Mr. Bob DeGardner was present to make appeal for this variance.
Mr. DeGardner said that the reason for the variance was that the house couldn't be
moved back any further because of steep river bank slope conditions and therefore
he had to ask for this variance to 60 feet. To go back any farther would create a
definite hardship. Mr. beGardner said that the house would be completely finished.
The entire back including the walkout would have cedar siding.
Mr. Minish asked if there was anyone that wished to be heard on this hearing.
Mr. Richard Harris and Mr. Harold Harris of 6200 Riverview Terrace and 6210 Riverview
Terrace came forward.
Mr. Richard Harris said that he had no objection to the, front setback variance.
What he objected to was the clear violation of the Codes by City Administration.
He said that DeGardner was led down the wrong path by the administration, The
administration had told DeGardner that if he got the neighbors to okay the variance
that they wouldn't have to go to the Board of Appeals and could get their permit.
The permit was issued without approval by the Board of Appeals and Council and they
started working. Mr. Harris said that he doesn't want this to become a habit. All
variances must be taken care of before the permit is issued.
Mr, Harris asked Mr. DeGardner if something would be done about the exposed concrete
basement block on the south side of the house. He asked if siding could be extended
or the block painted to give something more pleasing to look at.
Mr, DeGardner said that he would do whatever was necessary to protect the neighbors.
MOTION by Wahlberg to close the public hearing.
Seconded by Harju. Upon a voice vote, there being no nays, the motinn carried.
MOTION by Wahlberg to recommend to the City Council approval of the variance with
the stipulation that the exposed block on the south side be finished either by
extending the siding down or by painting.

Councilman Starwalt said he did not want to dwell on the matter, but he did
believe. Wa was the type.of expenditure that should be carefully watched.
Co4ncilman Utter agreed stressing th4 fact that the project called for an
additional expenditure of $6,000.00 over the amount budgeted. The City
Manager said the purpose of the item being presented to the Council was to
show the members the plans and determine if they had any suggested changes in the

may'have an the variances. He said he would not be available next week
scr he wished any questions could be answered at the present time.

1. That the applicant work with the City Staff to determine
means of blacktopping the section of alley used for access

Mr, James Hill, Public Safety Director introduced Mr, Charles Hanson., and said
Mr, Hanson had two years.experience as deputy sheriff with Anoka Cour-,-y and is
26 years of age, married and rives in Anoka-. Mr. Hill introduced Mr. Bary
W. Lanzmeier, age 27, and Mr. Phillip J. Salewski, age 26. Mr. Hill said one
of the other new men would be starting on the 26th of March.
Mayor Liebl welcomed the new men to Fridley.

Mrs. Bakke introduced herself and announced an upcoming meeting of the Nature

The City Engineer called the Council's attention to page I -A of the agenda and
said the request is to reverse the plan. The City Engineer said Mr. DeGardner
was present to discuss the matter.. The City Engineer said there was a problem
with the requested plan as the building does not fit the lot and either the
house.or the gargage would have to be cut by one foot fo.r the required amount
of side yard set back.
Councilman Brelder asked If the plan submitted to the Council in the agenda was
the new plan? The City Englnebr said, no, this was the old plan. The City
Engineer said there Is a minimum set back of five feet for the south side or
garage side. He added, on this side the plans will have to allow for a six
foot setback, because of.the existing slx.foot easement, or an additdonal set
back of one foot, The City Engineer asked who is the property owner on the
north side? Mr. DeGardner said, Mr. Al Johnson. The City Engineer said there
were two alternatives; one, approve the plans stipulating the house be cut down
by one.foot, or two, obtain approval from the property owner on the north side
and proceed with the reversing plan. Mr. DeGardner said the property on the
north side is vacant. Mayor Llebl asked if Mr. Johnson would object to the
variance? Mr. DeGardner said no, he was sure Mr. Johnson would not object.

r REGULAR COUNCIL MEETING OF MARCH 19, 1973
Mr. Richard Harris, 6200 Riverview Terrace, said he would like to se<: the south
elevation of the house. Mr. DeGardner said the elevation was a litt:e higher
than on the previous plan. He said the people he was building the h.,me for,
i had visualized the home angled®back. He added, with the change in p'.ans, it
i will enable the home owner to have a better view of the river.
Councilman Nee said he would recommend the second alternative of approving the
variance, contingent on receiving a letter of agreement from the adj�ent
property owner.
The City Engineer said the request was a simple request to flop the �)use plans
over, and he recommended the Council approve the request.
MOTION by Councilman Nee to close the Public Hearing. Seconded by C—ricilman
Breider. Upon a voice vote,all voting aye, Mayor Liebl declared the motion
carried unanimously and the Public Hearing closed at 7:52 p.m.
MOTION by Councilman Nee to grant the variance for a side yard set ba, --k on the
north side from ten to nine feet, contingent upon receipt of a letter of approval
from the adjacent property owner on the north side, Mr. Al Johnson; and to
approve the request to reverse the house plan. Seconded by Councilm-��i Starwalt.
Upon a voice vote, all voting aye, Mayor Liebl declared the motion carried

OLD BUSINESS:
DISCUSSION ON ACQUISITION OF PROPERTY IN CONNECTION WITH ISLANDS OF PLACE PROJECT:
Mayor Liebl said the Council had received a copy of a memorandum prepared by
the City Attorney on the matter and called on the City Attorney to express his
views.
The City Attorney said he would like to make a correction on the last para-
graph of the memorandum changing "purchase agreement" to "option".
The City Attorney said he had been contacted by Mr. Ed Wilmes who stated he
and Mr. Minder, the property owner, had had some discussion on acquiring the
property which Is adjacent to Chase Island for the Islands of Peace Project.
He said they had discussed price and terms of a possible agreement. The City
Attorney said the Fridley -Lions Club had contributed $2,000,00 to the project
as option money for the two sites. The City Attorney explained that the Islands
of Peace fund is under the jurisdiction of the Council and the Committee is
an ad hoc committee with appointments by the Council. He said in order to
approve entering Into this option agreement, it would have to be done through
the City to obtain proper title,
The City Attorney said the Committee had indicated they wanted to enter into
the option agreement with Mr. Minder, He added, the $2,000.00 would be used as
option money, He said if the option is exercised the option money would be
applied to the price of the land. He said if the option is not exercised, the
money would be forfeited, The City Attorney said an additional $13,000.00
would have to be paid to Mr. Minder at the time the option is exercised or
at the time of closing.

The City Attorney said Mr, Minder was present at the meeting.
Mr. Wilmes said he believed the approval of the request was important to the
Committee and also the entire area. He called on Mr. Foster Dunwiddie, Miller-
Dunwiddie, Architects, Inc., to present the matter for the IslAnds of Peace
Committee. He said, Mr. Richard 0. Jacobson, Islands of Peace Advisory Board
member from the Fridley State Bank.,was also presgnt.
Mr. Dunwiddie addressed the Council and Audience and placed a map of the area
on the easel. Mr. Dunwiddie said what they were discussing that evening was
the acquisition of two lots or a four acre tract. He said the.land acquisi-
tion had been discussed at the February 5, 1973, meeting of the Council. He
said the land would be used for the construction of shelters and be used for
a reception area for the project. He added, the problem of the island being
within the flood plain zoning area subjects it to some inundation. He added,
there would be some saving.in cost to the project by the acquisition of the
lots and also, the sewer and water are within close proximity.
Mr. Dunwiddie said he would like the Council to approve the Committee's request
to enter into an option agreement at this time. Mr. Dunwiddie stressed the
importance of approving the request at the present meeting saying the Committee
would only have 60 days to assemble the balance of the down payment. Mr.
Dunwiddie listed many foundations and corporations that may be willing to
contribute to the balance.
Mayor Liebl asked Mr. Dunwiddie if the two lots were essential to the project
in his opinion, and Mr. Dunwiddie said they were vital because they would save
on the cost of,the project and add to the entire plan.
Councilman Breider questioned if 60 days would be an adequate amount of time
to raise the remainder of the money? Mayor Liebl said he thought there should
be more time allowed. Mr. Dunwiddie said the Committee would also like more
time, but Mr. Minder has a purchaser for the lots. The City Attorney agreed,
this was what Mr. Minder had said, to the best of his knowledge. Mayor Liebl
asked Mr. Minder if this was.the case, and he said it was.
The City Manager said he was concerned if whether the Lions Club was fully
aware that the money would be forfeited if the balance is not raised. Mr.
Dunwiddie said the Lions Club was award of this. The City Attorney said the
City can not enter into a contract for treed. He said, in case of default,
the seller would have to take the property back. Mr. Minder did not agree
and stated, he had the same privilege of foreclosure. The City Attorney
said, Mr. Minder could not sue for the balance.
Mr. Minder said he did not want to get into trouble at any time. He said he
did not wish to be put into the position where someone would ask "why didn't
you give the money back to the Lions Club?". He said he had a purchaser for
the property and he had given him an option, He said if he waited one more
year there would be $2,000.00 in taxes and special assessments on the property.
He said he did not want to think he had taken money from the Lions Club. He
said.if the option was not exercised he did not want anyone present or anyone
from the Lions Club to have hard feelings.

Chairman Drigans asked how the room would'be heated.
Mr. Johnsons said he would use some kind of independent auxillary heat.
The aerial photo of the area was shown to the Board.
Mr. Harju asked how much area is between structures,
Mr, Johnson said from wall to wall there is approximately 16 feet. He said
his garage is 5,6 feet from the line and his neighbors is 10.5 feet from the
line.
Mr. Crowder noted the houses are on a cul de sac so the back of the homes are
farther from the line but a firewall may be required by the Building Inspector
in case the neighbor was to enclose his screened porch which would bring two
living areas closer than 20 feet,
Mr. Harju asked if a door was to be installed from the garage to the patio and
Mr. Johnson answered that there would not be.
MOTION by Crowder, seconded by Wahlberg, to close the public hearing. Upon
a voice vote, there being no nays, the motion carried.
Mr. Harju stated he felt it was a reasonable request. He added he felt the
cases where living areas are behind garages should be covered by the Planning
Commission.
MOTION by Crowder, seconded by Harju, to recommend to Council approval of the
variance with the following stipulations; I. The wall between the porch and
garage is to have the necessary fire rating, 2. The wall on the north side of
the patio is to have no openings and contain the necessary fire rating, Upon a
voice vete, there being no nays, the motion carried,
MOTION by Wahlbez% seconded by Crowder, to waive reading the public hearing
notice. Upon a voice vote, there being no nays, the motion carried.
.Mr. Jerry Johnson was present to present the request, The verifying survey
of the dwelling was presented to the Board for their review.
Mr. Johnson explained they had gotten approval of a variance of the front yard
setback for this house, 'Then they had decided to reverse the house plan and
they received approval, on that. He said when they laid out the house they came
up with side yards of 6 feet and 8 feet. He said apparently there was a
misunderstanding between the surveyor and himself and the foundation was laid
with aide yards of 6,6 feet and 6.8 feet. He added after the surveyor is out
to verify the foundation, they wait three days before they continue construction
and by then City Hall hAq their copy of the verifying survey. He said they did
wait three days and on the fourth day they start9d building. When he received

his copy of the survey, on the fourth day, he noticed the mistake in the side
yards and pulled his crew off the job and came up to City Hall to talk to the
Building Inspector. Mr. Johnson added the only thing they could do is to build
the house to the north of this lot farther away from the adjoining lot line to
acquire the required footage between structures. He said he plans to start
the house on the adjoining lot within a week or two.
Mr. Dick Harris, 6200 Riverview Terrace, stated he had no objections to the
variance as long as the stipulations for the previous variances on this property
would still be in effect.
Chairman Drigans stated this variance would not alter the stipulations for the
previous variances. He then read the Code concerning verifying surveys which
stated the verifying survey showing the location ofthefounda�ion shall be
required before the framing of the structure is begun.
Mr. Johnson stated he was in error by not having the survey in his possession
before they started framing but City Hall usually gets ,their copy of the survey
in three days which in this case they did not.
Mr. Crowder asked if on the dwelling to the north, would the garage side be
toward this house.
Mr. Johnson said they would rather put the living area on the south side because
the two structures would then be farther apart, but they could' :do it that way
if the Board requested it.
Mr. Harju stated he felt the City should have a written agreement on the location
of the dwelling to the north.
Mrs. Wahlberg asked what the City's feeling was on this variance.
Mr. Nordahl stated the City wanted the stipulation that the house to the north
would be built farther from the adjoining lot line to insure the required footage
between structgres.
MOTION by Wahlberg, seconded by Harju, to close the public hearing. Upon a voice
vote, there being no nays, the motion carried.
MOTION by Harju, seconded by Wahlberg, to recommend to Council approval of the
side yard variance from 9 feet to 6.35 feet with the stipulations that Mr. Johnson
supply the City with an agreement that the house to the north will have a side
yard setback 'increased to a comparable amount to stay within Code and that all
the stipulations for the previous variances should still be considered in effect.

Mayor Liebl asked Mr. Clark to explain the overall consensus of the Board of
Appeals and why they had recommended the Council grant the variance.
Mr. Clark said the applicant had requested the Council grant a side yard setback
from 5 to 1.2 feet to build an addition on the existing garage to make that
garage 20 feet wide. He said the Board of Appeals had recommended the Council
deny the 1.2 foot setback and approve a 2.2 setback. He said they stipulated
the wall to the east of the garage would have no openings and proper firewalls
as determined by the Building Inspector and would be provided.

MOTION by Councilman Starwalt to receive the letter from Mr. Rodger L. Sorseleil
opposing the approval of the variance dated May 2, 1973.
Seconded by Councilman Nee. Upon a voice vote, all voting aye, Mayor Liebl
declared the motion carried unanimously.
Mayor Liebl called on rIr. Sorseleil to state his objections to the variance.
Mr. Sorseleil said his objections were as listed in the letter.
Mayor Liebl asked if the appearance hazard meant that the construction would
block the view from his home.
Mr. Sorseleil said he felt that if this variance was granted all other persons
in the neighborhood would request the sante thing and it would affect the
appearance of the entire neighborhood. He said he had not added a full two
car garage when he added on, he had only added a one and a half car garage.
Mayor Liebl asked Mr. Clifford Rickhoff, 1567 -60th Avenue N. E., if he objected
to the approval of the variance? Mr. Rickhoff said he was not opposed.
Mayor Liebl asked Mr. Allen if the requested variance was absolutely necessary.
Mr. Allen said this was the least he could go and still have a double door.
Mr. Allen said he felt the double garage he was requesting would be safer
than a tuck under garage. He said this would be several feet from the neighbors
construction and would have a fire wall. He said he has two cars and they
sit outside, there is a greater degree of danger with the cars outside and
also a greater noise factor.
Mayor Liebl asked if Mr. Allen had agreed to construct the fire wall. Mr. Allen
said he had agreed.
Mayor Liebl said he would comply with the stipulations if he were to construct
the fire wall. Mayor Liebl asked Mr. Allen if the two and a half feet would
be enough space to maintain the building? Mr. Allen said he planned to install
aluminium siding on the garage. He said he intended to improve his property
and increase the value of that property. He said he was aware .that a house
with a single garage was worth considerably less than one with a double garage.
MOTION by Councilman Starwalt to continue the item on the variance request
by Mr. James Allen until next meeting May 14, 1973, Enabling him to go to the
site and determine the effect of the proposed construction.
Mayor Liebl said the members of the Board of Appeals had to look at the site.
He said he felt that if Councilman Starwalt also felt he had to look at the
site this was possible.
UPON A VOICE VOTE, all voting aye, Mayor Liebl decIv red the motion carried
unanimously.
Councilman Breider said there would be many public hearings the following meeting
and he suggested the continued items appear on the agenda before the Public
Hearings so the people involved would not have to sit through another long
meeting. The rest of the Council agreed.
