Wazwaz 6130 Benjamin Street NE Fridley, MN 55432 RE: Fence Encroachment Dear Rashid: The City of Fridley was informed yesterday of a fence installation that may be encroaching into the City's right-of-way and easement adjacent to your property. This morning I met with an occupant of your property whose name was Ghasan, and explained to him that the fence is indeed encroaching into the Benjamin Street right-of-way. Chapter 407 of Fridley City Code prohibits installations in the City's rights-of-way without permission. The fenceposts within the Benjamin Street right-of-way need to be removed immediately. In addition,the City of Fridley has an easement on the south side of your property that is 15' wide. I provided Ghasan with a copy of the recorded easement. The City of Fridley does not require a permit for fence installation,however,a permit is required to install within the City's rights-of-way or easements. I advised Ghasan that we would not permit an encroachment of the fence within its right-of-way or easement adjacent to your property. If the fence is installed upon the City right-of-way or easement,the City of Fridley will require its relocation at your expense. I advised Ghasan that a survey of the easement and right-of-way location may be in your best interest prior to completing installation of the fence to avoid the potential for encroachment and subsequent relocation. I advised Ghasan that he could find land surveyors in the yellow pages or interne that would be able to perform this service for you.
