Mr. Hickok stated that the Planning Commission reviewed nd approved the special use permit,
and it will now go to the City Council for approval.
2. PUBLIC HEARING: VARIANCE REQUEST VAR #02-15. BY BENNY & JULIE
STREITZ:
Per Section 205.07.03.D.(2).()b) of the Fridley Zoning Code, to reduce the required side
yard setback for an attached accessory structure form 5 feet to 3.86 feet to recognize an
existing non -conformity on Lot 6, Block 3, Brookview Terrace 2nd Addition, generally
located at 990 Rice Creek Terrace NE.
MOTION by Mr. Jones, seconded by Ms. Jackson, to open the public hearing and waive the
reading.
UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON KUECHLE DECLARED THE
MOTION CARRIED AND THE PUBLIC HEARING WAS OPENED AT 7:44 P.M.
Ms. Hanson stated that this variance is to recognize the non -conformity of the attached garage.
Code requires a side yard setback of 5 feet between an attached accessory building and a side
property. The property is zoned R-1 as are all surrounding properties. The existing home was
built in 1960 with the attached garage built in 1963. The garage side is 3.86 feet away from the
property line. The hardship states: We are requesting a variance to recognize the existing
outside wall of the attached garage. The garage wall is 3.86 feet from the property line which is
less than the current amount allowed and we are requesting this variance now because we are
planning future construction off the back of the house."

Ms. Hanson stated staff has no recommendation as this request is within previously granted
dimensions. A similar variance, VAR #01-11, was granted at 5733 West Moore Lake Drive to
reduce the side yard setback of a structure from 5 feet to 3 feet to allow the construction of an
accessory structure.
Mr. Kuechle asked that if the petitioners were to extend that garage further, would they have to
request another variance?
Mr. Hickok stated that the variance would be for what currently exists, any modification to
expand the garage would require a variance. They are asking for this variance with the idea
that if they construct an addition on their home, that addition would be conforming if this
variance is granted.
Dr. Vos stated that if they want to add living area off the back of the garage, that would be a
different setback.
Mr. Hickok stated that is correct; living area needs to be 10 feet from the side lot line. They will
come in at a later date to ask for a permit for an addition on their house once it is conforming.
The petitioner, Julie Streitz, stated that their addition will not even involve the garage. It just
recognizes the garage's setback so they can move forward.
Mr. Kuechle asked how they became aware of the fact that it was 3.86 feet instead of 5 feet.
Ms. Streitz stated that they had the property surveyed a few years ago when they built a shed.
MOTION by Mr. Zinter, seconded by Mr. Jones to close the public hearing.
UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON KUECHLE DECLARED THE
MOTION CARRIED AND THE PUBLIC HEARING WAS CLOSED AT 7:50 P.M.
Mr. Zinter stated he does not have a problem with this variance request.
Mr. Jones stated he, too, does not have any issues with it.
Ms. Jackson agreed.
Dr. Vos stated that it was a good idea.
Mr. Jones stated that he commends them for surveying the property before building the shed.
MOTION by Mr. Jones, seconded by Dr. Vos, to approve variance request, VAR #02-15 with the
following stipulations:
1. The petitioner shall obtain all necessary building permits prior to construction of any
additions.
2. Additions shall be architecturally compatible with existing home.

SUMMARY OF HARDSHIP
"We are requesting a variance to recognize the existing outside wall of the attached garage. The

ANALYSIS
The property is located on Rice Creek Terrace. The lot is rectangular in shape, with the home
being "squared up" to and fronting the corner of Rice Creek Terrace and Oakley Street. Oakley
Street provides access to the residence. The existing home was built in 1960 and the attached
garage was built in 1963.
A building permit issued in 1963 for the addition of an attached garage states the side yard
setback as 5'. However, a current survey shows the existing garage side yard setback as 3.86'.
