved to be in compliance with the local, state and federal
regulations, he was not pursuing the matter further. He gave consideration to
vertical construction, but because of the amenities and aesthetics of the
building and terrain, felt it was not feasible. I attempted to contact Mrs.
Erkel, but she was not at home.

You have advised me that the Erkel residence is located in a
CRP -2 District and its elevation is below the flood plain.
You have also informed me that Ms. Erkel is seeking City
approval to use the existing garage as a living space and to
build a new garage.
Assuming that the home complied with all zoning and building
requirements at the time of its initial construction, it now
constitutes a non -conforming use since it is below the flood
plain.
As a general rule, a non -conforming use may expand providing
that the expansion and its use conforms with all ordinances.
Ordinance No. 728 states that the City must issue a special
use permit for a residence in a CRP -2 District unless the
City can show that the proposed use is in violation with
Section 205.1574(2)(A)(2), Section 205.1574(4) or
Section 205.1575. Consequently, it would appear that if the
owners wished to make a vertical addition to their home,
they could, providing that this addition does not violate
the above Sections and conforms with the balance of the
Zoning and Building Code.
If the owners make a vertical addition, the City should pay
particular attention to Section 205.1574(4)(C). If it can
be established that a vertical addition increases the danger
to the home's residents in the case of flooding, then of
course the special use permit should not be issued.
The question of whether the existing garage can be converted
into a dwelling area is more difficult to answer.
Normally, a non -conforming use can utilize all existing
space and may alter their use providing that the intensity
of the use does not significantly change. As an example, if
the non -conformity in the present case was that of set -backs
instead, then there is no doubt that the current garage

could be converted to living space providing that all other
ordinances were complied with. However, our present concern
Js with flooding. It could be argued that by expanding the
^living area of the home, more people will be able to live in
the home with the result that more people are exposed to the
danger of flooding. It would be my opinion, however, that
the.homeowner is probably entitled to convert the garage
into a living area, provided that the proposed addition
meets all of the requirements other than that the dwelling
is located within a flood plain.
The next issue that is then raised is whether the owner may
construct a new garage if he converts the existing one into
a living area. The only fashion in which such a garage
could be constructed would be if it complies with Ordinance
No. 728. Constructing a new garage constitutes the expansion
or enlargement of a non -conforming use. Such activity is
prohibited by Section 205.1578(1) unless the new structure
is flood -proofed.
You also asked whether the City could grant a variance.
Section 205.1577(5) provides that a variance may be granted
only if the enforcement of the Ordinance would result in an
undue hardship. It is up to the City to determine whether
such a hardship exists.
In summary, it is the opinion of this office that a vertical

Dear Mr. Savage:
This letter is being written in response to your inquiry regarding the
above matter.
You contacted our office on July 22, 1986 asking for information on a
permit application for an air conditioning installation at your home. You
also inquired if Neil Heating & Air Conditioning Company was licensed with
the City of Fridley to do work in the City. You were informed that this
department had not received an application for installation of an air
conditioner at your home, nor had we received a license application from
Neil Heating & Air Conditioning Co.
Mr. Neil Olson, President of Neil Heating & Air Conditioning Co., did apply
for both a heating and gas service license with the City on July 28, 1986.
We received the required Public Liability insurance certificate on
August 21, 1986 and the licenses will go before the City Council on
September 15, 1986. We did not receive a permit application for air
conditioning installation for your address from Neil Heating & Air Conditioning
Company.

SUBJECT: Potential Problems with the 1992 Spring Thaw
When the snow melts this spring, several potential drainage
problems could occur. Additional late snowfalls and the rate of
snow melt will be the deciding factors.
At 573 Rice Creek Terrace the floor elevation of 831.27 is 2.73
feet lower than the 500 year storm line elevation of 834.0 and
approximately one foot higher than the 100 year line.
—� At 567 Rice Creek Terrace the floor elevation of 830.47 is
approximately 17 hundredths above the 100 year storm elevation.

In addition, the homes at 7899 and 7895 Broad Street are behind the
Mississippi River dike, but will have to have the culvert on 79th
sandbagged and pumped in order to keep water from backing up from
the Mississippi River and flooding them.

SANITARY SEWER EJECTION PUMP
SYSTEM INSTALLATION AND MAIN TENANCE
THIS AGREEMENT made and entered into this _=day of o& 1992, between C. Wade
Savage and J. Diane Savage, Husband and Wife, hereinafter referred to as "owners", fee
owners of the below described property; and the City of Fridley, County of Anoka,
Minnesota, hereinafter referred to as "City".
Lot 12, Block 2, Rice Creek Terrace Plat 7 (Except
Southeasterly 200 feet of said Lot 12, excepting from exception
Southwesterly 15 feet and lot 13, Block 2, Rice Creek Terrace
Plat 7 (Except Southeasterly 200 feet of said Lot 13). All
exceptions as measured along Northeasterly line of said Lot 13.
WHEREAS, the residence was assessed the normal sanitary sewer costs and these
assessments were paid.
WHEREAS, any available sewer line does not provide for a normal gravity plumbing service
and the owners request the City to correct the problem.
THEREFORE, the City will install at no expense to the owners a Sanitary Ejection Pump
System under the following conditions:
1. The owners provide the City with permission to enter the property and locate
the most beneficial and economic location ( in the building or on the
property) as determined by the City.
2. The owners provide all restoration and continued maintenance and repair of
the City installed Sanitary Ejection Pump System and shall hold the City
harmless of any liability or damages consequent upon, resulting from, growing

ut of, or in any manner connected with the Sanitary' Ejection Pump
Installation.
3. The owners release the City of any future obligation regarding sewer hookup
for the above property, that owners maintain all facilities out to the City
sewer line and realize there will be no future cost to the City for this facility
and service.
FURTHER, IT IS MUTUALLY AGREED that the provisions of this agreement shall be
binding upon and enforceable against the parties hereto, their successors and assigns and
all subsequent owners of the property herein described. An executed copy of this
agreement shall be filed with Anoka County Recorder's Office and made a part of and be
binding upon the above-described property.

Dear Property Owner:
Effective January 1, 1992, Minnesota Statutes require that most residential building
contractors, remodelers, roofers, and manufactured home installers be licensed by the
state. Specialty contractors who perform only one special skill (e.g. concrete &
masonry, excavation, carpentry, interior finishing) are exempt from state licensing.
Contractors who generate less than $15,000 in gross annual receipts are also exempt
from state licensing, but must obtain a certificate of exemption from the Minnesota
Department of Commerce.
The state license number of a residential building contractor must be placed on all
building permits and permit applications issued by a city or county. A license number
must also appear in a site plan review and all zoning permits. Cities and Counties are
prohibited by state law from issuing permits to unlicensed contractors who are
not exempt from licensing. In addition, it is a misdemeanor to perform
contracting work without a license unless the contractor is exempt from
licensing.
State licensing is intended to ensure a minimum level of competency and to afford
consumer, protection. To accomplish these goals, licensed contractors must pass a
two-part examination relating to the construction trades as well as business
administration and law. Licensed contractors are also required to take seven hours of
approved continuing education each year and provide proof of liability insurance and
workers' compensation insurance (if required by law) as well as business ownership
documents to the state. Also, licensed contractors and remodelers must contribute to
the Contractor's Recovery Fund. This Fund is intended to reimburse homeowners who
obtain judgments of up to $50,000 against licensed contractors and are unable to
collect on their judgments. Homeowners who use unlicensed contractors will forfeit
their rights to access this Fund. Licensed roofers and manufactured home installers do
not participate in the recovery fund, but instead are required to hold a surety bond in the
amount of $5,000 and $2,500 respectively.
Contractors are licensed and regulated by the Minnesota Department Commerce. To
determine the licensing status of a particular contractor, call the Department's Licensing
Division at (612) 296-6319 or 1-800-657-3978. Complaints against licensed contractors
can be directed to the Department of Commerce, Enforcement Division at (612) 296-
2594 or 1-800-657-3602.
The license number of a licensed contractor must appear in all advertising, business
cards, lien notices and statements, contracts and proposals.
