Dear Mr. Gibbs:
This letter isto make clear this department's requirements .for the
swimming pool construction at the above address.
1. As indicated, one (1) skimmer approved by the National Sanitation
Foundation will be provided.
2. As indicated, two (2) inlets of approved design for fresh.and/or
repurified water will be provided.
3. The filter and pump shall be approved by the N.S.F. and be of
sufficient capacity to provide a minimum turnover of at least two (2)
tunes in 24 hours. This department recommends a turnover rate of
6-8 hours.
4. A deck of at least three (3) feet wide, measured from the pool waters
edge, shall be provided which extends completely around all private
residential pools. Above ground private residential pools may be
provided with decking of a minimum size of 4 feet by 4 feet at pool
entry points and provided that such decking has the approval of the
City.
5. Fencing or other effective means including but not limited to walls
or buildings, acceptable to the City , shall be provided to positively
control all access to public and private residential swimming pools.
Fencing shall meet the following criteria:
(a) The fencing shall prevent the entrance of children and be without
hand or foot holds that would enable a person to climb over it.
(b) The fencing shall be at least 6 feet high and entrances shall be
equipped with self-closing and self -latching gates capable of r
being locked.
(_c) Self-closing and self -latching devices shall. be placed at the top
of the gate or otherwise inaccessible to small children.
(d) The opening between the bottom of the fence and the ground or
other surface shall be not more than four inches.
6. An automatic chlorinator should be provided with a suitable test kit.
7. All electrical and plumbing installations shall be inspected and
approved by the City Inspection Department.

8. All electrical lines must be greater than 15 feet away from the pool
surface. An alternative is to bury said lines.
9. The pool fill spout must be protected by a vacuum breaker or air -gapped.
10. Suitable safety equipment to include but not limited to a ring buoy
and rope that is 111 times the pool diameter, and shepherds crook pole
must be provided and maintained with.the pool at all times.
Furthermore, these and any other requirements must meet the provisions of
the Fridley City Code, Section 115, Swimming Pools. The building permit is
approved contingent on final inspections and approval by the City.

We are in receipt of your claim, the sewer backup form you
completed and returned to us and a copy of your letter directed
to Mr. Sidney Inman dated August 17, 1982. �..
Please be advised that after review&ng your clams and`diseussing
it further length with the city sewers superintendent Rusty Silseth
we have found that the cause of the sewer backup at your residence
was directly related to a blockage found near the 68th Avanue man-
hole. The blockage was identified as a chunk of roots that had
been cut out from a home service line in your area. This floated
through the sewer system and block the manhole exit.,
Please be advised that our obligation as an insurer is not to pay
all claims, but to pay only those claims for which our insured is
shown, conclusively,- to be negligent and therefore, responsible.
Our investigation indicates, that our insureds

maintenance
Programs are thorough and that the sewer lines are in-
spected and cleaned on a regular basis.
Under the circumstances, we feel that our insured does take all
reasonable and proper action to maintain the sewer systems in your
area. The city cannot be held responsible for what isflushed

This letter is written in response to your correspondence and telephone conversation of October 29,
1991 regarding minor fill placement adjacent to Rice Creek. It is our understanding that this
project consists of an approximate depth of 6-8 inches of topsoil being placed behind your residence
to eliminate a small depression which collects runoff.
Due to the minor naturg of the work and its distance from the creek (200± feet) we consider the
project to be a landscaping effort for which a Rice Creek Watershed District permit will not be
required. The Watershed District inspector may view the site as part of his general inspection
duties and will advise you directly if any problems are apparent.

I am writing you with reference to a situation in your Ward. I
live at 577 Rice Creek Terrace. Recently we had our street widened
and cement curbing put in. We have not gotten a final billing on
it, but I am advised by Mr. Flora we have obtained a favorable rate
and the price should be somewhere around $800 or $900.00.
This improvement provided for a wider street by one foot on each
side. However, several things have happened that have directly
reflected on any benefit I may receive from this improvement.
First, there apparently is a provision that one side of the street
be designated "no parking," in spite of the fact the street is now
wider than it was prior to the improvement. The side of the street
designated "no parking" is the other side of the street to my
house. Now the City has created a situation where my across -the -
street neighbor must park their cars in front of my house.
Unfortunately for me, they have a van and a large truck, which are
on a consistent basis parked in front of my house.
I have no complaint about my neighbors personally, they are good
people, but they are locked on the horns of a dilemma also, in that
they have a large boat and there simply is not room for everything
in their driveway. It seems to me that the City could easily
designate "no parking" on both sides of the street, or allow
parking on both sides of the street, as I understand in spite of
the Federal -regulations or State regulations regarding no parking
there may be ways around it.

In any event, the alleged improvement has resulted in my having
vehicles parked in front of my house on a continuing basis, and as
you I'm sure can see, that is objectionable to me, and I'm sure to
the other neighbors who live on the same side of the street where
parking is allowed.
I propose that this situation be remedied by the City Council in
the manner stated above, or that those who have received the
"benefit" of the improvement with the parking on their side of the
street be given a reduced rate, as most assuredly their benefit is
clearly diminished by the no parking signs. As a matter of fact,
there is probably no benefit to them at all.

READ BEFORE SIGNING APPLICATION
1. . A surety bond or certified check. in the amount'of $ := = ==r= = (S% of value of work to be
completed) must be submitted after approval of applicatioq and prior to any work commencing. 'INS
bond or check is to� erisn a -satisfactory- performance -and compliance with the below stated
stipulations. The surety bond or check shall be kept active until the completion of work and/or
expiration of permit and can only be released by written notification of the City after a satisfactory
final inspection has been performed by the City.
2. All access and street frontage of the land alteration site must be controlled by a fence, a minimum
of four (4) feet in height. All entrances must have gates that are capable of being locked.
3. Only rock, sand, gravel, dirt, or similar natural earth fill is permitted. No concrete, asphalt, or
demolition wastes will be permitted as fill unless a demolition landfill permit is first obtained from
Anoka County.
4. Operations shall be limited to daylight hours and shall not interfere with the health and safety of
surrounding residents and the premises shall be maintained at all times so as not to create a
nuisance.

5. Any explosives used must be done so in accordance with Chapter 212, subsections 212.07.5A, .SQ,
.SC, .SD, and .SF. of the Fridley City Code and any other applicable standards, e.g. Federal, State,
Industrial, etc.
6. At the end of each season's operations and no later than the last day of December each year, the
site is to be left in a neat and orderly condition, with maximum slopes of 2:1 with no overhang or
vertical banks and with a level bottom.
7. On the Friday of each work week, or when required by the City, material from this operation that
is found to exist on City streets shall be cleaned to the City's satisfaction by the applicant
8. Upon completion of land alteration operations, the land must be left according to the plans and
contours submitted with this application and planted with suitable vegetation to prevent erosion.
9. Upon completion of land alteration operations or expiration of this permit, an inspection will be
made by the City of the premises and adjoining streets. Any damage found to have been caused by
these operations will be corrected by the applicant upon notification by the City.

As a result of the public hearing on the Rice Creek Bank Stabilization project, Bruce Lester of 577 Rice
Creek Terrace objected to the increased cost for the bank stabilization resulting from an increase in bank
work from 40 to 100 feet.
Staff contacted Mr. Lester after the meeting regarding the assessment, where upon he agreed to pay $1,000
based upon the original figures provided for the project.
The City contacted Park Construction. Park Construction met with Mr. Lester and as a result of that
meeting, I understand that Mr. Lester has agreed to pay the full assessment. As a result of this decision,
there is no further issues associated with the Lester assessment.
