I am writing this letter with reference to the masonry -work done
at 98 Rice Creek Way.
I -am sure you recall that this has been brought to your attention
at least twice in the last month in our phone conversations and
also once when you were in our office.
Mrs. Sutter, the occupant, informs me that you still have not stopped
in at her house to arrange for making the corrections. Items needing
attention are the outside concrete slabs at the base of the patio
steps and at the back door of the garage. The.maximum rise is 8"
at these locations. Also she is experiencing serious Spaulding on
the front part of their garage floor.
Would you please contact Mr. Sutter to arrange for making these
corrections on or before September 1st and complete the work by
September 15, 1975.

BOARD OF APPEALS
TO WHOM IT MAY CONCERN:
NOTICE IS HEREBY GIVEN THAT the Board of Appeals of the City of Fridley
will meet in the Council Chamber of the City Tull at 7:30 P.M. on January 15,
1974 to consider the following matter:
A request for variances of; Section 205.053, 4,
Fridley City Code, to reduce the front yard
setback from 35 feet to 31.20 feet, and, Section
205.053, 4b, to reduce the side yard setback
from 10 feet to 9.40 feet, to allow the
completion of the dwelling and garage located on
Lots 41 and 42, Block 6, Fridley Park, the same
being 98 Rice Creek Way N.E., Fridley, Minnesota.

The City -Manager said the Board of Appeals had recommended approval of the
request in the sign variance which was for the purpose of changing the wording
of the sign for special events.
Councilman Starwalt said the applicant had ordered the sign and did not know
until after that time that this was not a conforming use in the Codes. He said
he thought the addition would be a benefit to the applicant and the area.
MOTION by Councilman Starwalt to concur with the recommendation of the Board
of Appeals and approve the request for the sign variance for Ground Round.
Seconded by Councilman Utter. Upon a voice vote, all voting aye, Mayor Liebl
declared the motion carried unanimously.

Mayor Liebl said the Board of Appeals had recommended to the Council that the
request be approved.
MOTION by Councilman Starwalt to approve the variance as requested for Fridley
Office Supply that the two unused signs be replaced and that the area be cleaned
up. Seconded by Councilman Utter. .Upon a voice vote, all voting aye, Mayor Liebl
declared the motion carried unanimously.

he supposed the. customer had looked at the existing signs and decided to have the
same size. Mr, Peu4h said the sign has not been made up yet.
Mr. Peugh stated the sign will be metal and have.a green background with white
lettering. He added that a sign seems large when you talk about square footage
but when a sign is erected, it seems to shrink as you get away from it. Mr. Peugh
said the customer just wants the sign to be seem from about the Sears Store and
the highway.
MOTION by Gabel, seconded by Plemel, to close the public hearing. Upon a voice
vote, there being no nays, the motion carried.
Mrs. Gabel said shei,can't see that just because the other signs are there, that
it would justify this variance, but she supposed the applicant feels he has a
right to this size sign as the priority has been already set.
Mr. Plemel said thiel sign is 10 square feet smaller than the Payless Shoe sign.
He said it would belnice if all of the signs could be uniform. He said on a
new shopping centers he would not be inclined to grant a variance for sign area
but this was a different case.
Chairman Crowder said his feelings on signs were.difficult to explain. He said he
is not in -the sign business so he doesn't know what size sign would be adequate
for a particular business or for reading from a distance of so many feet. He said
on this shopping center we have signs that are just about all oversized and this
is the last shop in the center to be occupied. He said the only reason he can
approve of this sign is because the others are existing and there is no reason
to deny this sign to set.an example.

Mr. Bob DeGardner was present to present his request.
Mr. DeGardner explained at the time the building permit was issued, the house
was positioned on the lot to meet all of the setbacks. He said they discovered
they had put the foundation in wrong when the verifying survey was made. He said
the dwelling has a jogged garage that is setback 33.20 feet, while the hoose is
setback only 31.20 feet. He said the east side iot line adjoins a 12 foot alley
easement so there shouldn't be any problem with the variance.

Chairman Crowder asked if there was any talk about eliminating this alley? Mr. Mattson
said it hasn't.been'a pressing issue.
Chairman Crowder asked what portion of the living area was on the east side of the
house? Mr. DeGardnr answered that the bedrooms are on that side.
Mrs. Gabel asked ifIthe adjacent land is vacant? Mr. DeGardner said it was vacant
but that he doesn't 'own it. He added that the owner of that land has two lots and
will probably face the house, if he builds, toward Hickory Street.
Chairman Crowder stated his only concern is with the lots to the east but it seems
the variances wouldn't affect them that much. He asked if there was a large
boulevard in front of this lot? Mr. Mattson answered approximately 10 feet.
MOTION by Gabel, seconded by Plemel, to close the public hearing. Upon a voice
vote, there being no nays, the motion carried.

Mr. Plemel said thee is a hardship due to the fact that the foundation is in.
He said there seems�to be no special problems involved.
Mrs. Gabel stated the intent to do it right is there.
Chairman Crowder sad the adjacent dwelling could have a problem but it would be
nothing major. He aid he couldn't see any precedent being set with the front
yard variance and t ere are no objections from the surrounding property owners.
MOTION by Gabel, seconded by Plemel, to recommend to the City Council, approval
of the variances. Upon a voice vote, there being no nays, the motion carried
unanimously.

Mr. Gary Bettcher was present to present his request.
Mr. Bettcher statedlthe two houses to the south of his lot are older homes that
have their own sewer systems and are built towards the river. He said the two
houses to the north *re newer homes and built closer to the road. He said if his
house has to be built with the average setback, he would have sewer problems as
the land slopes toward the river. He said he would also have to install a longer
driveway than he wants.
Mr. Bettcher presented a letter signed by his adjoining property owners that
stated they had no objections to the variance.
MOTION by Gabel, seconded by Plemel, to accept the letter of no objections. Upon
a voice vote, thereibeing no nays, the motion carried.
