SUMMARY OF ANALYSIS City Staff recommends denial of this variance request due to lack of hardship, but would recommend the following stipulations if approved. • Petitioner shall remove the storage shed from the 5' easement on the south property line and maintain required 3' side and rear yard setbacks for accessory structures. • Any future fencing intended for the petitioner's property shall be placed on the petitioner's property. • Necessary building permits will be obtained prior to construction. • Guard rails will be installed on deck when height above finished grade exceeds 30" • The proposed deck shall not be covered or enclosed in the future. • The proposed retaining wall shall not extend into the easement. • The proposed retaining wall shall not exceed 3' in height. CITY COUNCIL ACTION / 60 DAY DATE City Council — June 13, 2005 60 Day Date — June 20, 2005 Staff Report Prepared by: Rachel Harris VAR -05-06 REQUEST The petitioner, Brent Gabel, is seeking a variance to add a deck to the south side of his home at 40 Rice Creek Way. The property is a comer lot with the narrowest width facing 67th Way. The front door of the home faces Rice Creek Way, creating the appearance that the proposed deck will be in the property's side yard. The proposed deck, however, would be in the property's rear yard. This corner property did receive a variance to the rear yard setback of a minimum of 25' in 1967 when the home was constructed. The home is only inches from meeting the minimum rear yard setback. Proposed Deck Location in Rear Yard As you view the property, it is important to note that the storage shed in the southeast corner of the property is encroaching 4' into the 5' utility easement and is only one foot inside the property line and was built without the benefit of a building permit. Also, the south fence is actually placed a few feet onto the neighbor's property at 58 Rice Creek Way, so it is important to note that the fence line is not the property line. The petitioner is proposing to build a three - section deck that is 17' 3 % "on average in width attached to the south side of the home. SITE DESCRIPTION AND HISTORY The property is zoned R-1, Single Family Residential District. All surrounding properties are also zoned R-1, Single -Family Residential. The subject property is located at the comer of 67t" Way and Rice Creek Way, just southeast of Locke Lake. The home was constructed in 1967. There are no additions on record to the property. Including the square footage of the newly constructed storage shed, there is 15% lot coverage currently on the property. View from corner PROPOSED CONSTRUCTION The petitioner's plans are for construction on a three -section deck, accessible from the home through a new patio door opening in the location of existing windows. One section of the deck, the one at the new patio door opening, will measure 10'-0" by 18'-6". The middle section will measure 8'-0" by 16'-6". The section of the deck closest to the storage shed will be 10'-0" by 10'-3". It should be noted that this section is proposed to be double beam construction, so it is likely the homeowner plans to use this section for a hot tub or other heavy activity or feature. It should also be noted that this section of the deck will lie directly alongside the utility easement and will be only 5 feet from the property line and in close proximity to the living area of the home on an adjacent site. Steps are proposed on the east side of the deck. CODE REQUIREMENTS Section 205.04.6.A(3) of the City Code states that Decks, unenclosed porches, canopies, and steps to building entrances may not extend more than ten (10) feet into the required rear yard setback and not more than three (3) feet into any required side yard, provided they do not extend nearer than five (5) feet to any lot line. The petitioner is requesting to be able to construct a deck that will encroach 17'-3 3/n into the rear yard setback. This is a 7'-3 3/" variance to the required rear yard setback for a deck. HARDSHIP STATEMENT The petitioner's hardship statement reads as follows: Our house faces Rice Creek Way NE. Due to the long, narrow lot, the side of the house that faces 67th Way NE is considered the `front" yard. Therefore, the location of the proposed deck is in the rear yard. Because the location of the proposed deck is considered to be the rear yard, I am requesting a variance. The layout of the residence prohibits access to the rear (actually the side) yard, unless using the front door or attached garage. The entire rear of the home is composed of bedrooms. Therefore, there is no place for a walk -out door. I am a designer by trade and have spent many hours on alternate placement of the deck on a CAD system and there is no other feasible location. The petitioner has obtained signatures from many of the surrounding neighbors indicating that they do not object to the proposal. However, the property directly south of the petitioner's property, which is most affected by the proposal, is currently vacant, so there are no signatures from that property owner. PREVIOUS CASES There have been some similar variances granted in the past for porches and for decks in the side yard. However, staff could only find two previously granted rear yard variances for construction of a deck. In 1999, a rear yard setback variance was granted involving a deck on an interior lot at 6310 7th Street NE. The variance was for encroaching of 17' into the rear yard setback (10' allowed without a variance). This situation was different than the proposal being considered since the deck was still 14' back from the property line. It was also a slightly different situation since it was on an interior — not a corner - lot. No rear adjoining neighbor was affected as the back of the property was a large drainage easement. Another rear yard setback variance was granted in 1994 for reconstruction of a deck at 81 Alden Circle NE. This was another interior lot situation with an odd -shaped interior lot on a cul- de-sac that was only 84' deep. The closed living portion to the adjoining property on the rear was 140' back, so there was little affect to the neighbors to extend the deck an extra 2' into the rear yard setback for a wider stairway on the reconstruction of a previous deck. In summary, staff finds no precedence for the particular situation under consideration. RECOMMENDATIONS City Staff recommends denial of this variance request for the following reasons: • The petitioner could still construct the same square footage of deck to the south and east side of their home if they wrapped the deck around to the east side of the home. • The proposed deck would likely affect the peace of the adjoining neighbor to the south because the living area (likely the bedrooms) of their home is within about 26' of the outermost edge of the proposed deck. • The petitioner has failed to provide a compelling hardship statement. STIPULATIONS City Staff recommends if this variance request is granted that the following stipulations be attached. 1.
