Her complaint is that Mr. Bonine is conducting business in his house and trucks come in and out all hours of the day and he handles food so doesn't he need some food licenses. She asks whether he should be able to conduct this type of business in the home. Her second complaint is that he is building a much larger garage than would be allowed under the protective covenants for the plat. I indicated to her that the City can only enforce our local codes and if she feels she wants to get the covenants enforced, she should get a private lawyer to handle the case because of the civil nature of the complaint. I am attaching a copy of the covenants she gave me. It might be advisable for us to bring this to the attention of Mr. Bonine (this covenant), and also if there are any violations of the City Code, please see they are enforced. NMQ/ms CC: Darrel Clark Enc. 7/27/78 Please be advised members of our Inspection Department have con- tacted Mr. Bonine and informed him of the restrictive covenants applicable to the plat in which he resides. As far as can be determined, there is no evidence of violations of the City Code. Mr. BQnine operates a vending machine operation and therefore, his delivery trucks (2 vans) are parked in the driveway. There is no selling of materials from his house and no customers ever approach his house, so there is no violation of the home occupation ordinance. Mr. Bonine said that he would review the restrictive covenants and satisfy himself in his own mind that he is in compliance. Further, it should be noted that Mr. Bonine's supply trucks have been licensed by the City. He has been advised his new garage should not be used for the storage of food or machines.
