will conduct a Public Hearing in the City Council Chambers at 6431 University
Avenue Northeast at 7:30 p.m. on Tuesday, October 28 , 1936 in regard to the
following matter:

ordinance upon first reading. Seconded by Councilwoman Jorge nson./)Upon a
voice vote, all voting aye, Mayor Nee declared the mot io carried
unanimously.
6. CONSIDERATION OF FIRST READING OF AN ORDINANCE RECODIFYING TjiE FRIDLEX UITY
CODE BY ADOPTING A NEW CHAPTER 803 ENTITLED "ORDINANCE E.ORCEMENT " AND
Mr. Hill, Public Safety Director, stated the Legislate,', a enacted Chapter 334
which went into effect on August 1, 1987. He stat„this legislation is
commonly referred to as the Police Practices Billnd under this new law,
the City must now give explicit authorization for non -peace officers to
issue citations for building, fire housing c e, animal, noise control,
zoning and other land use violations. He st d this ordinance would bring
the City in compliance with the State statu.
Mr. Hill noted that item 6, under Sectio (803.02 of this ordinance, should
be changed from Building Inspections t Building Inspectors and would be
corrected at the time of second readies` of the ordinance.
MOTION by Councilman Schneiderto � ve the first reading and approve the

7. REVIEW OF SP X87-01 BY EDiRD WALDOCH, AND CONSIDERATI
Mr. Robertson, Communit ;Development Director, stated when this special use
permit was approved, t e Council requested it be reviewed in six months. He
stated in the revi process, it was found only two out of the 14
stipulations remain ' o be completed. He stated this involves the repair and
striping of the p ng lot and sodding the area between the parking lot and
planting beds.Robertson stated Mr. Waldoch has provided the City with
a bond which ex /res on October 1, 1988 and it is, therefore, recommended
the deadline s to complete these two stipulations be extended until next
year, as the . 'andscape and asphalt contractors are booked for the rest of
this season
MOTION by�'bouncilman Schneider to concur with staff Is recommendation and
extend ffie deadline dates for repair and striping of the parking lot to May
309 19 and to extend the deadline for installation of the sod until June
6, 19 8. Seconded by Councilman Fitzpatrick. Upon a voice vote, all voting

A DIFFERENT COMMERICAL USE IN AN S-1 ZONING DISTRICT (SPECIAL
ZONING DISTRICT FOR HYDE PARK) LOCATED ON LOTS 27 AND 28,
BLOCK 12, HYDE PARK, THE SAME BEING 5973 3RD STREET N.E., BY
JOHN GLYNN:
Mr. Robertson stated this is a request for a special use permit" in the S-1
special zoning district for Hyde Park. He stated this partic far property
was the subject of a special use permit granted in 198,;,;' however, the
petitioner never took occupancy of the building and the Aeration wasn't
finalized. He stated Mr. Glynn is proposing a lower inte city use than the
one approved in 1985 and fewer parking spaces will be �quired.
Mr. Robertson stated the Planning Commission at thr October 21 meeting
recommended approval of this special use permit wiffii four stipulations which
he outlined.

Councilman Goodspeed stated last year he made the m ion to deny this
variance on the basis of the neighbor's objection. A felt two q ue st i ons
had to be addressed, one if the variance should be a oved and, second, the
policy on how to handle these requests in the fut e.
(bunci.lman Goodspeed stated Mr. Frocm's new ne' ghbor would prefer to have
the garage extended. He stated the Oouncil pay also consider an ordinance
this spring to prohibit parking on the str ets in the winter. He stated
with these two things in mind and, cons' ring Mr. Barna' s comments, he
would move the following:

the stipulation that there be openings in the west wall and it must be a

Mayor Nee stated he canthize with the issue raised by Mr. Betz old and
this should probably be&Iscussed at a Conference Meeting.
Mr. Herrick stated i he were to quote the tests of the Supreme Court, 90%
of the variances sh dn't be granted and this probably isn't unique to the
City of Fridley. stated whether the Cbuncil wishes to try and set forth
a formal policy how these are to be handled or continue on a case-by-case
basis, he didn' have a strong feeling. He stated he has taken the position
if the Council and the neighbors are satisfied, and the Oouncil is taking a
practical a cath, he didn't object. He stated the Council has to make
certain f i ngs and they, as the governing body, are authorized to make the
final deci on.
It wase general concensus of the council to review this at the Oonferenoe
Meetin and discuss what tests may apply.

A. PUBLIC PURPOSE SERVED BY REQUIREMENT:
Section 205.07.3, D, 2c, 3, requires that an attached or detached
accessory building which opens onto the side street shall be set back
at least 25 feet.
Public purpose served by this requirement is to allow for off-street
parking without encroaching on the public right-of-way and also for
aesthetic consideration to reduce the building "line of sight"
encroachment into the neighbor's front yard.
B. STATED HARDSHIP:
"We need a variance to attach the new garage and keep it in line with
the present building, and also to avoid moving the present incoming
power supply."
C. AEKINISTRAT1VE STAFF` REVIEW:
The petitioner presently has a one -stall garage. He would like to
enlarge it and he would prefer not to have a second detached garage in
the middle of his back yard.
If he is granted this variance he would add onto the rear of his
existing garage and provide a new driveway out to 62nd Way. 9bere is a
7 foot boulevard on 62nd Way, therefore there would be 27 feet between
the curb and the garage door.
The south wall of the addition would jog 7 feet to the north; an
additional .5 foot jog would make an attached garage addition
impractical.
Tb construct a detached garage would result in the removal of at least
one large mature tree.
The addition would be about 75 feet from the neighbor's house to the
east.
If the Appeals Commnission approves this request the only stipulation
the staff recommends is that the driveway be hard surfaced.

Councilman Goodspeed stated last year he made the motion to deny this
variance on the basis of the neighbor's objection. He felt two questions
had to be addressed, one if the variance should be approved and, second, the
policy on how to handle these requests in the future.
Councilman Goodspeed stated Mr. Frown's new neighbor would prefer to have
the garage extended. He stated the council may also consider an ordinance
this spring to prohibit parking on the streets in the winter. He stated
with these two things in mind and, considering Mr. Barna's comments, he
would move the following:
MOTION by Councilman Goodspeed to approve variance, VAR #86-29, to reduce
the side yard setback f ram 5 feet to 3 feet to allow construction of an
attached accessory building at 940 Pandora Drive N. E. , by Donald Froan, with
the stipulation that there be no openings in the west wall and it must be a
one-hour fire -rated wall. Seconded by Councilman Barnette. Upon a voice
vote, all voting aye, Mayor Nee declared the motion carried unanimously.
Mayor Nee stated he can sympathize with the issue raised by Mr. Betzold and
this should probably be discussed at a Conference Meeting.
Mr. Herrick stated if he were to quote the tests of the Supreme Court, 90%
of the variances shouldn't be granted and this probably isn't unique to the
City of Fridley. He stated whether the Council wishes to try and set forth
a formal policy on how these are to be handled or continue on a case-by-case
basis, he didn't have a strong feeling. He stated he has taken the position
if the Council and the neighbors are satisfied, and the Council is taking a
practical approach, he didn't object. He stated the Council has to make
certain findings and they, as the governing body, are authorized to make the
final decision.
It was the general conoensus of the Council to review this at the Oonferenoe
Meeting and discuss what tests may apply.
Mr. Herrick stated there are probably some memos frau his office in f ile on
this subject.

Mr. Robertson, Community Development Director, stated this is a request for

Commission Meeting of October 20, 1986. Seconded by Councilman Goodspeed.

Mr. Bill Aunt, Assistant to the City Manager, stated the Charter Commission
is recommending two revisions to the Charter. He stated one is requiring
election judges to be registered voters and the other removes a reference to
a State Statute which has been changed since the Charter was enacted. Mr.
Aunt requested the Council consider scheduling a public hearing for December
8, 1986 to consider these revisions.
NDTION by Councilman Schneider to set the public hearing on these proposed
Charter revisions for December 80, 1986. Seconded by Councilman Goodspeed.

Mr. Clark showed the Commissioners an aerial photo of the property. He stated
the garage will have to job 7 ft. to the north to get the 20 ft. To go any
further to the north to get 25 ft. would block one of the windows of the house
and the electrical would have to be moved. The petitioner will keep the
existing garage with the long driveway to Riverview Terrace and the new garage
with the driveway to 62nd Way.
Mr. Arnold stated he would like to put a double car garage on the back side of
his house. Right now he has just the single car garage. One of the reasons
for the new garage was that he and his wife have two cars, and his son will
soon be moving home adding a third car. They need garage space for three
vehicles. The garage width would be 24 ft.
Mr. Barna asked Mr. Arnold if he had considered that instead of having the
garage door opening and driveway onto 62nd Way, having the garage door openina
off the east side of the garage with a curved driveway onto 62nd. This would

enable the petitioner to keep the side wall straight, not having to move the
wall over. The 24 ft. width would then become the depth of the garage, and
there would be no need for a variance for an opening into a side yard. It
would just be a variance for the side of the structure from the side street
from 17 ft, to 15 ft. This was a variance that was more often granted
because it would be continuing the line of the existing structure; and,
aesthetically, it would look better to the neighborhood.
Mr. Arnold stated if he put the opening and driveway on the east side of the
garage, he would have to remove some large trees.
Ms. Arnold stated they already have a very long driveway to remove snow from
in the winter. They would not want another long driveway.
Mr. Clark stated the 7 ft. jog might be incorrect. It might be 5 ft.
Mr. Betzold stated that whether or not this is approved by the Appeals
Commission and whether or not it has to go on to City Council, he would
recommend that before the structure is built, that the measurements be taken
again to make sure this is all going to work. Some question has been raised
by Mr. Clark about a possible discrepancy of 2 ft.

Mr. Barna stated the Commission also has to look at the length of the driveway,
and they were talking about 27 ft. from the curb. The average car was 18-20 ft.
so there was still 7-8 ft. to the curb which really wouldn't block the view
that much. But, there were other ways for the garage to be built with a lesser
variance or no variance. The same size structure in the location proposed by
the petitioner could be built and moving the door from the south side to the
east side would not require a variance. He stated he was opposed to the
variance request.
Ms. Savage stated she would be opposed to an addition that would require the
removal of trees, and there was one large mature tree in the rear yard.
Aesthetically, to the neighborhood, she felt it was more important to keep the
mature trees. The house on the east was 75 ft. away from the proposed addition.
Aesthetically, it did not appear that the proposed addition would cause any
crowding on the lot.
Mr. Sherek stated the variance was necessary to accomplish the addition as
proposed. There was already enough driveway to clean in the winter with the
100+ ft. to Riverview Terrace from the existing garage. The access from the
east side, although it would simplify things as far as the code, did not
really accomplish a lot more. He did not see any problem with the proposed
addition layout and would be in favor of approving the variance.

Mr. Betzold stated this was an unusually shaped lot and the way the house was
designed on the lot was probably not the way it would have been designed today.
Ideally, the petitioners would like to have continued onto their existing
structure to the street, but that would probably have been opposed by the
Commission. So, the petitioners have come up with the second best alternative
with the jog and two driveways. The petitioners have made some accommodations
to try to make what they want fit on the lot. For them to try to do what
they would like to do and not have a variance at all would cause too much
tearing up of the back yard, removal of trees, etc. He would be in favor of
granting the variance.
Mr. Barna stated he felt this variance request fell into the same category as
the first variance request heard at this meeting. It was not a truly defined
hardship. The alternatives were too easily accomplished without the require-
ment of a variance.
Mr. Sherek stated he also had a problem with the removal of trees. Trees
were important aesthetically.

Mr. Betzold stated this item would go to City Council because it was not a
unanimous vote.
3. OTHER BUSINESS:
Mr. Betzold stated it was his intention to write a letter to the City Manager
and City Council asking for some guidance and clarification on the following
three issues:
1. What should the Appeals Commission do regarding two -car garages?
Should the Appeals Commission be denying the variances because
there are really no stated hardships? Or, should the Commission
take into consideration that if there is a single car garage and
the petitioner wants to build up to 3 ft, from the lot line, should
the Commission consider having a single car garage as a hardship?
By strict definition, they should not.
Mr. Barna stated that on Dec. 8, 1971, the Commission got a lot of information
from the City Manager and other people stating what the Commission had to look
at as far as a hardship, what things they could take and could not take into
consideration, and also mentioning the fact that in the situation they had

at this meeting where there were two similar variances --one was not granted
and was being sent on to City Council, and one could have been granted without
going to City Council, this could have resulted in a court case. There was
more of a hardship in the first case than in the second case. He stated it
was previously defined that if they were going to set up standards for trees
and other aesthetics, they are supposed to maintain those standards consistently
in granting variances. The City Council has stated several times when the
Commission has asked for guidance that the Commission was doing fine.
Mr. Betzold stated he kept referring back to the statutory standard that there
had to be something unique about the lot that made it a hardship, etc. If
that wasn't standard, the Commission would have to say they must deny variance
requests for expanding single car garages into double car garages, but he would
like to know from the City Council if that was the policy they want to set forth.
Mr. Barna stated the Council's guidance in the past was that the Commission
was not there for just strict enforcement. If the Council wanted strict
enforcement, there would be no need for an Appeals Commission. The Council's
guidance in the past was basically up to the Appeals Commission, what they
could live with, what they wanted, and what they thought the value of the variance
would be to the neighborhood, etc.
Mr. Betzold stated the code in the past, though, was not for two -car garages,
and he thought they should ask the City Council for any new guidance.
2. Questions on variances along the Mississippi River. The Commission
has had two variance requests along the Mississippi River in the
last year. The Commission has routinely sent these on to the City
Council. It was his feeling the City Council would like these
variance requests automatically sent to the Council, although the
Council has never actually directed the Commission to do so.
3. Parking lot stall widths.

Mr. Robertson stated this is a request for a special usep rmit in the S-1
special zoning district for Hyde Park. He stated this p ticular property
was the subject of a special use permit granted in 985, however, the
Petitioner never took occupancy of the building and he operation wasn't
finalized. He stated Mr. Glynn is proposing a lower ntensity use than the
one approved in 1985 and fewer parking spaces will required.
Mr. Robertson stated the Planning Commission aY their October 21 meeting
recommended approval of this special use perms with four stipulations which
he outlined.
MOTION by Councilman Fitzpatrick to concur with the recommendation of the
Planning Commission and grant specs use permit, SP #87-18, with the
following stipulations: (1) building f cede improvements, subject to staff
approval, to be completed by October , 1988; (2) landscape improvements,
as per City plan dated October 21, 987, to be installed by October 31,
1988. Location of plantings on no subject to Council determination; (3)
parking situation to be reviewed n two years (or sooner if necessary) to
determine adequacy of existi parking lot. If additional stalls are
required, petitioner will ins t 1 expanded parking with concrete curbing as
per October 21, 1987 drawing Contingent upon Council approval of lease of
approximately 1,604 square ee t of Lot 29, Block 12, Hyde Park; and (4 )
petitioner agrees that ny future reuse of the building is subject to
finding, through a spe al use permit process, that the reuse would be
compatible with the rrounding neighborhood. Seconded by Councilman
