Raising my wall to accommodate the Lake at 821 will not keep the water from rising to a flooding level after a heavy rain. I don't know of any time the City has come without our calling. I question what if we were not available—middle of night, vacation, etc.). We will be raising your existing retaining wall to a minimum elevation of 821.5 feet and, if necessary, adding rip -rap along the base of the walls and in gaps between walls; ..Black dirt and seed will be added behind the walls to blend into the existing yard. This will give 6 inches of protection above the proposed lake elevation of 821.0 feet. This project will be completed by the City. We propose to begin this project this winter or early in the spring. The majority of the work will be done along the shoreline to minimize landscaping impact. Permission from you as the property owner is required before any work is begun. We are also enclosing a copy of Ms. Westenfield's letter of October 31,1997, wherein she expressed her misgivings about the proposed project. Ms. Westenfield has spoken with you or your staff a number of times but has yet to receive answers that satisfy her concerns. Raising the level of Lock Lake to 821.0 feet will certainly put Ms. Westenfields home in jeopardy. Her rear entrance and basement floor level are at 822.26 feet. In the past heavy rains have caused the water.level to raise between 2 and 2 %2 feet. With the dam at 821.0 feet such events in the future will cause significant harm to my client's property and that of other lakeshore homeowners in similar circumstances. We understand that increasing the level of the lake will aesthetically enhance certain homeowners property but in doing so you are putting the property of Ms. Westenfield and others in significant peril. We suggest that the lake level be set at 820.7 ;feet until such time that an electronic lowering device can be installed that would automatically regulate the dam height by the water level. This proposal would be an increase of .4 feet fromjthe exiting level. If the city still insists on raising the level of the lake, Ms. Westenfield will allow access to the property contingent on the following: 1) Her level be raised one block with new blocks conforming to existing.
