SPECIAL PROVISIONS
VIII. This permit must be recorded in the Register of Deeds office by the property owner and
certification thereof provided to this Department before the permit is valid. At that
time, a notice of permit card will be sent to you. This card must be posted at the .sit(
prior to construction.
IX. All General and Special Provisions of this permit shall bind permittee, his heirs and
assigns and shall run with the land.
X. Permittee shall maintain the authorized wall in a stable and safe condition and shall
repair or replace it at any time that the Co=issioner finds the wall is subject to
instability, creates a navigation hazard, or has become an aesthetic nuisance.
XI. This permit may be terminated by Commissioner's Order for any violation of the purposes
of said permit, or of a general or special, or a notice, or a maintenance provision
thereof, or at any time the Commissioner deems it necessary for the conservation of
the water resources,.or for any cause for the protection of the public interest.
XII. Any Commissioner's Order terminating this permit may also require the permittee, at his
own expense, to remove within_the time specified in said Order, any authorized structur
constructed under this permit and, if applicable, any unauthorized structure in viola-
tion of this permit. Said Order shall also require the permittee to restore, if
necessary, the protected waters or beds thereof to the condition existing before the
unauthorized activity.

At their meeting on October 26, 1983 , the Board of Managers of -the
Rice Creek Watershed District reviewed your nermit application and the rec
ommendation of the District Engineer together with the following exhibits:
1. Permit Application dated September 20, 1983.
2. Retaining wall location and construction plans, undated and received
October 7, 1983.
3. Letter from Gregory and.Mary Farmer dated September 20, 1983.
They found the project as planned to be in accordance with the Rules and
Regulations, and Guidelines of the District and therefore approved the
permit as requested, with the following stipulations:
NONE
A followup inspection will be conducted at theproject site to assure com-
pliance with all agreements, terms and/or stipulations to this Permit. Fai:
ure to comply with the foregoing may result in rescission of the Permit, ai
is in violation of Chanter 112.89 MSA, a misdemeanor.
This document is not transferable, and is valid for one (1) year after the
date of issuance. No construction is authorized beyond expiration date.
If Permittee requires more time to complete construction, a renewal of the
Permit will be necessary.
Please contact us at 483-0634 when the project is about to continence so an
inspector may view the work in progress. The enclosed Owner's Certificatic
must be forwarded within 10 days of project completion.
