Rea Refund of Permit Fees
Dear Marvin;
Under date of August 24, 1964, you inquired about the refund
of permit fees where a plumber takes out a permit for a job
and then does not actually get the job, and asks for his permit
fee back.
It is my opinion that he is entitled to a return of the permit
fee. I think that if the office issued some sort of administra-
tive notice that a portion of the fee would ,be retained for
administrative expense that such an administrative notice would
be enforceable.
I do not believe the situation you inquire about is identical
with the criticism the Auditors made of pro -rating a license
fee without specific ordinance provision. The license fee is
for a particular term and is a right or privilege for that term,
whether used or not. The permit for plumbing work is a permit
for doing a specific job, and of course, if someone else does
that specific job and pays a permit fee, the City has no right
to duplicate payment.
