APPEALS COMMISSION MEETING, OCTOBER 9, 2002 PAGE 4 Dr. Vos stated that a quirement for a variance is a hardship, and he did not see anything in this request that show a hardship. He states he would vote against the appeal. Mr. Jones agreed. Mr. Jackson stated she bell ed this is a very important, viable ordinance, and it would be very difficult for the City to startm suring different levels on every driveway and try to have an exception based on decor. She understood that black asphalt may not look as good in the petitioners' situation, but, hopef,!o, the petitioners can find another option that would maintain the look of their driveway. She mented on how the Commission must be fair to everybody. Mr. Zinter stated that in the winter, it ust be hard not to pick up some of that gravel with a shovel or a snowblower, and having i end up on the driveway, on the sidewalk, or on the street. He, too, would vote for denial of the va 'ance. Mr. Kuechle stated he looked at the prop , and there is no doubt the petitioners have done a good job of maintaining it. He did not think he small water retention is really a big issue and thinks the argument can be made the water noff to the street in their situation is minimal. However, he also is not able to come up with clear hardship, and there are alternatives if they do not choose to use concrete or bituminous s ace. They could use flagstone which is of course a little more expensive. The concern he as is setting a precedent. MOTION by Ms. Jackson, seconded by Mr. Jones,o recommend denial of variance request, VAR #02-17, by Robert and Constance Metcalf. PUBLIC HEARING: VARIANCE REQUEST VAR #02-18 BY CATHERINE ANDERSON: Per Section 205.07.03.D.(3).(a) of the Fridley Zoning Code, to reduce the required rear yard setback from 25 feet to 23.5 feet to allow the construction of a garage and porch on Lot 20, Block 1, River Edge Addition, generally located at 132 River Edge Way. Ms. Stromberg stated the petitioners are requesting a variance to allow the construction of an attached garage with a porch connected off the back of their residence at 132 River Edge Way. The existing home will be connected to the proposed garage in a pie -shaped addition. Ms. Stromberg stated that in 1989 and 1995, variances were granted for this property to reduce the rear yard setback from 25 feet to 21 feet to allow the construction of an attached garage with a porch off the back of the home. The structure was never constructed and, therefore, the variances have become void. The property is zoned R-1, Single Family. The Robert Lewis Stevenson Elementary School is located directly to the south of the property. The existing APPEALS COMMISSION MEETING, OCTOBER 9, 2002 PAGE 5 home was built in 1957, and the existing garage will be removed to allow room for the proposed structure. Ms. Stromberg stated the "summary of hardship" submitted by the petitioners states: "I am planning to raze the old garage and build a new attached garage. In doing so, we will reduce the length of our driveway by 50 percent and it will allow us more green space. In order to build a reasonable -sized garage and porch, we will have to extend one and a half feet into the setback." Ms. Stromberg stated the City Code requires a rear yard setback of not less 25 percent of the lot depth but not less than 25 feet or more than 40 feet for any building. Due to the odd configuration of the lot, the petitioners are requesting the variance to reduce the rear yard setback of 25 feet to 23.5 feet. The proposed structure will consist of a 26'x 36' attached garage with a porch located off the back. The house and proposed garage will be connected in a pie -shape. Ms. Stromberg stated City staff has no recommendation as this request is within previously granted dimensions. A variance was granted in 1995 and 1989 to reduce the rear yard setback from 25 feet to 21 for this property. This year, a variance was granted for 1479 - 73`d %2 Avenue that reduced the rear yard setback from 25 feet to 15 feet. If the Commission approves the variance, staff recommends the following stipulations: 1. The petitioner shall secure a building permit for the proposed structure by December 31, 2002, and install a hard -surface driveway within 12 months of issuance of that building permit. 2. The petitioner shall obtain all necessary building permits prior to construction. 3. The structure shall be architecturally compatible with the existing home and finished with complementary siding and color scheme. 4. All vehicles shall be stored on the hard surface driveway as approved by the City. 5. The garage shall not be used for a home occupation or living area. The petitioner, Ken Anderson, presented a model of the structures. He stated there are no houses behind them and on one side there is a big fence (the City took part of their property for a walkway to the school) and on the other side is a fence. There is really no view by anyone of the rear yard. They are on a cul-de-sac so they have a real shallow lot and there is only so much that you can do. Dr. Vos inquired about the second story on the garage model. Mr. Anderson stated they are considering a second story for an extra bedroom. Mr. Bolin stated this would be for living space, typical of two-story homes or split levels where a garage is underneath the living area. Mr. Anderson stated there are two other homes with a similar second story. Dr. Vos asked why the need for the variance when it is only an extra 1 Y2 feet in the southwest corner. Mr. Anderson replied he would like the extra space for storage space behind the cars in the garage and that the 1 %2 feet makes a big difference. ANALYSIS AND CODE REQUIREMENTS In 1989 and 1995, variances were granted for this property to reduce the rear yard setback from 25 feet to 21 feet to allow the construction of an attached garage with a porch off the back of the home. The structure was never constructed and therefore the variances have become void. The difference between the previously granted variances and the current variance is the angle of the garage on the lot has changed, the porch will be located off the back of the garage instead of the home, and the current variance request has been reduced by 1.5 feet. The property is zoned R-1, Single Family and is located on River Edge Way at the end of the south cul-de-sac, north of Robert Louis Stevenson Elementary School. The existing home was built in 1957. There isn't a permit on file for the existing detached garage. The existing garage will be removed to allow room for the proposed structure. Existing Home City Code states that the rear yard setback shall not be less than twenty-five percent (25%) of the lot depth with not less than twenty-five (25) feet permitted or more than forty (40) feet required for the main buildings.
