Per Section 205.07.03.D.(1) of the Fridley Zoning Code, to reduce the front yard
setback from 35 feet to 23 feet to allow the construction of a covered deck and
stairs on Lot 9, Block 2, Rice Creek Terrace Plat #7, generally located at 581
Rice Creek Terrace.
MOTION by Dr. Vos, seconded by Ms. Beaulieu, to open the public hearing.

THE MOTION CARRIED AND THE PUBLIC HEARING OPEN AT 7:32 P.M.
Mr. Bolin stated the petitioner is requesting a decrease in the front yard setback from 35
feet to 26 feet to allow the construction of a covered porch and stairway. Originally, the
petitioner was requesting a variance to decrease the setback to 23 feet. After reviewing
some other options for the stairs, the petitioner decided that a setback of 26 feet would
meet his needs. The code requires a minimum front yard setback of 35 feet. The
property is zoned R-1, Single Family, as are the surrounding properties..

Mr. Bolin stated that in the hardship statement, the petitioner states that the addition of
the porch will prevent water build-up during heavy rains which accumulates along the-
foundation
he ,foundation and has caused damage to the lower level, will enhance the time the family
spends in the front yard, and will increase the beauty and function of their home. The
petitioner is replacing the roof and this is a good time to complete this project.
Mr. Bolin showed a picture of the front of the home and the location of the proposed
porch. The porch would extend from the front door to the west side of the home, would
extend 8 feet from the front of the home, and would be 25 feet in length. The stairs
would add an extra foot onto the southeast comer of the porch.- The .porch itself will be
at the 27 -foot setback. The one foot for the steps brings the setback to 26 feet.
Mr. Bolin stated staff has no recommendation regarding this request because it is within
previously granted variances. If the Appeals Commission chooses to recommend
approval, staff recommends the following stipulation:
1. Property owner shall obtain building permits prior to construction.
Dr. Vos asked if this is an open porch.
Mr. Bolin stated, yes, the porch will be open with a roof.
Mr. Kuechle stated there has been discussion about changing the setback requirement.
He asked if there are any guidelines from those discussions yet and if this request fit
into those guidelines.
Mr. Bolin stated this request would most likely fit within the guidelines discussed so far.
Staff has been looking at what other cities are doing. Some cities have just reduced the
front yard setbacks to 25 feet across the board. Other cities, such as Roseville, use a
setback permit issued administratively. In Roseville, the petitioners meet with city staff.
The staff then looks at the property, talks with adjoining landowners, and works out a
compromise with the petitioners. He stated staff hopes to have something for Planning
Commission in September.
Mr. Kuechle asked if there is a different rule for enclosed porches versus open porches.
Mr. Bolin stated the reason for a variance is because they would be one and the same.
There is a caveat in the code that allows open porches and small entryways to
encroach closer than the 35 -foot setback. To go beyond that, one must have a
variance. If the 26 -foot setback is acceptable, they would want it be acceptable for a
covered porch or a fully enclosed porch. If, in the future, the petitioner wishes to
enclose the porch, the variance will have given permission for that.
Mr. Thompson stated the presentation indicated the porch was 8 feet x 12 feet. The
porch measures 8 feet x 25 feet. He spoke with staff several times and talked about
alternatives for the steps. They have reduced the setback needed by changing the

steps. The stairs will be at an angle in the southeast comer of the deck. By doing so,
they can save an existing tree. The steps would still be partially under the overhang.
They are not sure if the steps would be concrete or wood. They will need to work that
out with the contractor. Other than that, he had no additional comments.
Dr. Vos asked if the petitioner had heard any comments from his neighbors.
Mr. Thompson stated that other than some teasing from his neighbors, he has had no
comments.
Dr. Vos stated the house to the east, 585 Rice Creek Terrace, appears to be set back
further than the 35 feet. Is that neighbor concerned about an impact to the site lines?
Mr. Thompson stated, no. The street is curved so it seems to project out a little more.
MOTION by Ms. Mau, seconded by Ms. Beaulieu, to close the public hearing.

THE MOTION CARRIED AND THE PUBLIC HEARING CLOSED AT 7:44 P.M.
Dr. Vos stated the request seems to be similar to past requests. Staff reported this is
the third or fourth such request. The hardship seems to be the same case, which is
water runoff and a little bit of encroachment. He would vote in favor of the request.
Mr. Jones stated the survey shows the house is 37.5 feet back. It looks as though, if
the porch extends a total of nine feet, it will really encroach 6 feet into the setback.
Mr. Kuechle stated the setback at the one comer in 37.5 feet. However, in the middle of
the arc for the street, the measurement is probably 35 feet.
Ms. Mau stated thatif the porch will eliminate the problems with water and is within
previously granted variances, she would vote in favor of the request.
Ms. Beaulieu agreed. This is essentially the same as previous requests and those were
approved. She would vote in favor of approval.

HARDSHIP STATEMENT
"I wish to add this addition to our home for the following reasons:
• Adding a porch with a roof will prevent water buildup during heavy rains that have
created water accumulation along the foundation of the house and damage to the
carpeting and walls of the lower family room. The roof will divert water away from
the foundation and prevent this problem in the future.
• Our family spends many hour during summer evenings, sitting in the front yard
conversing with neighbors. To enhance our comfort and the "Friendly Fridley"
image, a front porch will increase the beauty and function of our home.
• We are replacing our roof due to last years hail storm. Now is the perfect time to
complete this project."

ANALYSIS
Section 205.07.03.D.(1) requires a minimum front yard setback of 35'. The petitioners
are seeking to decrease the required front yard setback from 35' to 23' to allow the
construction of covered deck / porch and stairs.
The proposed deck / porch would extend 8' out from the front of the home and would
run for a length of 25' along the front of the home. The covered deck / porch would
reduce the front yard setback to 27. The drawings submitted by the petitioner indicate
that 4' stairs would be located on the front of the porch, further reducing the front yard
setback to 23'.
In a telephone conversation with the petitioner, staff discussed the possibility of the
petitioner locating the stairs on the east side of the porch, thus decreasing the
encroachment into the front yard. There are alternatives for the stairs, that would
eliminate the need to reduce the front yard setback down to 23. A reduction down to
27' would be more comparable to recent variances granted for similar uses.

This petitioner is not alone in his desire to have a front porch to promote
"neighborliness". Whether it's a desire to return to days past or escape from the basic
split level and rambler homes that have dominated suburban America, front porches
and sidewalks have again become popular. Staff recently had an opportunity to tour
new developments in Lake Elmo and Stillwater that were designed with these features.

I understand you are having a public hearing on a front yard variance request from 35 to 12 feet at 581 Rice Creek Terrace
for a covered deck and stairs.
This is a 12 -foot intrusion into the front yard which I believe is a considerable impact to the remaining homes on the street.
If the request is for a covered deck, I believe there should be a stipulation that screens and windows may not be installed
to ensure the appearance of a front porch in lieu of a usable living space.
