NOTICE OF PUBLIC HEARING
Notice is hereby given that the Appeals Commission of the City of Fridley
will conduct a Public Hearing in the City Council Chambers at 6431 University
Avenue Northeast at 7:30 p.m. on Tuesday, May 14, ,1985 in regard to the
following matter:
Consideration of a request for variances
pursuant to Chapter 205 of the Fridley City
Code, to reduce the front yard setback from
35 feet to 27 feet, and reduce the side yard
setback on the.living side of a dwelling from
10 feet to 9.83 feet, to allow the construction
of an addition to the house and and a new
garage, on Lots 14 and 15, Block 1, River
Edge Addition, the same being 144 River Edge
Way N.E.
Notice is hereby given that all persons having an interest therein will be
given the opportunity to be heard at the above time and place.

there are objections from surrounding neighbors, the City Staff, or the petitioner

ADMINISTRATIVE STAFF REPORT
144 River Edge Way N.E.
A. PUBLIC PURPOSE SERVED BY REQUIREMENT:
Section 205.07.3D•1, requires a front yard with a depth of not less
than 35 feet except as noted in Section 205.04.4G.
Public purpose served by this requirement is to allow for off-street
parking without encroaching on the public right of way and also for
aesthetic consideration to reduce the "building line of sight"
encroachment into the neighbor's front yard.
Section 205.07.3D.2a, requires a side yard of not less than 10 feet
adjoining living area.
Public purpose served by this requirement is to maintain a minimum of
20 feet between living areas in adjacent structures and 15 feet between
garages and living areas in adjacent structures to reduce exposure to
conflagration of fire. It is also to allow for aesthetically pleasing
open areas around residential structures.
B. STATED HARDSHIP:
"#1 Front setback for new garage is 37 feet from street and 27 feet
from property line. Due to lot size and backyard elevation, there is
no other possible location for larger garage. Existing garage is
single car and we need the space for two cars. #2 New addition at
northwest corner is slightly less than 10 foot requirement. Conforming
to setback would cause unsightly jog in building.
C. ADMINISTRATIVE STAFF REVIEW:
The petitioner would like to convert the present garage to a dining
room (161x261) and construct a new garage (24'x24') in front of his
present garage. The front of the new garage would be 27 feet back from
the front property line and would be in front of his neighbor's houses.
The petitioner also plans to add 12 feet onto the back of their
bedroom. The addition would be 2 inches less than the required 10 foot
setback. If the variance is granted, it would be a westerly extension
of the present north wall of the house. The two houses are presently
in excess of 22 feet apart.
If the Board approves the requests, the staff has no stipulations to
suggest.

Mr. Joseph Maertins stated the house was built in the 1950's when single car
garages were popular. Now most people have two cars, and it was rather diffi-
cult to accommodate two cars with only a single car garage. He stated there
was not a feasible way to put a new garage behind the house. It was a large
lot., but harrow. What they are attempting to do, and what he thought was
architecturally pleasing, was to build the garage out in front (only an
additional 18 ft. beyond what is there; the present garage sticks out 6 ft.
beyond the house) and to add an entryway to the house to offset the depth
change between the garage and the house, so there was not just a garage sitting
in front of the house. He stated both the neighbors on the north and south
have given their approval to this proposal. He stated this was not a typical
block where all the houses are sitting in a row.
MOTION BY MR. PLEMEL, SECONDED BY MR. BETZOLD, TO CLOSE THE PUBLIC HEARING.
UPON A VOICE VOTE, ALL VOTING AYE, VICE -CHAIRPERSON BARNA DECLARED THE PUBLIC
HEARING CLOSED AT 7:49 P.M.
Mr. Barna stated this looked like the only place a garage could be built. With
the elevation of the lot, nothing could be done in the rear.
Mr. Plemel stated that since there did not appear to be any neighborhood
objection, he would be in favor of granting the variance.
MOTION BY MR. PLEMEL, SECONDED BY MS. GEROU, TO APPROVE VARIANCE REQUESTS
